Wellfleet Board of Health

                                       Minutes of Meeting of January 9, 2019

Senior Center, Duck Pond Room, 7:00 p.m.

 

 

Present:  Ken Granlund Jr., Chair; Moe Barocas, Janet Drohan, Gary Locke, Nick Picariello; Health Agent Hillary Greenberg-Lemos, and Mary Rogers, Committee Secretary

 

Chair Ken Granlund called the meeting to order at 7:00 p.m.

 

Variance Requests

15 Ring Road

Jason Ellis presented the request for a septic system upgrade on behalf of Marianna Koval of 15 Ring Road (Map 41, Parcel 103) as requested in his November 28, 2018 letter and on the J. C. Ellis Design plan dated October 30, 2018 for the following variances:

 

  1.  5’ from proposed S.A.S. to lot line.

(10’ required. 5’ provided. 5’ variance requested)

  1.  50’ from proposed S.A.S. to Coastal Bank

(50’ required, 0’ provided, 5’ variance requested)

  1. 24’ from proposed septic tank to Coastal Bank

(25’ required, 1’ provided, 24’ variance requested)

  1. No reserve area provided.

 

Three wells appear on the plan.  The surveyor’s stamp needs to be on the plan.  There is grading that needs to be done before the plan receives ConsCom’ s final approval. The Board of Health will need to see a revised plan with the grading detail and the surveyor’s stamp,

 

Gary Locke moved to approve the J. C. Ellis Design plan dated October 30, 2018 and grant the four variances for the upgrade of a septic system to serve a 3-bedroom structure requested in the November 28, 2018 letter for 15 Ring Rd. (Map 41, Parcel 103) using ADVANTEX AX20 denitrification technology under the general use Mode 3B subject to the following conditions:

 

  1. Design flow to be limited to 440 GPD, to serve 3 bedrooms.
  2. 50% reduction in leachfield.
  3. No increase in habitable area without Board of Health review.
  4. There is to be no conversion of use without Board of Health review.
  5. The well water shall be tested and found potable, with results copied to the Health Department, prior to issuance of the Disposal Works Permit.
  6. Any restriction in design flow and all conditions shall be recorded against the deed for the property at the Registry in Barnstable, and proof of deed recording shall be submitted to the Health Department prior to the issuance of the Disposal Works Permit.Design flow   for 3 bedrooms
  7. A copy of a 3 year operation and maintenance contract with a certified wastewater operator shall be submitted to the Health Department prior to issuance of the Disposal Works Permit.  The system is to be equipped with a modem and auto dialer programmed to automatically call the maintenance company if alarm conditions occur.  Monitoring shall be quarterly for effluent for the following parameters:  temperature, pH, nitrate, ammonia, BOD, TSS, Total Nitrogen and TKN.  The influent shall be sampled for these parameters biannually.  The schedule for monitoring shall be quarterly for the first 2 years of operation, semi-annually for the next 2 years, and 1 sample annually from then on.  If sampling data results exceed maximum effluent discharge limits, a system modification will be required.  The Board of Health will evaluate limits that are exceeded twice in a year’s time.  Upon transfer of deed this schedule shall be restarted.  All results copied to the Health Department and the Barnstable County Department of Health and the Environment, with data provided in what format is acceptable to those agents.  Any other sampling per DEP approval.
  8. Plan to be submitted with land surveying stamp.
  9. Grading detail over SAS to be submitted.

 

Moe Barocas seconded, and the motion carried 5-0.

 

135 Old Truro Road

Jason Ellis explained the proposal for a new single-family residence, well and septic system for Lawrence Kaplan and Michele Rose at 135 Old Truro Road (Map 8, Parcel 144) for the variances requested in his letter dated November 28, 2018 and presented on the J.C. Ellis plan dated November 10, 2018:

 

  1.  12’ from proposed S.A.S. to proposed foundation.

(20’ required, 8’ provided, 12’ variance requested)

  1. 8’ proposed S.A.S. to drainage system.

