  • Agent Greenberg-Lemos stated Jim O’Connell, Coastal Geologist, reported on the Donald’s property.  DEP had appealed our Order of Conditions, and Jim O’Connell was hired by the Donald’s.
  • Thank you card from the Pyles for extending their Order of Conditions.
  • Coast Sweep – Monday, 10/10/16 – work with the Recycling Committee.
  • Press Release – potential sea level rise – Monomoy area.
  • Cape Cod Commission – revising regulations regarding fees
  • Letter from Wellfleet Conservation Trust to Doug Guey-Lee to hold Conservation Restriction on the Doak’s property on Lt. Island
  • Subdivision Plans – Stewart – 15/148.2 and 148.3.  Subdivision of land outside of Commission jurisdiction. The Commission reviewed and acknowledged receipt of  the paperwork with no further action.
  • Subdivision Plans – Map 15, Parcels 22 and 23 – two lots proposed.  There are some freshwater wetlands associated with Squire’s Pond.  The commission stated they were concerned with the driveway within the 100’ buffer zone; however, the Planning Board was not asking for approval.

Jurisdictional Opinions – Goldman, Map 40 Parcel 21 – remove 2 dead oak trees.  Ginie Page moved to approve the Jurisdictional Opinion; seconded by John Portnoy; passed 5-0.

Meeting Minutes – to be reviewed at next meeting

Open Space Committee:  Bruce Hurter, Chair, would like to come to a Commission meeting  to discuss regular inspections  of the town- owned conservation properties. 

Pole Dike Road – garage – Trudy Vermehren wanted a site visit made by the supervisor,. 

Moby Dick restaurant parking lot – several aerial images were reviewed from Google Earth to determine if any changes have taken place over the years in the extent of wetland fill for parking.  Agent Greenberg-Lemos will request the owners come to a meeting for a discussion of their activities relative to the immediately adjacent wetlands .

                                      

Public Hearings 5:00 pm:

Denterlein, 5 5th St., Map 40, Parcel 66, NOI, prune scrub oak, remove 6 cedar trees and prune 6 pitch pines (Cont’d).  Chet Lay represented the applicant and submitted a new planting plan.  The commission requested 100% survival rate for the plantings over a 3 year growing season.  John Portnoy moved to approve the NOI; seconded by Barbara Brennessel; passed 6-0.  Supervisor:  John Portnoy

Brown, 1200 Bound Brook Island Rd., Map 7, Parcel 602, NOI, construct residential driveway through small portion of isolated wetland. (Cont’d)   Lauren McKean recused herself.  Chet Lay represented the applicant and stated the Massachusetts Natural Heritage and Endangered Species Program has ruled that  this is not a take.  Chet stated this is not a subdivision as yet, and has not been recorded. The intent of the NOI is to determine whether or not the driveway across a small wetland beside Bound Brook Island Rd is permissible by the Commission.  He had provided updated site plans.  Ginie Page moved to approve the NOI; seconded by John Portnoy; passed 5-0.     

Estey, 36 East Well St., Map 36, Parcel 155, RDA, new driveway, remove deck attached to shed and remove existing septic components from 100’ buffer zone around an  isolated vegetated wetland.  Jason Ellis represented the applicant and stated the owners want to construct a small addition to their home.  The leach pit is within the 100’ buffer zone, and the new septic system will be out of the buffer zone.  He provided information regarding the wetlands and elevations.   Barbara Brennessel identified this as a Negative 3; seconded by Ali Sands; passed 6-0.

AJOR, LLC, 635 Chequessett Neck Rd., Map 19, Parcel 117, NOI, remove existing pool and deck and replace with new pool, deck and patio.  John O’Reilly represented the applicant and gave an overview of the project, stating the current decking and pool are attached to the dwelling.  The upper deck will be replaced and the portion within the buffer zone will remain at the same footprint.  Patio space will be expanded within the buffer zone.  Mr. O’Reilly gave the dimensions of the work limit for the project.  There will be a retaining wall at the upper deck.  Trudy Vermehren requested that additional information be provided to identify the amount of soil disturbance, square footage of disturbance (existing and what is proposed), alternative analysis and a construction protocol.  The pool will be an infinity pool within the current patio area.  The patio will be wet-set and will contain run off options.  A planting plan was provided on the site plan.  John Portnoy was concerned that the Commission was being asked to permit even more development within the 100-ft buffer for the new patio, replacing existing exposed soil and grass cover with impermeable masonry.  Cameron Sanders, abutter, stated he was concerned with noise from the new  pool mechanisms because his bedrooms are on the pool side of the property.  Trudy Vermehren moved to continue to August 3, 2016; seconded by Ginie Page; passed 6-0.
