October 7, 2015

4:00 - Business Meeting & Conservation Agent's Report

Mail / Discussion:

  • Letter from Nancy Rea regarding the New England Wild Flower Society harvesting sea lavender seeds.   She expressed concern that  harvesting wild flowers in a public area like Hamblen Park would send the wrong message to park visitors.
  • Enforcement order sent to Ellen Fedor/DiToro for activity using heavy black plastic to kill invasive plants in the buffer zone after septic installation.  Order was to remove the black plastic as well as a listing of plantings for mitigation.
  • Violation 134 Compass Hill Rd – reconstruction of deck and ramp within resources without commission's approval.
  • Planning Board – site plan for a sub-division, requesting commission to review.

The subdivision will be behind the Congregational Church.  After reviewing the site plan, the commission expressed concern with drainage, and the possibility of wetlands.  Agent Greenberg-Lemos will make a site visit regarding any wetlands.

  • Letter from Dana and Dorothy Brooks regarding complaint about the kayak crisis on Lt. Island.
  • Letter from Cape Cod Commission stating that it had approved the proposed cell tower in South Wellfleet.

Agent Greenberg-Lemos stated the ACEC line could have an error factor of plus / minus 10 feet  and the conversion factor from the old vertical datum to NGVD 88 is +0.86 ft.  She stated the local regulations will have to be amended with this information.  Revision of regulations will be on the agenda for 10/21/15.

 

Indian Neck – people are driving around the fencing built to restrict off-road driving.

Sluice Way – Lauren McKean stated flags (unknown source) were placed on shrubs along the path to the sluice way, which would have widened the walkway.  Lauren received permission to remove the flagging because it is incorrect.  She stated cars are parking near the Sluiceway and parking in areas that are not designated parking spots.    

Lauren McKean stated the National Seashore personnel made visits to the ponds.  Duck Pond needs plantings and jute along either side of the path. At Dyer Pond, users have created new beaches.  Spectacle Pond requires some help but is not as bad as expected. She stated the Long Pond parking area is in very good shape.

Jurisdictional Opinions

Todd Spencer, 55 E. Commercial St., 22/21, replace existing 10 x 12 tool shed with 10 x 14 shed.  After a site visit, it was noted that the current shed is very close to Duck Creek and the bank.  Trudy Vermehren moved to recommend an RDA be filed, seconded by Barbara Brennessel; passed 5-0.

Public Hearings 5:00 pm:

Town of Wellfleet, Gull Pond Sluiceway, Map 4, adjacent to Parcel 33, RDA, restore pedestrian access routes and vehicle access route with native vegetation.  Agent Greenberg-Lemos stated funding was received for the plantings and fencing.  She stated she is hoping the project will take place this fall.  Trudy Vermehren identified this as a Negative 3; seconded by Ed Simpson; passed 5-0.

Baptist, 461 State Hwy, Map 30, Parcel 19, RDA, construct shed (Cont’d).  Ed Simpson recused himself.  The commission made a site visit.  Mr. Baptist did not supply a plot plan as requested.  Mr. Baptist stated timbers could be placed under the containers.  There was further discussion regarding the location of the containers.  Mr. Baptist stated he would do some measuring to determine if the containers will fit on the pavement.  He stated he may fence off the area for refuse.  Trudy Vermehren moved to continue the hearing until April 2016; seconded by Barbara Brennessel; passed 4-0.

Verma, 134 Compass Hill Rd., Map 41, Parcel 62, RDA, prune and/or remove black locust (Cont’d)  A site plan was provided to identify what plants/trees would be removed and what would be replanted.  Lauren McKean identified this project as a Negative 2; seconded by Ed Simpson; passed 5-0.  Supervisor:  Ed Simpson

Kemmling, 195 Kendrick Ave., Map 20, Parcel 23, NOI, bulkhead replacement and beach nourishment (Cont’d).  Don Monroe represented the applicant and stated additional plan notes were added to the site plan.  There was discussion regarding Plan Note #6 and the monitoring of sand renourishment at a 6 month timeframe.  Agent Greenberg-Lemos suggested April 1 and October 1 for the monitoring.  Lauren McKean moved to approve the NOI; seconded by Barbara Brennessel; passed 5-0.

Bromberg, 195 Samoset Ave., Map 28, Parcel 97, NOI, remove and rebuild dwelling (Cont’d) At the request of the applicant, Trudy Vermehren moved to continue to October 21, 2015; seconded by Cary Rea; passed 5-0.

Yudowitz, 75 Omaha Rd., Map 28, Parcel 189, RDA, control parking with large stones inside property line.   (a previous RDA was approved utilizing posts, not rocks).  No one attended the meeting.  Agent Greenberg-Lemos will issue a letter stating the stones were placed incorrectly.  Trudy Vermehren moved to continue indefinitely so Agent Greenberg-Lemos can send a letter. 

Trudy Vermehren moved to close the public hearings at 6:40 pm and reopen the business meeting.

Jurisdictional Opinion:  Shed at 55 E. Commercial Street – discussion with Jamie McGrath from Pine Harbor Wood Products. Trudy Vermehren told McGrath the commission had ruled that the Spencer’s would need to file an RDA because the commission would like to see the new shed farther out of the resources.

Trudy Vermehren moved to adjourn at 6:45 pm; seconded by Ed Simpson; passed 5-0.
