We reviewed an article in the Cape Codder regarding a Board of Selectmen meeting on 07/14/15 covering  snow plowing and private roads.  Ed Simpson stated the DPW and town are requiring vegetation removal on private roads before the town will plow snow.  .  The Commission agreed that  jurisdictional opinions or RDAs will be required for vegetation removal within the buffer zones of wetlands and coastal banks.      

A new Google Earth image  of Indian Neck shows the new fencing and plantings installed by the Commission and AmeriCorp. 

Agent Greenberg-Lemos reported there are two grant opportunities:  land management for $4,000 and a wildfire grant.  She requested the commissioners report back to her with any ideas. 

Letter from Ellen Berezin stating what she has planted (need map and plot numbers).

A letter from Jason Zimmer, Mass. Division of Fisheries and Wildlife, stating that the boats (vessels) are located on the road layout on  Field Point and not on state property.  Regradless of land ownership, the vessels are damaging dune vegetation and not  permitted; there is no boat rack there.    Agent Greenberg-Lemos will check a previous filing regarding road work in the area to see who actually owns the property where the vessels are stored, and if there are any time-of-year restrictions on adjacent road work. 

Trudy Vermenren stated that few boats have permit stickers on the kayaks/canoe racks at Pleasant Point.  Agent Greenberg-Lemos  stated enforcement is not consistent, evidenced by boats with and without permit stickers.   Current rules and enforcement are complicated involving the state, Beach and Conservation Departments, as wells as private property owners.  It was suggested by Greenberg-Lemos and Portnoy that a simpler long-term solution may be to abandon the permit and fee system, allow boat storage on a first-come basis, and remove any vessels stored on the ground and/or on vegetation. The Commission’s goal is to prevent damage to dune and marsh plants.   There was also discussion regarding boats at Gull Pond (Aunt Sally’s landing) stored on shoreline vegetation.   Agent Greenberg-Lemos and Lauren McKean will make a site visit to Aunt Sally’s.

Jurisdictional Opinions

            Heidi Harris, 30 Fox Island Road, Unit 9, remove 1 pine tree leaning over the cottage and 1 dead shrub.  John Portnoy moved to approve the Jurisdictional Opinion; seconded by Ed Simpson; passed 5-0.

Meeting Minutes

Barbara Brennessel moved to approve the amended June 17, 2015 meeting minutes; seconded by John Portnoy; passed 4-0.

Agent Greenberg-Lemos reports DEP will make a site visit to Mayo Creek on  Wednesday, July 22, 2015 at 1:00 pm.  This is in response to the appeal by Harborside Village Cooperative Corporation of the Commission’s approval of the temporary removal of the tide gate for hydrodynamic model validation.

Public Hearings 5:00 pm:

Zelinsky, 170 Pond Ave, Map 29, Parcel 382, Certificate of Compliance.  Agent Hillary Greenberg-Lemos reported the work was never done.  Trudy Vermehren moved to approve the Certificate of Compliance to close out the Order of Conditions; seconded by Barbara Brennessel; passed 5-0.

       

Dzen/Dechirico, 190 Blue Heron Road, Map 41, Parcel 12, NOI, vista pruning, removal of trees, replanting and construction of at-grade deck (Cont’d from 06/03/15).   David Lajoie represented the applicant and stated the diamond piers will be used for support on the deck.  [I thought Ed’s idea of simple concrete posts was accepted.]  On the revised site plan, the kayak rack is identified.  However, the required planting plan was not provided by the landscaper; therefore, Trudy Vermehren moved to continue to August 5, 2015; seconded by Ed Simpson; passed 5-0.

Manning, 1694 State Highway, Map 30, Parcel 84, RDA, Construct shed.  A site visit was made and John reported the shed covers a large area and the plan does not identify the dimensions, location of the buffer zone, or mitigation plantings.  Mitigation (planting)  has not been completed for the original (2010) filing for the house construction.  John Portnoy stated he believes the shed is located within the 50-ft buffer of the adjacent wetland.  Agent Greenberg-Lemos will determine if this wetland is jurisdictionally “bordering vegetated wetland” or “isolated land subject to flooding”, relative to the Wetlands Protection Act..  Trudy Vermehren moved to continue to August 5, 2015; seconded by Lauren McKean; passed 5-0.

Sachar, 65 Vanessa’s Way, Map 29, Parcel 24:  RDA, Outside shower to drain in drywell (after the fact)  Cont’d from 07/01/15.  Chet Lay represented the applicant and stated that the site plan identifies the location of the drywell.  Barbara Brennessel is the supervisor and wants to be notified when the drywell is installed for inspection.  Trudy

Vermehren identified the project as a Negative 3; seconded by John Portnoy; passed 5-0.
