Mail / Discussion

  • Preliminary plans for subdivision behind Congregational Church from the Planning Board.  The Commission reviewed the plans and determined the project was not within its jurisdiction.
  • Ed Simpson presented a letter, which he had received from his mortgage lender, as an example of how FEMA-determined flood zones were being interpreted for lending institutions by third party businesses. Letter that Agent Greenberg-Lemos wrote to Dr. Mabee,  of the Provincetown Center for Coastal Studies regarding geological and underwater mapping of Wellfleet Harbor.
  •       Judy Ellis and John Hirsh,  property owners on Snake Creek Road, off High Toss Road, appeared before the Commission for advice on whether an engineering plan and permit was needed for permission to fill holes in their road.    It is partially owned by the Seashore.  Agent Greenberg-Lemos said that it would require an engineering plan showing road layout and wetland boundaries, and suggested filing a NOI because it is located at the edge of a wetland.  Ms. Ellis stated the area is no longer than ¼ mile.  Oil trucks would not deliver oil anymore, and it is questionable if emergency vehicles can get in.  It appears it is a private road, but this needs to be checked.   Ellis and Hirsh were concerned about  the expense of an engineering plan. 
  • USGS is measuring nutrient flux from Herring Rive marshes as part of pre-restoration monitoring.  Accordingly, John Colman of USGS has requested permission to install weirs on Bound Brook and Pole Dike Creek; however, final locations are still to be determined.
  • Agent Greenberg-Lemos called Mark Adams regarding the current position of the ACEC boundary, normally 100 ft landward of the 10-ft elevation contour, now that the accepted reference datum has changed from NGVD29 to NAVD88.  The issue was raised recently by  David Lajoie of Felco.  [John Portnoy subsequently contacted GIS and Cartographic Specialist Mark Adams at the Seashore, who explained that the correction factor of 0.86 ft, subtracted from any NGVD elevation, was sufficiently accurate to convert elevations to NAVD88 anywhere in Wellfleet.].

Cary Rea announced the Open Space Committee will be requesting a transfer of three parcels of e town owned wetland properties to Conservation Commission jurisdiction.

Jurisdictional Opinions:  none

Emergency Certificate:  720 Ocean View Drive – will be filing an NOI to move the house away from the coastal bank.

Yudowitz – working with a representative regarding the rocks on Omaha Road

Meeting Minutes:  October 21, 2010:   Cary Rea moved to approve the amended meeting minutes; seconded by John Portnoy; passed 3-0.

October 7, 2010:  Barbara Brennessel moved to approve the amended meeting minutes; seconded by Cary Rea; passed  4-0.

 Revegetation work will be performed on Nov. 16 at the sluiceway.

Public Hearings 5:00 pm:

Cotton, 145 Indian Neck Rd., Map 28, Parcel 135, Certificate of Compliance:  (septic system).  Needs inspection by Health Dept. before issuing.  Ginie Page moved to approve the Certificate of Compliance for the septic contingent upon the Health Dept approval; seconded by John Portnoy; passed 6-0.

Reavey, 145 Indian Neck Rd., Map 28, Parcel 135, Certificate of Compliance (dwelling).  Agent Greenberg-Lemos stated the project is in compliance.  Cary Rea moved to approve the Certificate of Compliance; seconded by John Portnoy; passed 6-0.     

Barrio, 110 Springbrook Rd., Map 47, Parcel 30, AOOC.  Jason Ellis represented the applicant and William Barrio came to the table.  Jason stated there was a conceptual house plan previously approved and Mr. Barrio would like to reconfigure the design of the house.  The dwelling will be smaller in size, but decking and a garage will be added.  The new proposal has ½ of the garage and some decking within the 100 foot buffer zone.    The shed will be used to house oysters during the winter time.  The well is in, and the septic system will remain in the same location.  All excavated dirt will be moved offsite.  After discussion about the shed and its full basement , the commission requested it be located outside of the 100-ft buffer zone with no driveway.  John Portnoy moved to approve the AOOC with conditions; seconded by Ginie Page; passed 6-0.  Supervisor:  Ed Simpson

Verna, 134 Compass Hill, Map 41, Parcel 62, RDA, remove and rebuild ramp, steps and rooftop deck.  Winslow Grullemans represented the application and stated the work was required because the structures were rotting and becoming unsafe.   The work has already been performed (after the fact filing).  John Portnoy identified the project as a Negative 3; seconded by Cary Rea; passed 6-0.  

NPS, Gussack House Way #625, off Long Pond Rd., Map 16, Parcel 630, RDA, remove abandoned water well equipment, existing waste pipe and install 1000 gallon recirculation tank, install electrical service, backfill, loam and reseed.  Lauren McKean recused herself but remained at the table to provide additional information.  Bruce Hebbel gave an overview of the project.  He identified the work limit, the excavation locations, and described the area the materials would be placed in at the worksite.  McKean stated that concrete blocks dumped within an adjacent wetland  will be removed by the Seashore.  Portnoy pointed out that elevations on the plan have no units and no reference datum; Hebbel responded that the plan was given to him, so he could not identify the reference datum.  Ed Miller of the Provincetown Banner questioned who the occupants would be and   Lauren McKean responded there is additional paperwork with the National Seashore to be finished.  Cary Rea identified the RDA as a Negative 3; seconded by Cary Rea; passed 5-0.

Ginie Page moved to adjourn at 5:45 pm; seconded by Ed Simpson; passed 6-0.
