479 Black Pond Rd.  Tim Brady, Garry Olney, and Theresa Sprauge came to the table.  The applicant asked for a sense of where the Commission stood regarding the proposal to keep the stairs and include mitigation planting.  Brennessel remarked that the Commission already voted unanimously to have the stairs removed.  The draft minutes of the meeting at which the decision was made was read to the applicant.  The stone walkway was completed without approval from the Commission and the owners had told the contractor the project was to be put on hold.  The stones were going to be used on the cottage behind their house.  Brady stated the stones were placed securely and look attractive and there doesn’t appear to be any damage to the resources.  Theresa Sprauge stated there needs to be vegetation on the side of the steps and in between the steps.  She also recommended the slope and top of the bank would be improved with ground cover and more vegetation.  Retaining wall at top of bank requires improvement.  Theresa recommended a land management plan which would improve habitat for the area.  A new NOI will be filed.

There was discussion regarding having alternates on the commission in order to make motions and votes on projects.  Agent Greenberg-Lemos will discuss with Town Clerk.  There is concern with having a quorum due to members being on other boards and having to recuse themselves.    

Barbara Brennessel requested the Friends of Herring River come to a business meeting in April to discuss the project.       

Jurisdictional Opinions – none

MACC –  Interstate Gas Pipe Lines – Lauren McKean moved to support and be a signatory for the Wellfleet Conservation Commission for the MACC letter opposing gas pipe lines going through wetland resources; seconded by Barbara Brennessel; passed 4-0.

The Rose property auto repair and services on Main Street had a license for towing vehicles.  The last renewal of the license was in 2015 and there is no license at this point in time. 

Disposition of town property – Pleasant Point – commission wants to meet with Open Space committee.  A recommendation for an article on Town Meeting will be made.  Agent Greenberg-Lemos will contact the Open Space committee.

Public Hearings 5:00 pm:

615 Chequessett Neck Road Realty Trust, 615 Chequessett   Rd., Map 19, Parcel 118, Certificate of Compliance.  A site visit was made and the project is in compliance.  Trudy Vermehren moved to approve the Certificate of Compliance; seconded by Barbara Brennessel; passed 4-0.

Haggerty, 615 Chequessett Neck Rd., Map 19, Parcel 118, Certificate of Compliance.  A site visit was made and there was concern regarding the resource area.  Ginie Page moved to continue the Certificate of Compliance to 02/01/17, (bank requires revegetation and brush removed); seconded by Trudy Vermehren, passed 4-0.

LeBart, (Town of Wellfleet property), 325 Main Street, Map 14, Parcel 174, NOI, Construct a memorial garden.  Gary Locke represented the applicant and stated all native plants and shrubs will be used.  The circular stone area will be a conservation mix and will be 18” off the ground.  There will be irrigation and invasives removed.  Todd LeBart stated volunteers will help with the plantings and he hopes the project can be started this spring.  Gary Locke stated it could take 4 weeks.  Barbara Brennessel stated there is a vernal pool and is a habitat area, although the species are not protected.  Trudy Vermehren recommended stumps be ground, soil shaped, provide a description of section of the stairs, and indicate what will be removed/trimmed of the vines at Wesley Swamp.   There was discussion regarding additional use of the garden for commercial reasons.   The commission requested the town owned boundaries of the vernal pool be staked, handicapped access to be provided to park and identified on site plan, cross section of grass wall and steps be submitted to the agent, the construction protocol revised, and IPM to be utilized.  Trudy Vermehren moved to approved the NOI, seconded by Ginie Page; passed 4-0.

AJOR, 635 Chequessett Neck Rd., Map 19, Parcel 117, NOI, remove pool, replace with new pool and patio with mid-level deck.  At the request of the applicant, Trudy Vermehren moved to continue to February 15, 2017, seconded by Ginie; passed 4-0.   

Bruce/Stearns, 105 5th Ave., Map 40, Parcel 52, Certificate of Compliance.  This is a partial certificate, Trudy Vermehren moved to approve a partial certificate; seconded by Lauren McKean; passed 4-0.

The public hearing was closed at 6:00 pm.  The business meeting was reopened at 6:00 pm to vote on meeting minutes. 

Meeting Minutes:

11/16/17 – add Lauren McKean on attendee list.  Barbara Brennessel moved to approve the amended 11/16/17 meeting minutes; seconded by Ginie Page; passed 3-0.

12/07/17 -  add Jorgenson – Peter Due of Estates representative.  Barbara Brennessel moved to approve the amended 12/07/17 meeting minutes; seconded by Trudy Vermehren; passed  4-0.

12/21/17 – Ginie Page moved to approve the amended 12/21/17 meeting minutes; seconded Barbara Brennessel; passed 4-0.

Trudy Vermehren moved to adjourn at 6:10 pm; seconded by Lauren McKean, passed

4-0.
