Minutes of Meeting on Wednesday, February 3, 2016

Council on Aging, 7:00 PM

Members Present: Janet V. Morrissey, R. Dennis O’Connell, Alfred Pickard, Janet Reinhart

Members Absent:   Gerald E. Parent, Chair, Andrew Freeman,

Others Present: ATA Brian Carlson, Chet Lay of Slade Associates

Vice-Chair Morrissey opened the meeting at 7:00 PM.

27 Whereaway Lane ANR #15-06

Chet Lay of Slade Associates presented documentation that the owner of 27 Whereaway Lane is a member of the Home Owner’s Association (HOA) for Whereaway Lane Extension.  The Board questioned the accuracy of the document as there appears to be a discrepancy in the number of members in the HOA.  Lay will address the discrepancy and re-file the ANR and return for the next meeting on February 17, 2016.

ZBL Revision Warrant Article Public Hearing

Vice Chair Morrissey opened the public hearing at 7:07 PM by reading the legal advertisement for the hearing that appeared in the Cape Codder on January 15 and 22, 2016. 

After the proposed revisions to Zoning Bylaw Sections 7.3.1 & 7.3.2 were reviewed by the Board, O’Connell moved to recommend the revisions to ZBL Sections 7.3.1 & 7.3.2 as they had been posted on the Town website and at the Town Clerk’s office; Reinhart seconded; the motion passed 4-0.

O’Connell explained the proposed revisions to the definition of Lot Area.  Reinhart made the motion to recommend the revised definition of Lot Area as amended; Pickard seconded; the motion passed 4-0.

O’Connell explained the proposed revisions for clarification to Zoning Bylaw Section 6.14.2.  Reinhart made the motion to recommend the revisions to ZBL Section 6.14.2 as amended; O’Connell seconded; the motion passed 4-0.

It was noted that there were no members of the public present, so no public comment was made during the hearing.

Vice- Chair Morrissey closed the public hearing at 7:28 PM.

Disposition of Town-Owned Property: Map/Parcel: 15/164, 29/489 & 29/493

The Board discussed the memo sent by Town Administrator Terkanian regarding the disposition of Town-owned land to the care of the Wellfleet Conservation Commission.  The Board noted that each parcel is considered marsh land.

O’Connell stated that the Wellfleet Conservation Trust is an abutter to some of these parcels.  He offered to recuse himself but it was agreed by the Board that he would simply abstain from voting.

Pickard moved to recommend the disposition of Town-owned lots: Map/Parcel 15/164, 29/489, and 29/493 to the care, custody, and control of the Wellfleet Conservation Commission for conservation protection contingent upon Town Meeting approval; Reinhart seconded, the motion passed 3-0-1.  A letter will be sent to the BOS and the TA regarding the Board’s decision.

Subdivision Regulations Revisions

O’Connell explained the most recent proposed revisions to the Subdivision Rules and Regulations.  The Board deliberated over these proposals, including details on seeding and loaming, and slopes.

Pickard moved to send the revised draft of the Subdivision Rules and Regulations to public hearing on March 16, 2016; Reinhart seconded; the motion passed 4-0.

Old King’s Hwy Community Housing Project

The Board discussed the progress of the case going through the Zoning Board of Appeals.  Their next hearing is slated for 2-4-16.  The taking of more trees had been considered by the ZBA.

Com Electric Restoration Bond Update

ATA Carlson stated that there is no repository or registry for restoration bonds.  The Town is considered a third party, so it would not receive a yearly Certificate of Insurance, and there are only limited reasons it would receive any communication about a bond at all.  Although the bond that was cancelled in June of 2015 covered the removal of Nextel’s telecommunications equipment on the Gross Hill Rd tower, the Board still questions whether there is a restoration bond for the tower itself.  More research will be done to ascertain the current status of the bond in question.

DLTA Grant Status

ATA Carlson stated that there was no news at this time on the status of the 2016 grant application. 

ATA Carlson then presented the Wellfleet Vacant Lot Map that was produced by Martha Hevenor of the Cape Cod Commission.  This map was requested by the Board for last year’s project to assist in drafting a revised Cluster Bylaw.  O’Connell suggested a change in the parameters used to increase the minimum lot size to approximately one quarter of an acre and also requested a larger version of the map that can be read and used more easily.  Vice-Chair Morrissey suggested tabling the discussion until the complete Board reconvenes in March.  In the meantime the Board will examine the map in order to propose further changes.

ATA Carlson stated that he is meeting with Martha Hevenor on February 10, 2016 at 3:00 PM and Planning Board members are welcome to attend.