(25’ required, 17’ provided, 8’ variance requested)

  1. No reserve area provided.

 

Hillary Lemos read two letters of concern from abutters: one requesting an environmental impact study and the other with issues about the size of dwelling and a blocked storm drain and culvert on the property.  The Board does not grant variances for new construction.  They suggested reconfiguring the plan to do away with the need for variances.  The “no reserve area” could be allowed.  The drainage culvert would be a DPW and construction matter. 

 

Gary Locke moved to continue to another meeting.  Nick Picariello seconded, and the motion carried 5-0.

 

1005 Third Avenue

Jason Ellis presented the proposed upgrade of the existing septic system at 1003 Third Avenue (Map 40, Parcel 8) for the Trustees of Island Road Realty Trust, Henry and Barbara Ferris, as requested in his letter dated November 28, 2018 and presented in the J.C. Ellis plan dated September 30, 2018 with a request for one variance:

 

  1. Proposed leach area to be located beyond property line.

 

The surveyor’s stamp needs to be added to the plan. 

Gary Locke moved to approve the J.C. Ellis plan dated September 30, 2018 and grant the one (1) variance as requested in his letter dated November 28, 2018 for 1003 Third Avenue (Map 40, Parcel 8) for upgrade of a septic system to serve a four-bedroom structure with the following conditions:

 

  1. Design flow be limited to 448.96 GPD, to serve 4 bedrooms
  2. No increase in habitable area without Board of Health review.
  3. There is to be no conversion of use without Board of Health review.
  4. The well water shall be tested and found potable, with results copied to the Health Department, prior to issuance of the Disposal Works Permit.
  5. Any restriction in design flow and all conditions shall be recorded against the deed for the property at the Registry in Barnstable, and proof of deed recording shall be submitted to the Health Department prior to the issuance of the Disposal Works Permit.Design flow   for 4 bedrooms.
  6. Plan to be submitted with a land surveying stamp. 

 

Janet Drohan seconded, and the motion carried 5-0.

 

Business

Letter to Governor Baker

Eastham Board of Health member Joanna Buffington presented the request to join other local health boards to urge the governor to require an independent health impact assessment prior to authorization of any natural gas infrastructure project in Massachusetts.  She explained the focus of Eastham Board of Health’s letter to Governor Baker.  The Board decided to take the matter under consideration and make a decision at another meeting. 

 

Appeal of Determination

Claire Watts had submitted a written appeal of the Health Agent’s determination of rats on the premises at 5 Beechwood Lane (Map 12, Parcel 240).  The Health Agent read a letter from abutters, requesting a review of the Watts’ chicken permit because of rats in the area.  The Health Agent had requested that Ms. Watts bring a professional exterminator to make a determination and for her to clear brush piles on the property.  Ms. Watts said she has removed birdfeeders and will clear the brush.  The Board suggested that Ms. Watts demonstrate effort on trapping and video recording any rat activity.  Paula Erickson, who co-owns the chickens, said they had taken measures to eliminate the rats.  The Board maintained that a professional exterminator must examine the property.  A farm permit for chickens carries the responsibility to take care of vermin.  The Health Agent will come back for another inspection as well. 

 

Farm Animal Permit

Pilar Clements had submitted an e-mail request for 6 chickens at 45 Peace Valley Road (Map 18, Parcel 239).  The Board said she will need to come to a meeting to present an application for her plans.

 

Licenses

Board members approved and signed licenses for 2019. 

 

Correspondence

Health Agent Hillary Lemos reviewed a number of letters which she had sent.  Board members discussed inspections of Airbnb’s and units subject to the 6% rental tax.  She distributed

the Organic Land Management Policy from the Selectboard and highlighted a number of other items in the Correspondence File.

 

BOH Meeting Time

The Board of Health made plans to begin meetings at 6:00 p.m.

Moe Barocas moved to approve the minutes of November 14, 2018.  Gary Locke seconded, and the motion carried 5-0.

Janet Drohan moved to adjourn.  Nick Picariello seconded, and the motion carried 5-0.
