4:10 - Business Meeting & Conservation Agent's Report

Review Community Development Strategy for FY 2015

The commission discussed additional items they wanted to see included in the Development Strategy for FY2015.  Agent Greenberg-Lemos will forward the suggested items to the Town Administrator.

Mail:

CCC hearing, 12/18/14 to determine regulations regarding fertilizers (Barnstable, Brewster, Chatham, Eastham and Provincetown).

Letter to Board of Selectmen  dated 12/10/14 from property owners on Ocean View Drive regarding parasailing and hang gliding and damage to the dunes.  They requested the town review parasailing and gliding at White Crest Beach.  Ed Simpson, owner of property on Ocean View Drive, stated he had not witnessed damage to the dunes.  The commission did not agree that this activity significantly damaged the marine scarp (aka “dunes”) and took no action. .

Agent Greenberg-Lemos stated the signs went up on Hamblen Park.

Meeting Minutes:    Cary Rea moved to approve the amended 11/19/14 Meeting minutes; seconded by Barbara Brennessel; passed 6-0.

Trudy Vermehren moved to approve the amended 12/3/14 meeting minutes; seconded by John Portnoy; passed 6-0.

The Commission will make a site visit to Indian Neck on January 7, 2015.  .

Public Hearings 5:00 pm:

Van Ness, 48 Sandpiper Hill Rd., Map 22, Parcel 7, Certificate of Compliance.  Agent Greenberg-Lemos stated that Felco Inc. confirmed the project was in compliance.  Ed Simpson moved to approve the Certificate of Compliance; seconded by Cary Rea; passed 6-0.

Kandal, 60 Bay View, Map 35, Parcel 37, NOI, control bank erosion (Cont’d from 12/03/14).   Don Monroe and Keith Johnson represented the applicant.  No work will be performed on the Spar property under this NOI filing; however, there is an open condition for beach nourishment on Spar property which will be done.  Keith Johnson gave an overview of the planned herbicide applications  for elimination of invasive plants, and also described  the plants which will be used to revegetate. (ck DEP numbers – if assigned, ok).  Trudy Vermehren moved to approve the NOI; seconded by John Portnoy; passed 6-0.  Supervisor:  Cary Rea   

Hamar, 560 Cheq. Neck Rd., Map 19, Parcel 56, RDA, Deck Replacement.  Mr. Hamar stated the original deck required replacement which he constructed in the summer of 2014.  The new  deck is 15’ x 28’ and Mr. Hamar stated he is not aware of the size of the original deck.  The commission stated they saw large amounts of debris as well as cutting of trees at the site visit.  He stated he had removed one spruce tree and pruned several trees within 100 ft of the wetland, but was unaware of the need for  commission approval.  The commission requested Mr. Hamar provide documentation of the size of the previous deck (photographs or from the assessor’s office).  The commission requested a continuation.  John Portnoy moved to continue to 01/07/15; seconded by Ed Simpson; passed 6-0.  

 

Seashell Condo’s, Cheq. Neck Rd., Map 19, Parcel 20, RDA, nourishment of beach

Alfred Pickard represented the applicant.  The commission made another site visit and agreed with the access that was recommended by Mr. Pickard, i.e. Power’s Landing to the beach, thence west along the beach to the condominiums.  He stated there was a washout in November 2014 and he received an Emergency Action permit.  (Green card to be provided).  Trudy Vermehren identified the project as a Negative 2; seconded by John Portnoy; passed 6-0.    Pickard will be diligent to re-nourish this site when needed in the future..

Friend, 675 Gull Pond Rd., Map 9, Parcel 627, NOI, addition to dwelling and exterior stairway (Cont’d from 11/19/14).  At the request of the applicant, Trudy Vemehren  moved to continue to 01/21/15; seconded by Ed Simpson; passed 6-0.

Donald, 0 Bayview, Map 35, Parcel 39, NOI, extend existing timber bulkhead (Cont’d from 11/14/14).  At the request of the applicant, John Portnoy moved to continue to 01/07/15; seconded by Ed Simpson; passed 6-0.

Bruce/Stearns, 105 Fifth Ave, Map 40, Parcel 52, AOOC, revise dwelling and floor plans, relocate  septic tank.  David Bennett represented the applicant and introduced Jessie Bean, a new employee from Bennett Environmental.  The revised plan has substantially reduced dwelling and decking area.  Some revegetation is provided for mitigation.   Lauren McKean moved to approve the AOOC; seconded by Barbara Brennessel; passed 6-0.  Supervisor:  Ed Simpson

Trudy Vermehren moved to adjourn at 6:00 pm; seconded by Lauren McKean; passed
