Attendees:  Trudy Vermehren, Barbara Brennessel, Ed Simpson, John Portnoy, Ginie Page, Cary Rea and Lauren McKean

4:00 – Business Meeting

Request for response regarding a subdivision from Planning Board at 35 and 40 Edmester Drive.  It is currently one parcel and they want to divide it into two lots.  The property is not within Commission jurisdiction; therefore,   no comment from the Conservation Commission.

Mail:

Cape Cod Commission:  Hearing Notice, Dec. 4:  Orleans Phosphorus Fertilizer Program.

Cape Cod Commission:  Agenda for 12/9, 12/10, 12/11:  Regional Plan 5 year update

Cape Cod Commission:  Notification of Amendments to CCC regulations

Town Administrator:  Request to comment on possible sale of portion of town-owned Map 14 Lot 4.  The Commission has already commented and voted not to recommend sale.

Community Development Strategy for FY 2015 – to be discussed at 12/17/14 meeting

Jurisdictional Opinions:

Woodes, 55 Commercial St., exact replacement of deck.  Trudy Vermehren moved to approve the Jurisdictional Opinion; seconded by Ginie Page; passed 7-0.

25 Heron Point Rd (Lt. Island), perform exploratory drilling for new well site.  Ginie Page recused herself.  The hope is to find potable water 10 feet from the current well.  John Portnoy moved to approve the Jurisdictional Opinion with the condition the exploratory drilling will be performed using small track equipment to minimize damage to vegetation; seconded by Ed Simpson; passed 6-0.

Trudy Vermehren provided an article from “The Natural Farmer” about managing nitrogen.  She also distributed materials from the Orleans Conservation Commission.

Agent Greenberg-Lemos stated the Seashell Condos received an emergency order certification to perform renourishment if necessary due to bad weather.  A hearing is scheduled for the December 17 meeting.

Wellfleet will host a DEP Workshop on new regulations, especially regarding salt marsh restoration, on January 8, 2015 from 9:00 – 12:00 at Town Hall.

Public Hearings 5:00 pm

Van Ness, 48 Sandpiper Hill Rd., Map 22, Parcel 7, Certificate of Compliance.  Agent Greenberg-Lemos stated the work for the septic system and well is in compliance.  Trudy Vermehren moved to approve the Certificate of Compliance; seconded by Ed Simpson; passed 7-0.

Van Ness, 48 Sandpiper Hill Rd., Map 22, Parcel 7, Certificate of Compliance.  David Lajoie will supply a letter verifying the work is complete.  To be continued to December 17, 2015.

Taylor Management, 165 3rd St., Map 40, Parcel 104, RDA, shed.  A site visit was made by the commission.  The owner of the property was unable to attend the meeting due to a family emergency.  Abutter Joanne Garfinkle stated she had concerns with the location of the proposed shed which included potential damage due to wind, the newest flood zone which would place it in the VE level, and she felt it would be better located behind the dwelling.  Mr. Taylor had supplied Ms. Greenberg-Lemos with a revised plan showing the shed angled at the same location but turned slightly to reduce wind resistance.  The commission stated there would be cutting of trees and shrubs built farther south behind the house,  and it would not be easy access.  Ed Simpson moved to identify the RDA as a Negative 2; seconded by Ginie Page, passed 7-0.  Conditions:  utilize an anchoring system to the shed and locate it on an angle as submitted in the revised plan from the applicant.

Brown, 465 Chequessett Neck Rd., Map 19, Parcel 126:  RDA, tree removal and pruning.  Trudy vermehren recused herself and made the presentation regarding the project.  Many of the trees are damaged or dead.  Those requiring pruning could cause damage to structures.  Those trees in the open area are diseased.  No stumps will be removed.  Portnoy noted that dead trees retain habitat value; therefore, the Commission needs to consider this and be consistent in justifying approval of their removal.  John Portnoy identified the RDA as a Negative 2; seconded by Lauren McKean; passed 5-0 with one abstaining and one recused.  John Portnoy will supervise.

Rispoli, 15 LeCount Hollow Rd., Map 30, Parcel 22, AOOC, expand under cooler.  David Lajoie represented the applicant and gave an overview of the project.  Excavation will be performed by a small bobcat machine; the materials will be removed by hand and carried off site.  Trudy Vermehren moved to approve the AOOC; seconded by Cary Rea; passed 7-0.  Supervisor:  Lauren McKean 

Kandel, 60 Bay View, Map 35, Parcel 37, NOI, control bank erosion.  Ginie Page recused herself.  Don Monroe of Coastal Engineering stated approximately 40 + cubic yards of nourishment will be used on the beach, and about six cubic yards to fill a hole near the top of the bank.  He requested additional renourishment for the Spar property which has fiber rolls on it.  Agent Greenberg-Lemos stated a separate filing would have to take place for the Spar property.  The bank is owned by the Conservation Trust.  The Board of Selectmen need to be notified of the work as well due to accessing Town property for the project.  Bank nourishment will be dumped into the hole in the bank  with a conveyor, and then spread and raked by hand and replanted.  Bittersweet will be removed by cutting the plant and treating the roots.  Trudy Vermehren moved to continue to 12/17/14; seconded by Ed Simpson; passed 6-0.
