Minutes of Conservation Commission

June 3, 2015

Attendees:  Trudy Vermehren, Ginie Page, Barbara Brennessel, Ed Simpson, John Portnoy

4:00 - Business Meeting & Conservation Agent's Report

Benefits of salt marsh restoration:  John Portnoy distributed the MA Wetlands Protection Act and the Wellfleet Environment Protection Bylaw.  Agent Greenberg-Lemos stated the commission should be focused on what should be there, the native ecosystem, versus what is there with respect to human altered habitats.  Agent Greenberg-Lemos stated there is a need to communicate the benefits of salt marsh restoration to the public.  Agent Greenberg-Lemos will review some of the material available.  The Commission discussed the Mayo Creek project and the timeframe.  The Commission will discuss this topic again on June 17, 2015.

40 Main Street, Wicked Oyster/Dorrell, parking and planting plans.  Deconstruction Plan, removal and revegetation and parking plan were distributed to the commission.  The lot will be regraded and the commission wants to be assured there will be clean fill used, if necessary, to avoid any invasive plant species.  Trudy Vermehren moved to approve the Supplemental information provided; seconded by Ed Simpson; passed 5-0.  

MAIL:

  • From Agent Hillary Greenberg-Lemos to Mr. Robert Wallace regarding parking on Indian Neck.
  • From Planning Board regarding a subdivision proposal for Habitat for Humanity for Old Kings Highway, Map 16,   Parcels  110, 111 and 143 Definitive Plan.  Agent Greenberg-Lemos stated the proposal would be sent to Natural Heritage for review.  The Commission signed off on the plan with no statement other than to request a copy of the MNHESP letter.

Meeting Minutes:     

Trudy Vermehren moved to approve the amended meeting minutes of 5/20/15; seconded by Ed Simpson; passed 4-0.

Trudy Vermehren moved to approve the amended meeting minutes of 05/06/15; seconded by John Portnoy; passed 4-0.

Jurisdictional Opinion:  Richard Lay, 335 Forrest Road, Map 16, Parcel 612.  remove 2 pine trees which are leaning over path and house.  Trudy Vermehren  moved to approve the Jurisdictional Opinion; seconded by John Portnoy; passed 5-0.

Agent Greenberg-Lemos stated she received from USGS a courtesy notification supporting Herring River Restoration blue carbon research.

Public Hearings 5:00 pm:

O’Reilly, 635 Chequessett Neck Rd., Map 19, Parcel 117, Certificate of Compliance.  John O’Reilly stated the work is in compliance.  The retaining wall was moved further away from the resources.  The Commission requested the pine needles and debris be removed from the resources.  A letter from the commission will be sent regarding the Japanese Knotweed.  Trudy Vermehren moved to approve the Certificate of Compliance; seconded by John Portnoy; passed 5-0.

O’Reilly, 635 Chequessett Neck Rd., Map 19, Parcel 117, Certificate of Compliance.

Beach access stairs.  There are pine needles and debris on the resources which the commission would like removed.  Trudy Vemehren moved to approve the Certificate of Compliance; seconded by Ed Simpson; passed 5-0.

Lear, 90 Blue Heron Road, Map 42, Parcel 99, RDA, construct wooden platform.  The Commission stated there is vegetation growing within the footprint of the project.  The Commission feels this is a large project and the site plan provided is very old, dated 1978.  An up-to-date engineered site plan needs to identify the wetland and the deck.  Agent Greenberg-Lemos will contact the applicant.  Trudy Vermehren moved to continue to 06/17/15; seconded by Ginie Page; passed 5-0.

TD Bank, 65 Old Salt Lane, Map 41, Parcel 70, NOI, Septic Upgrade.  John O’Reilly represented the applicant.  The area is an isolated fresh water wetland  and the lots are small, limiting wastewater disposal options.  Trudy Vemehren moved to approve the NOI; seconded by Ginie Page; passed 5-0.

TD Bank, 150 Compass Hill Rd., Map 41, Parcel 64, NOI, Septic Upgrade.  John O’Reilly represented the applicant.  There is isolated wetland near the property and the entire property is within the Commission jurisdiction.  This will eliminate a cesspool and be upgraded to a Title 5.  John Portnoy moved to approve the NOI; seconded by Barbara Brennessel; passed 5-0.

Trudy Vermehren moved to adjourn at 5:45; seconded by Ed Simpson; passed 5-0.
