Attendees:  Trudy Vermehren, Barbara Brennessel, John Portnoy, Ginie Page, Ed Simpson and Lauren McKean.

4:00 - Business Meeting & Conservation Agent's Report

Kayak Discussion:  Ginie Page reported last year there were 72 kayaks on Powers Landing and this year there is only one with some skiffs.  Ed Simpson recommended constructing more racks, to encourage people to use them, rather than concentrating on permitting.  Agent Greenberg-Lemos stated the racks are on town owned land.  She alos reported thsat there are kayaks/canoes on the ground/vegetation at all locations around the ponds and Audubon properties.  Doug Guey-Lee has been affixing a warning sticker on boats stored on shoreline vegetation.  Barbara Brennessel recommended signage stating that the land is fragile and that there is to be no boat storage on dunes and/or vegetation.  Agent Greenberg-Lemos stated there is money for the rest of the season to hire someone to go around and place stickers on the boats.  Ginie Page moved to hire a person to sticker the boats and document location of boats; seconded by Barbara  Brennessel; passed 6-0.

Mail / Correspondence/Discussion

Suzanne Thomas:  notification of road race in October.  Background: problem with  parking at Mayo Beach and parking at other locations and shuttling people on buses.  Race is proposed to take place this year on dirt roads within the National Seashore from the Gull Pond landing, along Schoolhouse Hill Road and around Slough and Round Ponds, the latter two in Truro.,.  Lauren McKean stated the National Seashore needs to review the route, and some of the roads are privately owned.  Ginie Page stated the trails in the National Seashore could be dangerous to some of the runners because of their rutted condition.  Agent Greenberg-Lemos will respond to Suzanne Thomas with recommendations from the commission to include the possibility of using roads within the Marconi Beach area or Duck Harbor Beach area, with reasons why the pond area is not recommended.

Letter from Mayo Creek Restoration Committee to Mr. Mahala withdrawing the RDA application.

Letter from Doug Guey-Lee to 75 Omaha, Map 28, Parcel 189:  boulders placed on edge of road is in violation of Wetlands Protection Act.  This would requirea filing for a RDA. 

Letter from EverSource:  operating plan for the right of way for vegetation management applying herbicides along the power lines.  Agent Greenberg-Lemos will send letter reminding them of the boundaries along any freshwater ponds and wetlands. 

1123 4th St – work started at Robert Lanza’s dwelling.  Ed Simpson, supervisor, stated he never received a phone call and the office was not notified of work starting.  The original house is demolished and steel is erected.  Ed reviewed the special conditions within  the Order of Conditions, including structural assessment of the Lieutenant Island bridge and access roads.  Agent Greenberg-Lemos stated a stop order was placed on the project, and Pate Steele requested the commission lift the stop order because a certified engineer will be going to the site tomorrow to study the load capacity of the bridge.  It was recommended the engineer coordinate with the town and the building contractor to determine pre-delivery status of the bridge / roads and the weight capacities of the various trucks.  The original construction protocol is different that what had been presented.  Agent Greenberg-Lemos will request that Mr. Lanza’s representative come to the next meeting and explain the above irregularities and status of the project.    

Jurisdictional Opinions

            Kathleen Soares – plantings and re-established grass which were disturbed by septic installation, and maintain walking paths with new materials.  Agent Greenberg-Lemos will get additional information.  The commission recommended a RDA filing.  

Meeting Minutes

Public Hearings 5:05 pm:

Wellfleet Environmental Protection Act changes – copies available at Health and Conservation office and Town Clerk’s office.  Agent Greenberg-Lemos reviewed the proposed changes, which included fees.  David Lajoie questioned the ACEC line changing.   Agent Greenberg-Lemos will check with the Coastal Zone Management Office regarding the placement of the ACEC line, now that modern surveys have switched to the NAVD88 datum.  Trudy Vemrehren moved to approve all other changes except those dependent on the ACEC boundary; seconded by Ginie Page; passed (Rev. 2015) 6-0. 

Berezin, 30 Wigwam, Map 35, Map 135, Certificate of Compliance.   Agent Greenberg-Lemos stated it is in compliance.  Trudy Vermehren moved to approve the Certificate of Compliance; seconded by Ed Simpson; passed 6-0. 

Jenkins, 200 Holbrook Road, Map 14, Parcel 160, RDA, new septic.  David Lajoie represented the applicant and gave an overview of the project.  He stated this property is on town water.  The old cesspool will be crushed and filled in with sand.  Advanced treatment will be used in the new system to reduce the discharge of nitrogen, given the proximity of a private supply well.  Trudy Vermehren identified this as a Negative 3; seconded by Ed Simpson; passed 6-0.

Zelinsky/Conservation Trust, 170 Pond Ave., Map 29, Parcel 382, Certificate of Compliance.  Ginie Page recused herself.  Agent Greenberg-Lemos stated work never took place.  Trudy Vermehren moved to approve the Certificate of Compliance; seconded by John Portnoy; passed 5-0.

Bromberg, 195 Samoset Ave., Map 28, Parcel 97, NOI, remove and rebuild dwelling (Cont’d).   Agent Greenberg-Lemos stated she had a discussion with the representative who requested a continuation to 9/2/15.  Trudy Vermehren moved to continue to 09/02/15; ; seconded by Ginie Page; passed 6-0.

Dzen/Dechirico, 190 Blue Heron Road, Map 41, Parcel 12, NOI, vista pruning, removal of trees, replanting and construct at-grade deck (Cont’d).  The number of plantings was identified on the site plan as well as  proposed plant  maintenance.   Ed Simpson moved to approve the NOI; seconded by John Portnoy; passed 6-0.  Supervisor:  John Portnoy

Trudy Vermehren moved to close the public hearings and reopen the business meeting at 5:25 pm; seconded by Lauren McKean; passed 6-0.

Agent Greenberg reported the dwelling at 5 Holbrook Ave has been condemned by the Board of Health.  She stated that  condemnation notices  have been repeatedly removed from the structure.  Despite promises by the owner to clean up the lot, no cleaning has been done.   The company that is holding the mortgage did not know it was condemned.  Agent Greenberg-Lemos will keep the commission informed of any activity and will have a discussion with Town Counsel.         

Meeting Minutes:  Barbara Brennessel moved to approve the amended 7/15/15 meeting minutes; seconded by John Portnoy; passed 6-0.   

Trudy Vermehren moved to adjourn at 5:30 pm; seconded by Ginie Page; passed 6-0.
