4:00 - Business Meeting & Conservation Agent's Report

  • Mail:  Invitation for 16th graduation ceremony for Americorps, Thurs. July 30, CCCC, 11:30
  • Draft of Renter’s guide to Natural Resources of MA.  It was recommended to call it “Vacationer’s guide……”.  The commission reviewed the material and made other recommendations. 
  • Habitant for Humanity for Cape Cod – Natural Heritage stated this will not be a take.
  • Safe Harbor newsletter
  • Transmittal from David Lajoie regarding new site plans for the Emmons property
  • Emergency Certification request from Ms. Krasting on Ocean View Drive to remove debris from the coastal bank.  Ed Simpson reported he made a site visit.  Agent Greenberg Lemos stated the leach pit is exposed and Ms. Krasting hired a contractor to remove it.  Ms. Krasting reported that concrete debris was placed on the bank  by Mr. Boehringer.  After reviewing some pictures, Agent Greenberg-Lemos will contact Ms. Krasting for further removal of debris.
  • A draft of a new general Order of Conditions attachment for the Wellfleet Wetland Protection Bylaw was reviewed by the commission.
  • On 6/23/15 – 11:00 am.  Site visit with Mass DEP at the Donald property, Old Wharf Road pursuant to the DEP’s appeal of the Commission’s approval of the NOI for the bulkhead extension.

      

Ginie Page stated there are some people who are upset that the sign at the overlook on Ocean View Drive is not visible.  She recommended the commission look at the site and determine what might be done to make it a public area again.  [It was subsequently determined that the parcel had been auctioned and sold to an abutter.]

Barbara Brennessel stated the fencing at Long Pond requires some repair.

Field Point – Kayaks.  The commission made a site visit and stated that there are three pallets on the coastal dunes which should be removed.  

Trudy Vermehren stated there are several temporary structures or shipping containers within Commission jurisdiction that have never received review under the WPA and local bylaw and are thus unpermitted.  Agent Greenberg-Lemos will have a discussion with the Building Inspector on how to manage these in general.      

                                  

John Portnoy gave an overview of current groundwater and creek water levels at Mayo Creek.  There was discussion regarding educating people who have concerns about the restoration of the creek and the removal of the duckbill valve.

 

Public Hearings 5:00 pm:

Lear, 90 Blue Heron Road, Map 42, Parcel 99, RDA, construct wooden platform (Cont’d).  The applicant requested a withdrawal.  Trudy Vermehren moved to approve the request for withdrawal; seconded by Ed Simpson; passed 6-0.

White / Shea, 9 Crest Ave, Map 35, Parcel 93.1, RDA, construct kayak rack.  Ms. Shea stated the rack would be on the beach, which she owns, and not on the coastal bank.  Natural Heritage stated they had no issue with the proposal.  Trudy Vermehren identified the project as a Negative 2; seconded by John Portnoy; passed 6-0.

Baptist, 461 State Hwy, Map 30, Parcel 19, RDA, construct shed (after the fact filing).   See hearing continuance below.     

Dzen/Dechirico, 190 Blue Heron Road, Map 41, Parcel 12, NOI, vista pruning, removal of 13 pitch pines, replanting and construction of at-grade deck.  David Lajoie and Adrian Punch gave an overview of the project.  A letter was distributed to the Commission from the owners which offered some mitigation.  Lajoie stated it is within the ACEC, riverfront buffer and within 50’ of  a coastal bank.  The owners are trying to get a view to the northwest by removing some trees and revegetate with lower growing shrubs.  Trudy Vermehren questioned the management of the black and white oak trees, which are resprouting. Portnoy questioned how these tall-growing oaks were to be managed, since the owners’ stated objective is to maintain a vista; however, Punch stated that he hadn’t discussed this with the owners.    Punch stated he didn’t believe the home owners would have an issue with future management, but would discuss this with them.  Punch stated the majority of the pine trees to be removed are not healthy and are located close to the structure.  Punch reviewed the replanting plan/mitigation plan.  The commission requested a more detailed plan identifying where plants will be located.  Punch explained the plants will be placed as close as possible to the trees to be removed.  He will be on site during the planting.  The proposed deck will be located in an area that is bare and there will be herbaceous plants placed around the deck. The commission recommended using an alternative anchoring system instead of sono tubes.  John Portnoy suggested an increase in the area of revegetation on the slope to restore the native coastal shrub thicket for wildlife habitat and for the control of runoff.   The commission requested a new landscape plan, a survival rate plan, maintenance plan and a plan for the kayak rack to accommodate 4 kayaks.  Trudy Vermehren moved to continue to July 15, 2015; seconded by Ed Simpson; passed 6-0.              

Trudy moved to close the public hearings and reopen the business portion at 5:35 pm; seconded by Barbara Brennessel; passed 6-0.

Emmons:  David Lajoie stated he had made an error on the site plan of the proposed dwelling.  He stated it is in the same location as before and there should be an additional jog on the plan.  There will be no change in the square footage of the building.    

Reopen public hearings at 5:40 pm.

Baptist:  The commission stated the shed is very large and looks like an addition to the main structure.  Agent Greenberg-Lemos has had correspondence with the owner for over a year and no site plan was submitted with the current application (after the fact filing).  There are also storage containers on the property.  Trudy Vermehren moved to continue to July 1, 2015; seconded by John Portnoy; passed 6-0.
