Jurisdictional Opinion

1)  Town of Wellfleet, Indian Neck, install split rail fencing and plant native vegetation.   John Portnoy moved to approve the Jurisdictional Opinion; seconded by Ed Simpson; passed 5-0.

2)  Young/MacDonald/ Lt. Island Road association, provide maintenance to Lt. Island Road, spot fill potholes in road.  Material will be native sandy subsoil.  The commission requested Agent Greenberg-Lemos to identify who owns the road.  Trudy Vermehren moved to approve the Jurisdictional Opinion; seconded by John Portnoy; passed 5-0.

3)  Gadwa, 130 Catboat Road, replace galvanized well with a well made of PVC.  Trudy Vermehren moved to approve the Jurisdictional Opinion; seconded by John Portnoy; passed 5-0.

Agent  Greenberg-Lemos stated she will request the owners of 135 Pine Point Rd. to remove  the brush from the property.

Agent Greenberg-Lemos reported retaining wall work was being done at 140 Fox Island Rd.

Fox Island Road, tree cutting done on Weisman.  The Commission can take no action because there is no evidence of who performed the cutting.  Agent Greenberg will write a letter to the association and state the issue must be settled in court.    Agent Greenberg-Lemos requested that Weisman have Slade Associates identify the jurisdictional wetland on the site plan; however, Mr. Weisman stated that he does not want to pay for this.            

464 State Highway, Map 42, Parcel 22:  Tree cutting / planting plan.  Planting plan not available at this time.  Owner will notify when he will be available for meeting.

Herring River Low Lying Roads – to be discussed at future meeting.

Fees:

Continued hearings beyond 2 meetings:  recommendation $5.00 per hearing to be paid prior to issuing final paperwork.

NOI:  current fee is $45.00, other towns are typically $100.00.  Propose $100.00

RDA:  current fee is $20.00.  Propose $30.00

JO:  no current fee.   Propose $15.00

Certificate of Compliance:  current $15.00.

AOOC:  current fee is $25.00.  Propose $50.00

Agent Greenberg-Lemos will provide commissioners with procedural form for review and update.

   

Public Hearings 5:00 pm:

Mayo Creek Restoration (Town of Wellfleet), RDA, open duckbill valve.  John Riehl Chairman of the Mayo Creek Restoration Committee (MCRC) stated they are proposing a 30-day trial opening of the one-way duckbill valve  to allow the collection of enough tide-height data to validate an existing hydrodynamic model for future planning.  Mayo Creek has been a degraded salt water marsh  for over 100 years, and by allowing water to flow in for 30 days, it would provide  flushing  with relatively clean harbor water.  Tidal restoration would also help with  nitrogen remediation.  He provided an overview of the importance of ground water level monitoring in the area, testing abutter ground water levels and any effects to drinking water.  Post-triall monitoring will take place after the valve is closed.  Maria Hollis of Harborside Village Cooperative Corporation (HVCC) stated Dave Bennett, an engineer for their water supply system, told her there is clay under one of the test wells.  The engineer stated the tests have to be coordinated at the same time, at various tide levels.  John Portnoy gave an overview of the borehole logs from both the HVCC supply well and the new deep Mayo creek observation well, just 200 ft away.  .  He also stated, after having a discussion with hydrologists from Cape Cod Commission, that it was very unlikely that water quality in these deep wells would be affected by tidal stage; therefore, the hydrologists and the MCRC see no need to sample these wells at various tidal stages  Modeling indicates that 20 acres will be flooded at high tide.  Tide heights would be well below any infrastructure, all of which is reported by the town as being above 3.5 ft NAVD88. .  Mike Parlante stated he is concerned with the time of year the valve is to be opened and expressed concern with the animals in the area that will be in jeopardy of salt water as well as any vegetation.  John Riehl stated the committee wants to have long working days and would have a problem with the short day length in the fall.        

Neil Gadwa  questioned if the boats in the marina slips will be affected by high velocity discharge from Mayo Creek’s culvert; however,  Riehl stated he didn’t feel it would be a significant issue.  Natural Heritage stated no endangered species would be affected.  John Riehl stated the Board of Selectmen will be addressing this project  at their June 16 meeting (it’s actually on 23 June –JP) and will determine whether the valve can be opened as planned in June or the opening postponed until the fall.   Trudy Vermehren moved to identify this as a Negative 2, seconded by Barbara Brennessel; passed 4-1.

Buglione, 84 Springbrook, Map 47, Parcel 28, NOI, septic upgrade.  Jason Ellis represented the applicant and gave an overview of the project.  The leach field is within the 200’ riverfront.  SE77-1387.  There was discussion regarding the elevations.  Trudy Vermehren moved to approve the NOI; seconded by Cary Rea; passed 5-0.

Trieschman, 14 Wigwam, Map 35, Parcel 134, NOI, add master bedroom, foyer and hall, new deck and staircase, stone steps and retaining walls.  Richard Lay and Jay Horowitz represented the applicant.  ZBA approval was received on May 7, 2015.  Mr. Lay gave an overview of the work to be done in the resource area and the construction protocol, identifying the work limit.  Gutters will be installed as well as drywells.  All disturbed areas will be revegetated.  Ms. Trieschman stated they are not looking to plant a lawn and want native plantings.  John Portnoy moved to approve the NOI; seconded by Ed Simpson; passed 5-0.     77-1388  Supervisor:  Lauren McKean

Bedrosian, 100 Kendrick Ave., Map 20, Parcel 8, RDA, deck extension and construct an outside shower.  Eric Winslow represented the applicant and stated there would be posts placed to support the decking and also used for the outside shower.  Ed Simpson moved to identify the project as a Negative 2; seconded by John Portnoy; passed 5-0.

Bromberg, 195 Samoset Ave., Map 28, Parcel 97, NOI, remove and rebuild dwelling (Cont’d from 05/06/15).  At the request of the applicant, Trudy Vermehren moved to continue the hearing to July 1, 2015; seconded by John Portnoy; passed 5-0.

Trudy Vermehren moved to adjourn at 5:55 pm; seconded by Cary Rea; passed 5-0.
