4:00 - Business Meeting & Conservation Agent's Report

Open Space Committee Chairman Bruce Hurter appeared to inform the Commission that his Committee would again take on the task of inspecting Town-owned conservation lands.  Bruce further asked for background on the ownership of the coastal bank and bulkhead near 1 Blackfish Creek (Pleasant Point). Town Meeting recently voted against selling the coastal bank to the upland abutters. He stated there is erosion behind the seawall.  The owners of the property behind the seawall have received Commission permission to rebuild the bulkhead with conditions to maintain the beach sand level, but reconstruction has not begun.   Mr. Hurter stated the bank seaward of the Patterson property has the most erosion. 

Mail / Discussion: 

            Draft Pond Condition Progress Report:  Lauren McKean made an informal presentation on pond projects performed in 2015/2016.  Americorps assisted with the work.  Lauren stated the work will be on-going in the future years. 

Wellfleet Conservation Trust Annual Business meeting will be held on Saturday, August 20, 2016 at 10:00 am.

Correspondence, USGS – seeking permission for wood planks over marsh areas within the Herring River area for greenhouse gas monitoring.   The project was previously approved and they are looking to change the location of the planks.  Agent Greenberg-Lemos will check the files and determine if this is simply a notification to the Commission.

            Hiawatha Condo owners regarding selective cutting and pruning performed

Todd Barry – (Moby Dick) – follow up regarding complaints – parking expanded, vegetation management on-going, wood chips in the marsh.  A September site visit will be scheduled.

Leif Valli – Chequessett Neck Rd., regarding weed whacking on dune    

Jurisdictional Opinions

  1.  Chris Lucy, contractor, Jim Gilbert- Briar Lane, remove 3 locus trees and remove overgrown roses.  A site visit was made by Doug Guey-Lee – work will be done on a slope above upper Pole Dike Creek, tributary to Herring River.  Mr. Lucy stated that only overgrown roses will be removed on the property.  Ginie Page moved to approve; seconded by John Portnoy; passed 6-0.
  2. Crest Ave, 25/91, David Lord, top or remove 3 locusts, top large pine, top oak behind pine, remove 6 pines, etc.  Chris Lucy, contractor, stated they want to remove the pines by the house and deck.   Ginie Page requested an RDA be filed so the commission can make a site visit due to the number of trees to be cut ; seconded by John Portnoy; passed 6-0.

Meeting Minutes:  July 7:  change “cultch”, commission, Barbara Brennessel also reported that in the past, some cultch was moved by dragging once they collected a set of oysters.  This activity is referred to as a “relay”.   Barbara Brennessel moved to approve the amended meeting minutes of July 7, 2016; seconded by John Portnoy; passed 6-0.

July 15, 2016:  John Portnoy moved  to approve the amended July 15, 2016 meeting minutes; seconded by Ali Sands; passed 5-0.

Steven Cooney, owner of property on 3 Kendrick Avenue, stated work will begin shortly.  He wants to do underground electrical work on the property. Agent Greenberg-Lemos recommended he draw up a plan for the commission’s review. 

                                        

Public Hearings 5:00 pm:

AJOR, LLC, 635 Chequessett Neck Rd., Map 19, Parcel 117, NOI, remove existing pool and deck and replace with new pool, deck and patio.   John O’Reilly represented the applicant and he reviewed the work to be done.  He described the drainage proposal for the patio and how the run off will be contained.  The construction protocol was briefly discussed.  There will be no fill taken out or brought in.  There will be approximately 1,300 sq. ft of  mitigation planting.  Mr. O’Reilly will provide estimates of storm run off  so that the Commission can ensure that planned drains are adequate to avoid soil erosion.  The commission was concerned with the conversion of existing permeable deck and lawn to impervious patios.  O’Reilly stated the new plantings would vegetate existing  barren land.  The owner did not want to use blocks for the new patio and O’Reilly stated the work will be done 65 and 70 feet away from the coastal bank.  John O’Reilly will come back with runoff calculations.  Barbara Brennessel moved to continue to 08/17/16; seconded by Ginie Page; passed 6-0.     

Chabot, 80 Second Avenue, Map 40, Parcel 126, Certificate of Compliance.  Work was never started.  Ginie Page moved to approve the Certificate of Compliance; seconded by Barbara Brennessel; passed 6-0.

Drew, 80 Second Avenue, Map 40, Parcel 126, Certificate of Compliance.  The beach nourishment had not been completed, but has since been completed.  John Portnoy moved to approve the Certificate of Compliance with on-going beach nourishment; seconded by Ali Sand; passed 6-0.

Duff, 435 Eastwind Circle, Map 36, Parcel 248, RDA, septic upgrade.  Tim Brady represented the applicant and gave an overview of the project, stating the property is being sold.  He described how the equipment will enter the property and stated there will be no impact to the resources.  Ginie Page identified the project as a Negative 3; seconded by Lauren McKean; passed 6-0.

Flattery, 479 Black Pond Rd., Map 4, Parcel 38, NOI, replace wood stairs with stone stairs (Cont’d).  Tim Brady requested a continuation to September 7, 2016.  Ginie Page moved to continue to September 7, 2016; seconded by Barbara Brennessel; passed 6-0.                                             

Ed Simpson moved to adjourn at 5:40; seconded by Ali Sand; passed 6-0.
