4:00 - Business Meeting & Conservation Agent's Report

135 Pine Pt Road, home owner and John Schnaible of Coastal Engineering asked for some direction on potential house reconstruction.  A site map was provided to the Commission.  They would like to add a full basement, add a new bedroom and screened porch.  The house is within the 100-foot buffer zone.  Commission recommended moving the house outside of the 100- foot buffer zone.  Owner will talk with the Building Inspector on relocating the house. 

JoAnne Muramoto and Andrew Gottlieb reviewed the proposed Environmental Bylaw changes with the Commission, with special attention to climate change adaptation.

Public Hearings 5:05 pm:

Ross, 945 Chequessett Neck Rd., Map 19, Parcel 98, NOI, replace 30 foot of seawall (Cont’d)  Lauren McKean recused herself.  Barbara Brennessel was acting chair for the hearing.  Paul Shea and Keith Fernandez represented the applicant.  This is a maintenance project, with the middle collapsed portion of the seawall replaced  Grout will be placed in the rest of the existing seawall.  Access will be from the upland area.  A track vehicle will be used, with no machinery within the salt marsh.  A beach nourishment plan must be provided to the Agent.  John Portnoy moved to approve the NOI; seconded by Michael Fisher; passed 4-0 with the condition a beach nourishment plan be provided.  Supervisor:  John Portnoy  

Evangelista & Kolenberg, 745, 765, 775 Chequessett Neck Rd., Map 19, Parcels 111, 110 and 109, NOI, repair timber bulkhead, reconstruct timber walkway and stairs (Cont’d)  Lauren McKean recused herself.  Roger Michniewicz represented the applicant.  The bulkheads are continuous on three properties.  Sand has been leaking seaward through these bulkheads. .  Work will be performed at low tide.  The bulkhead located at 745 Chequessett Neck Rd. requires a complete replacement.  He stated the existing bulkhead would remain and the replacement will be approximately 2 feet seaward.  Chequessett Yacht and Country Club have granted use of their property for access and staging, along with two other property owners.  The walkway and stairway are also in need of repair and diamond piers will be used.  John Portnoy questioned why the project could not be moved landward, and the response was the ties would have to be removed and the existing bulkhead would collapse.  Mr. Portnoy also requested a nourishment plan.  Agent Greenberg-Lemos stated the Shellfish Department suggested placing material on the groins.  Alfred Pickard questioned whether this project needed additional permitting (e.g Chapter 91) because work will occur below mean high water.  The Commission requested a continuation with a proposal for the bulkhead being placed landward.  John Portnoy moved to continue to 4/3/19; seconded by John Cumbler; passed 4-0.    

Spear, 835 Chequessett Neck Rd., Map 19, Parcel 105, NOI, replace timber beach stairs with stone steps (Cont’d).  Lauren McKean recused herself.  Mark Burgess represented the applicant and gave an overview of the project.  The replaced granite steps will become part of the revetment.  The beach renourishment would be 8.5 cubic feet per year.  The Commission also recommended retractable stairs.  Access to the beach would be through Chequessett Yacht and Country Club.  A tract vehicle will be used for access.  John Cumbler questioned why not use wood instead of the stones and thereby eliminate the need for vehicles on the beach; the response was that the owner did not want to have to replace wood on a continuing basis.  The Commission would like to see an alternate proposal for landward access .  Barbara Brennessel moved to continue to 4/3/19; seconded by John Portnoy; passed 4-0.    

Pyles, 170 Bayberry Lane, Map 41, Paracel 121, Request for 3-year extension.  Michael Fisher recused himself.  John Portnoy read the previous minutes.  Barbara Brennessel moved to approve the 3 year extension; seconded by Lauren McKean; passed 4-0.

Robbins, 11 Anawan Rd., Map 28, Parcel 208, NOI, replace and expand deck and upgrade septic system.  Michael Fisher recused himself.  David Lajoie represented the applicant and gave an overview of the project. John Portnoy read the previous meeting minutes and signed appropriate paperwork.  John Cumbler moved to approve; seconded by Barbara Brennessel; passed 4-0.  Supervisor:  Agent

Wotherspoon, 44 Cypress St., NOI, addition, screened porch and new deck.  David Lajoie represented the applicant and gave an overview of the revised plans.  The lower level deck will be made of gravel / stones with a walkway.  The addition will be placed on the east side of the dwelling.  The total lot coverage within Commission jurisdiction will be 1719 sq. ft.  New plantings will be made on the south side as well as plantings near the stoned driveway.  Drywells will be placed with a drip line.  A letter from the owners was read into the record.  The porch is the same dimensions as the deck.  John Portnoy requested additional plantings between the  driveway and the northern isolated wetland.  The Commission would like to have native grass planted under the porch to discourage storage.  John Cumbler moved to approve the NOI; with conditions of additional plantings; seconded by John Portnoy; passed 5-0.  Supervisor;  Barbara Brennessel.        

