Shellfish Advisory Board Meting
June 2, 2014

Present: Barbara Austin, Barbara Brennessel, John Duane, Joel Fox, James O’Connell, Jacob Puffer (alternate), Rebecca Taylor, Helen Miranda Wilson

Others in Attendance: Fred Richard, John Brawley, Andrew Koch, Shellfish Constable, Michael De Vasto, Jason Lance, Katie  Murphy, Chopper Young, Alison Paine, Bob Wallace.

  1. Meeting convened at 7:15 pm

  2. Minutes from May 6, were approved (5-0); issues will be brought to BOS meeting on June 10.

Reconsideration of Section 7.16.Petite Oysters and Gems.  There was an extended discussion of petites and commercial permits and also with reference to spat collection vs farm raised product.   We voted on a revision to Section 7.16.  Changes are in boldface:

 7.16. Petite Oysters and Gems 

An aquaculture license holder may harvest and sell petite oysters (between 2.5 and 3 inches in height) and/or gems (quahogs between 3⁄4 and 1 inch in width) grown on their grant if :

a. they do not harvest oysters of any size from the wild, by any means, from any part of the harbor;

b. they have documented proof of purchase of seed, with the exception of what they collect on spat collecting devices;

c. they have the required amendment to their propagation permit, granted by the State, allowing them to sell petite oysters and/or gems to a previously designated dealer, approved by the State;

d. they, or their employees, or otherwise affiliated persons (as defined in Section 7.8.4 Employees of Licensees) or their families do not store any oysters or quahogs, harvested from the wild on their licensed area(s); 

e. they are limited to selling petite oysters and/or gems for a term of not less than a year, beginning with the routine issuance of an annual propagation permit from the State;

 f. they forfeit any claim to a hardship waiver under Section 6.1.4 Hardship Exemption of the Town of Wellfleet Shellfishing Policy and Regulations.

  1. The amendment was moved and approved 5-0.We will hold the issue from consideration by the BOS until we decide ona structure for an alternate species permit.

  2. B.B. suggested that we put on the next agenda, the issue of a partial commercial permit for those who want to sell petite oysters but harvest other species.

  3. Possible liability insurance requirement:There was a discussion aboutgeneral liability insurance on licensed aquaculture grants.If we were to require this, John Duane suggested wording to the effect “To the minimum standard required or provided by the insurance industry. “Joel offered to find out more about this.

  4. Section 7.18.2 . Height and Arrangement of Equipment.We will ask the Harbor Master to come to a future meeting to give us input about height restrictions.

  5. Rotation of Areas: There was a discussion about rotational closures and spawning sanctuaries.There was no resolution to these issues.

  6. Further division of CCB11.There is a sense that CCB11 should be divided, so that potential closures do not affect the entire Harbor.There was no consensus about this issue.
