Meeting Minutes September 10, 2014

Senior Center, Long Pond Room, 7:00 pm

Attendees:  Richard Willecke, Ken Granlund, Janet Drohan, Lezli Rowell, Gary Locke

Chair Willecke opened the meeting at 7:00 pm.  Chair Willecke reviewed the procedures and protocol of the meeting. 

 

  1. Title V Variances Requests

Watts, 5 Beechwood Lane, Map 12, Parcel 240, Farm Stable - Chickens.  Ms. Watts stated the chickens have been there for some time and she is getting her permits now.  Agent Greenberg-Lemos stated the abutting well is 66’ from the chicken coop area   A letter from abutter Quimby was read into the record opposing the chickens.  A letter from the Potters supported the chickens.  Agent Greenberg-Lemos stated the manure management plan would have to include the chicken coop as well as fenced in area due to the abutter’s well concerns.  Paula Erickson, who cares for the chickens as well, stated she could build a sound proof barrier to the abutte’rs property.  Lezli Rowell moved to approve the permit as well as the manure management plan with the following conditions:

  1. A potable water test must be submitted prior to the issuance of the actual permit (water bottles available at the Board of Health office with water sample delivery to the DPW building on either Tuesdays or Thursdays by 9:30 am)
  2. Construction of an impervious compost bin according to Health Department requirements.
  3. The construction of a sound proof structure be provided for a sound barrier.
  4. Site inspection by the Health Department to confirm that conditions 1, 2 and 3 have been satisfied.
  5. No roosters allowed on this property.

Herring Creek Condo’s, 34 Erick’s Way, Map 8, Parcel 66.  Lezli Rowell divulged that one of the eight owners work as the office administrator at a construction company which employees three of her family members and Chair Willecke stated he did not see a conflict.  David Lajoie represented the applicant.  This is an 11 bedroom apartment building and is abutted by the Herring River and the system requires upgrading and the well needs to be relocated.  Lajoie stated there will be a retaining wall on the right hand side of the building.  Lezli Rowell moved to approve Felco Plan 14034, dated 08/27/14 and grant the 6 variances for the upgrade of a septic system to serve an 11 bedroom condominium structure, a grandfathered, non-conforming structure with pump dosing as requested in your letter of August 27, 2014 with the following conditions:

  1. Design flow is to be limited to 1,238 gpd, to serve eleven (11) bedrooms.
  2. The new well shall be connected and put in service under the benefit of proper plumbing and electrical permits and well shall be tested and found potable, with results copied to the Health Department, prior to issuance of the Disposal Works Permit.
  3. Audio / Visual alarms for pump chambers shall be set to activate when liquid level reaches 60% capacity; pumping to be performed within 48 hours.  Annual log of pumping records and septage disposal to be submitted to the Health Department with O & M contract for service and hauling copied to the Health Department.  All pumping records to be copied to the Health Department.  Failure to do so may result in requirement for inspection, or “cease and desist” order from operation of tight tank.
  4. Bi-Annual pump out of the existing 1,000 gallon septic tank is required, with log of septage disposal copied to the Health Department.  This is contingent upon water tightness testing accept by the Health Department, if 1,500 gallon tank to replace, upgrade to H-20 rating.
  5. Pump Dosing monitoring:  A copy of a 3 year operation and maintenance contract with a certified wastewater operator shall be submitted to the Health Department prior to issuance of the Disposal Works Permit.  The system is to be equipped with a modem and auto dialer programmed to automatically call the maintenance company if alarm conditions occur.  Monitoring shall be quarterly for effluent for the following parameters:  temperature, pH, nitrate, ammonia, BOD, TSS, Total Nitrogen and TKN.  The influent shall be sampled for these parameters biannually.  The schedule for monitoring shall be quarterly for the first 2 years of operation, semi-annually for the next 2 years, and 1 sample annually from then on.  If sampling data results exceed maximum effluent discharge limits, a system modification will be required.  The Board of Health will evaluate limits that are exceeded twice in a years time.  Upon transfer of deed this schedule shall be restarted.  All results copied to the Health Department and the Barnstable County of Health and the Environment, with data provided in what format is acceptable to those agents.  Any other sampling per DEP approval.

