Minutes of Conservation Commission Public Meeting

Business Meeting / Agent’s Report

Meeting called to order at 4: 10 P.M. by Chair Trudy Vermehren

Barbara Brennessel stated she attended a Shellfish Advisory Board meeting regarding Indian Neck and the Board approved of blocking off the roadways recently created by vehicle traffic, which are causing erosion in the area.    Agent Greenberg-Lemos will contact the Town Administrator as well as send a letter to the Board of Selectmen.  Barbara recommended putting up signs advising where vehicles should park.  Poles will be placed across the road.

The Herring Warden position will be reporting to Agent Greenberg-Lemos and interviews would be held in the near future.

Barbara Brennessel stated there is a kayak rack on 30 Way 14 (Gull Pond).  There has been some tree clearing.  Agent Greenberg-Lemos will send the Americorp intern to make a site visit.      

Cary Rea moved to approve the 12/17/14 meeting minutes; seconded by Barbara Brennessel; passed 4-0.

Horseshoe crabs – Barbara Brennessel stated there is not enough information regarding closing the fishing for the crabs.  She stated DMF recognizes that there are not many crabs left in Wellfleet and looked for juveniles but were unable to locate them in the harbor.  Horseshoe crabs do not mature until they are 12 years old.  MA Audubon has been studying the population for 10 years but DMF cannot wait 12 years to put a closure to the fishing.

The beach bathhouses will be inspected this spring.   

Public Hearings 5:00 pm:

Friend, 675 Gull Pond Rd., Map 9, Parcel 627, NOI, addition to dwelling and exterior

stairway (Cont’d from 12/17/14).   At the request of the applicant, Trudy Vermehren moved to continue to February 18, 2015; seconded by Cary Rea; passed 4-0.

Fitzgerald, 147 Kendrick, Map 20, Parcel 15, NOI, septic system upgrade.  David Lajoie represented the applicant and a new leaching field will be located on the west side of the property, a sub-pump in the garage, no change to the one bedroom building, with an alternative treatment.  Relief from the town will be necessary for access, and the project will go before the Board of Health in February.    Agent Greenberg-Lemos suggested a tight tank or drip dispersal system due to the disturbance to the sensitive site.  Mr. Lajoie stated if trees were removed, a condition could be to replace the trees.  David Lajoie requested a continuation to February 18, 2014.  Trudy Vermehren moved to continue to 2/18/14; seconded by Barbara Brennessel; passed 6-0.     

DiRocco, 155 Indian Neck, Map28, Parcel 134, Remove and rebuild dwelling.  Chris Wixson of East Cape Engineering represented the applicant.  The small foundation will be removed and a FEMA compliant foundation will replace the current footprint.  He identified the work limit and stated the driveway would remain pervious.  The proposed deck will be elevated off the ground about 6 feet and cantilevered for the last 4 feet.  Pruning will be performed on the trees.  The commission wanted to maintain the habitat at ground level.  The commission requested a planting plan as well as a description with the removal of debris and pruning.  The applicant  requested phasing the planting / pruning portion of the application.  A deconstruction protocol and construction protocol is required as well as square footage of the decking and total amount of disturbance.  Ginie Page moved to continue to February 18, 2015; seconded by Cary Rea; passed 5-0.
