Minutes of Meeting of July 13, 2016

Senior Center, Duck Pond Room, 7:00 p.m.

Present:  Ken Granlund Jr., Chair; Moe Barocas, John Cumbler, Janet Drohan, Gary Locke, and Mary Rogers, Committee Secretary

Chair Ken Granlund called the meeting to order at 7:00 p.m.  The meeting was tape-recorded.

Stable Permit Renewal - Briggs 45 Peace Valley Road (Map 8, Parcel 239)

Gary Locke disclosed that he was an abutter to the stable property.

Lonni Briggs presented her request for a renewal of her Stable Permit for 45 Peace Valley Road (Map 9, Parcel 239 with a second horse to be stabled on the property.

Janet Drohan moved to approve the renewal of a Stable Permit for 45 Peace Valley Rd. (Map 9, Parcel 239) with accommodation for a second horse.  Moe Barocas seconded, and the motion carried 5-0.

Variance - Kane, 155 Pine Point Road (Map 21, Parcel 56)

David Lajoie from Felco explained the three variance requests for 155 Pine Point Road.

  1. 7’ from leach area to property line (street) – 310 CMR 15.211
  2. 24% reduction in required leach area provided – 310 CMR 15.240(4)
  3. Modified 5’ excavation for construction in fill – 310 CMR 15.255

The plan had already been before the Conservation Commission, he said.  It provides an upgrade from cesspools to a Title 5 system.

Gary Locke moved to approve Felco Plan #15043  dated May 30, 2016 and grant the three variances requested in the letter of June 17, 2016 to serve a 3 bedroom structure subject to the following conditions:

  1. Design flow is to be limited 330 GPD, to serve 3 bedrooms.
  2. A variance has been granted to allow a reduction in the size of the leach area provided to  225 gpd.   Any functional or hydraulic failure will necessitate upgrade to Title 5 Code LTAR soil absorptions system calculated to at least 77% of the design flow.
  3. No increase in habitable area without Board of Health review.
  4. There is to be no conversion of use without Board of Health review. 
  5. The well water shall be tested and found potable, with results copied to the Health Department, prior to issuance of the Disposal Works Permit.
  6. Any restriction in design flow and all conditions shall be recorded against the deed for the property at the Registry in Barnstable, and proof of deed recording shall be submitted to the Health Department prior to the issuance of the Disposal Works Permit.
  7. Pumps, alarms and other equipment requiring periodic or routine inspection and maintenance shall be operated, inspected and maintained in accordance with the manufacturer’s and the designer’s specifications and Department guidance. I no instance shall inspection be performed less frequently than once every three months for a system serving a facility with a design flow of 2,000 gallons per day or greater and annually for a system serving a facility with a design flow of less than 2,000 gallons per day.  The system owner shall submit the results of such inspections to the local Approving Authority annually by January 31st of each year for the previous calendar year.

Janet Drohan seconded, and the motion carried 5-0.                        

Business 

The Board reviewed the plans for Preliminary Subdivision #16-01 (Map 15, Parcels 22 & 23) and an 81-W Modification for Whereaway Lane (Map 15, Parcels 148.2 and 148.3) wrote their comments to submit to the Planning Board.

Janet Drohan asked about statutes that deal with commissary kitchens.  She was referred to the State regulations and the Health Agent. 

Licenses

The Board signed licenses that had been submitted for approval.

Moe Barocas moved to approve the minutes of May 11, 2016.  John Cumbler seconded, and the motion carried 5-0.
