Agent Greenberg-Lemos sent a letter to Rebecca Rosenberg informing her she had to file an after-the-fact NOI for all the work done on her property.

Habitat for Humanity filing – not applicable to the Conservation Commission

Mayo Creek

John Riehl stated they are in the process of writing their final draft for the Mayo Creek Restoration Project. . He stated he would like to have the Commission read the report and make suggestions on the feasibility of the project.  

Harbor Management Plan – John Riehl stated that a new plan has to be submitted every 10 years.  The 2006 NRAB plan is on the town website.  They are thinking of doing a 3rd Management Plan.  Many of the recommendations from 2006 are still underway, regarding such issues as  nitrates, salt marshes, dredging, replenishing the shell fish beds, maintaining the shoreline, etc.  New Issues to be looked at include climate change and biodiversity in the harbor (shellfish population, horse shoe crabs, and monitoring fin fish population).  Mr. Riehl stated they would be very interested in hearing comments from the Commission.   Another concern relates to the issue of  salt marshes migrating inland with climate change.  Mr. Riehl stated there are homes that are at risk of high sea levels on coastal banks.  Barbara Brennessel stated that the Commission is currently working on the by-laws and the bylaws will cover rising sea levels and take into consideration climate change.

Observations:

Barbara Brennessel stated she attended the Shellfish Advisory Board  meeting on 4/16/19 – Fishermen \were concerned that sedimentation is covering the shellfish beds at Egg Island (Powers Landing).   The Commission has been requesting property owners along that stretch of coastline to renourish and Barbara questions whether  this is a good mitigation.  There was further discussion regarding the movement of the sand, the amount of sand for the renourishment, and how it affects the shell fisherman.  It was noted Mark Borelli is doing a study and he may shed some light on the issues.   Alfred Pickard was in the audience and Brennessel asked if the sand is migrating to Egg Island.  He stated there is a double tide at Egg Island and he believes the Herring River affects the sand.  He stated that the beach renourishment being done now is going into the harbor near the L pier.  He has received some of that sand from the Town and moved it farther north for mitigation on private properties. He gave examples of properties within the harbor and recommended close observation of sand movement as well as the amount of sand people are putting on their property.  He also stated the sand should be a larger size based on the shifting and movement.  He stated that what is currently being used is so fine it doesn’t stay in place.

Public Hearings 5:10 pm:

Valli, 30 Ridge View Dr., Map 13, Parcel 134, Certificate of Compliance.  This a partial Certificate of Compliance, work on the well and septic is in compliance.  The addition and deck have not been completed.  Lauren McKean moved to approve the partial Certificate of Compliance; seconded by John Cumbler; passed 4-0. 

Kaplan/Rose, 135 Old Truro Rd., Map 8, Parcel 164, NOI, construct dwelling, septic, well, and appurtenances (Cont’d).  Attorney Ben Zehnder represented the applicant and provided 1) a letter from the Building Inspector dated Sept. 28, 2010 stating the lot is buildable; 2) # Page 2 of Slade topographical map from 1995 (identified fill on area), and 3) another topographical map to identify any fill within the wetlands..  Attorney Zehnder stated the owner notified him that they now want to build a smaller structure.  Lauren McKean stated the Commission requires square footage of disturbance, new lot coverage, clearer explanation on new design, narrative, work limits, construction protocol, mitigation for structure, management of invasives, knotweed elimination, and identification of  the neighbor’s well location.  Also identify the setback of pesticide treatment should be considered for neighboring properties due to close proximity of their wells, relying on mechanical treatment near property line.   John Cumbler moved to continue to May 1, 2019; seconded by Mike Fisher; passed 4-0.         

Evangelista & Kolenberg, 745, 765, and 775 Chequessett Neck Rd., Map 19, Parcels 111, 110, and 109, NOI, repair timber bulkhead, reconstruct timber walkway and stairs (Cont’d).  Alfred Picard represented the application.  Alfred Pickard requested a continuation to May 15, 2019.  He stated they have new plans.  John Cumbler moved to grant the continuation to May 15, 2019; seconded by Mike Fisher; passed 4-0.

Kraft, 580 Old Chequessett Neck Rd., Map 19, Parcel 601, NOI, tree removal, pruning, native plantings, driveway maintenance.  Due to lack of a quorum and at the request of the applicant, Mike Fisher moved to continue to May 1, 2019; seconded by Barbara Brennessel; passed 3-0.

The public hearing was closed at 5:40 pm.

Barbara Brennessel moved to adjourn 5:50 pm; seconded by John Cumbler; passed 4-0.