Kaplan/Rose, 135 Old Truro Rd., Map 8, Parcel 164, NOI, construct dwelling, septic and appurtenances  (Cont’d).  Jason Ellis and Ben Zehnder came to the table.  Mr. Ellis stated he talked with the Building Inspector the latter initially  didn’t see any issues after reviewing deeds and history, but intended to review this project further before his signoff.  .Ellis stated that there appears to have been a substantial fill placed in the area when Meadow View Road was excavated. There was a cease and desist issued for manure being used as fill.  A manure management plan was put in place and no further fill has been placed on the lot.  The Commission would like to inspect past aerial photos for an indication of when the fill was placed over the bank on this lot.  Attorney Zehnder questioned if the fill was placed within the wetland and John Portnoy stated that test pits could answer that question.    Lauren McKean moved to continue to 4/17/19; seconded by John Portnoy; passed 5-0.     

Berry, 287 Coles Neck Rd., Map 7, Parcel 56, NOI, construct dwelling, water line and septic system.  Michael Fisher recused himself.  John Portnoy read the previous meeting minutes and signed the appropriate paperwork.  Mary Berry and Jerry Bissette came to the table.  Ms. Berry gave some history of purchasing the property and the proposed house design.  The building materials for the dwelling are on the property and she is concerned with weather.  She was issued a building permit in November 2018 and was led to believe she could build.  She stated she is working with Gordon Peabody to develop an environmental plan which will be distributed to the Commission.  Lauren McKean moved to approve the NOI; seconded by John Cumber; passed 4-0.  Supervisor:  John Cumbler

Tierney, 2069 Weatherly Ave., Map 20, Parcel 19, NOI, construct 31’ by 14’ addition to replace existing addition and deck.  The applicant had sent a letter requesting a continuation to 5/15/19.

Town of Wellfleet, 0, 70 & 90 Kendrick Ave, Map 20, Parcels 4, 5,6, &7, RDA, construct pavilion.   Becky Rosenberg and David Michniewicz gave an overview of the project.  This will be a 40’ x 30’ pavilion with no sides.  It will be located where the seasonal tent has been since the early 2000s.  Wood chips are on the ground and Mr. Michniewicz stated there is no erosion and doesn’t feel gravel for the drip line is necessary as children kick and spread the gravel around.  The Commission would like to have diamond piers used as support.  Lauren McKean identified the RDA as a Negative 2; seconded by John Portnoy; passed 4-0.

Rispoli, 15 LeCount Hollow Rd., Map 30, Parcel 22, RDA, Construct art installation including a  landscaped planting bed.  David Michniewicz and Attorney Liza Cox tated this will be an ornamental planting area .  Barbara Brennessel identified the project as a Negative 3; seconded by John Portnoy; passed 4-0.

Emmons, 119 Hamblin Farm Rd., Map 19, Parcel 13, Partial Certificate of Compliance. 
Agent Hillary Greenberg-Lemos stated the new cottage was built.  David Lajoie and Al Timmons came to the table.  There is still work to be done on the main building.  Lauren McKean moved to grant a Partial Certificate of Compliance; seconded by John Portnoy; passed 5-0.

Thorton, 1305 State Hwy, Map 30, Parcel 159, RDA, construct 2 decks.  Michael Fisher recused himself.  Craig Thorton gave an overview of the project.  The Commission requested using diamond piers instead of sono-tubes.  John Cumbler would like some plantings or blocks placed to avoid storage under the deck.  Barbara Brennessel identified the RDA as a Negative 3; seconded by John Portnoy; passed 4-0.

The Business meeting was reopened at 6:55 pm

Jurisdictional Opinion:  Heather Reavey, 145 Indian Neck Rd., Perform exploratory drilling for new location for well.  Their water is extremely salty.  Lauren McKean moved to approve the Jurisdictional Opinion; seconded by John Portnoy; passed 4-0.

It was reported by a commissioner there is construction being done at 24 Pleasant Point Landing.
