4:00  Business and Agent’s Report

Trudy Vermehren opened the business meeting at 4:04 pm

Warrant:  Article 47:  disposition of town land on Pleasant Point (bulkhead and marine scarp below 0 Blackfish Creek, Map 35:210?) – transfer care and custody to the abutting owners.  There was discussion regarding the amount of land involved and the Commission viewed an assessor’s map.  John Portnoy moved not to recommend Article 47 as it appears in the Warrant, because this sensitive coastal scarp would be best retained under the stewardship of the town; seconded by Ginie Page; passed 6-0.

Fees:    to be discussed at next meeting (charge for hearing continuations)

Oyster Symposium:  Barbara Brennessel asked the commission if they had any role in the conservation/restoration of shellfish habitat.  She stated there are many regulations regarding shellfish restoration (e.g. oyster reefs) from the Div. of Marine Fisheries.  The international symposium is scheduled for October and being held in Falmouth.  Agent Greenberg-Lemos stated permitting must be done for the culching and stated she had met with the Shellfish Warden, as well as members from the National Seashore. 

Tree Cutting – 464 State Highway, Map 42, Parcel 22:  Steve Riley stated trees were growing through the utility lines and he hired a tree service (Treescapes) to remove the trees.  The tree service cut more trees than expected (approximately 15 in total).  He stated he was not aware of the Commission’s jurisdiction over tree removal within 100 ft of a wetland.  The commission will make a site visit on April 1 and requested Mr. Riley come back to the commission with a planting plan on April 15.

Trudy Vermehren moved to approve the amended 02/18/15 meeting minutes; seconded by Barbara Brennessel; passed 4-0.

Barbara Brennessel moved to approve the amended 03/04/15 meeting minutes; seconded by Cary Rea; passed 5-0.

Public Hearings 5:00 pm:

Donald, 0 Bayview, Map 35, Parcel 39, NOI, extend existing timber bulkhead (Cont’d from 02/18/15).  At the request of the applicant, Trudy Vermehren moved to continue to April 1, 2015; seconded by Ginie Page; passed 6-0.

Friend, 675 Gull Pond Rd., Map 9, Parcel 627, NOI, addition to dwelling and exterior stairway (Cont’d from 02/18/15).  Lauren McKean recused herself.  At the request of the applicant, Trudy Vermehren moved to continue to April 1, 2015; seconded by John Portnoy; passed 5-0.

Town of Wellfleet,  Herring River NOI, request for Extension Permit for Order Of Conditions.  Lauren McKean recused herself.  Agent Greenberg-Lemos stated this is for herring passage and maintenance and was issued in 2008.  The National Seashore requested that the extension be limited to two years.   Ginie Page moved to allow an extension for 2 years; seconded by Cary Rea; passed 5-0.  

Ahern, 6 Pleasant Pt. Landing, Map 35, Parcel 105, RDA, shed with foundation.   Agent Greenberg-Lemos stated there are no buffer zone issues, i.e. the project is outside of Commission jurisdiction, and the applicant requested to withdraw without prejudice.  Trudy Vermehren moved to allow the application be withdrawn without prejudice; seconded by Cary Rea; passed 6-6.

Sachar, 65 Vanessa’s Way, Map 29, Parcel 246, NOI, remove deck and construct screened porch.  Chet Lay represented the applicant and provided a plan showing the deck.  The screened porch will be larger than the deck, but the stairway will be removed.  There will only be 3 sonotubes used to support the porch.  There will be gutters and a downspout from the roofline.   It was recommended pin pilings/diamond piers be used for less disturbance to the resources.  The diamondback terrapin nesting timeframe is in June/July so it was recommended the work be completed in Spring.  After discussion, the southeast line of the proposed reconstruction will be pulled back 2 feet so that ground coverage remains the same as existing.   Trudy Vermehren moved to approve the NOI with the conditions; seconded by Lauren McKean; passed 6-0.   Barbara Brennessel - supervisor.    

Trudy Vermehren moved to close the public hearings and reopen the business portion of meeting at 5:30 pm; seconded by Ginie Page; passed 6-0.

Indian Neck Parking Area Parking Plan:  presentation is ready to go before the Board of Selectmen again.  Agent Greenberg-Lemos will make arrangements for getting on the agenda and members of the commission will go to the meeting.  Barbara Brennessel recommended having a discussion with the Harbormaster and Beach Sticker office to develop a parking plan, particularly for those who have a mooring and offer suggestions for alternate parking.  Lauren McKean will take a picture of the area.