Janet Drohan seconded; passed 5-0.

Riley & Baranowski, 130 Pleasant Pt., Map 35, Parcel 104.  David Lajoie represented the applicant and stated on June 11, 2014 approvals were received from the Board of Health for an upgrade.  The property is now on the market and because there is a public water supply in the area, the property will require additional variance requests.  This property is in Zone 1 and Lajoie contacted DEP who responded that if there is no increase in bedroom count, it would be provisional testing/approval.  Ms. Riley learned about the necessary upgrade after accepting an offer for the property and is in a hardship at the present time.  She stated part of the P & S agreement was that a new system be installed.  Lezli Rowell reviewed the rlocal regulation requiring ditrification with a well location within 100’ as plain language but agreed the technology could be required  under Maximum Feasible Complince.  Liz Sorrell and three abutters expressed concern regarding the upgrade.  Todd Everson, engineer for the Pleasant Point Water system, requested the Board  approve an I/A system.  He stated there is a challenge to maintain the water quality.  Lezli Rowell moved to approve Felco Plan 14023, dated 08/27/14 and grant the 6 variances for the upgrade of a septic system to serve a two bedroom structure, for I/A technology using Advantex Orenco denitrification technology under the provisional approval category as requested in your letter of August 27, 2014:

  1. Design flow is to be limited to 234 gpd, to serve two bedrooms.
  2. No increase in habitable area without Board of Health review.
  3. There is to be no conversion of use without Board of Health review.
  4. Any restriction in design flow and all conditions shall be recorded against the deed for the property at the Registry in Barnstable, and proof of deed recording shall be submitted to the Health Department prior to the issuance of the Disposal Works Permit
  5. Kim Shkapich, 317 B Main St., Food Code Variance.  Kim Shkapich stated she uses vinegar in many of her products and hermetically seals her products.  A special permit is required due to the vinegars and she has sent her products to be tested.  Agent Greenberg Lemos gave an overview of the MA regulations regarding the use of vinegar for preserving food.  Lezli Rowell moved to approve the variance; seconded by Ken Granlund; passed 5-0.

 

  1. Business

Public Hearing – dates for transfer station closure.  Agent Greenberg-Lemos  stated at our last meeting, there were two haulers who had issues with the transfer station being closed on Wednesdays.  Last year the Board of Health approved the  Wednesday and Thursdays closures from Memorial Day to Labor Day.  Commercial haulers stated they would like the station open on Wednesday and Agent Greenberg-Lemos had discussions with the Director of the DPW.  She stated this would be an inconvenience to all the residents because of the change.  She provided data regarding usage of the transfer station as well as tonnage per month from 2011 to 2013.  Town Administrator, Harry Terkanian, provided information on the use of the transfer station on days of the weeks by commercial haulers.  Harry Terkanian stated the seasonal staffing issues are a problem for the DPW.   Harry Terkanian stated Yarmouth is outsourced and takes garbage from everywhere.  Paul Lindberg stated the recycling is going to Yarmouth and he has developed a relationship with Yarmouth and makes appointments to drop off the refuse and his staff has not had to wait.  Harry Terkanian stated the town is not aware of the tonnage of the commercial haulers and there is a mixture of purple and black bags.  The Board approved an emergency order at the last meeting for commercial haulers to utilize the transfer station.  It was determined by the Board not to change the closure days.  Janet Drohan moved to revisiting the commercial fee schedule; seconded by Ken Granlund; passed 5-0.  Harry Terkanian stated he has been obtaining data regarding beach permits, transfer station data, etc. to start determining the population.   

Survey for Haulers – no questions / comments – Chair Willecke stated he did not feel this subject needed to be continued.

  1. Correspondence:      

Lezli Rowell reviewed the correspondence file.  One letter in particular started a  conversation regarding the sodium level because it identified the sodium level at 2,000 mg/L and the state level is 20 mg/L.    Agent Greenberg-Lemos will contact the state to gather additional data.

The swap shop is reopened.
