Minutes of Meeting on Wednesday, January 21, 2015

Wellfleet Senior Center, 7:00 p.m.

 

Present: Janet Morrissey, Acting Chair, Eric Larsen, Dennis O’Connell, Janet Reinhart; Assistant Town Administrator, Brian Carlson

Janet Morrissey called the meeting to order at 7:00 p.m.

Minutes

Janet Reinhart moved to approve the amended minutes of January 7, 2015.  O’Connell seconded, and the motion carried 4-0 as amended.

Mail

The Planning Board received minutes from the Herring River Restoration Committee and notice of several Zoning Board applications.

Josem Way & Howard Court Discussion:  These items were continued to the next meeting.

Disposition of Town-owned Property

Map 35-1, Parcel 210 (Pleasant Point abutters’ request)

The Board discussed this request.  Denny O’Connell moved to approve with the following conditions:  Recommend that there be a Conservation Restriction rather than a Deed Restriction.  Agree with Natural Resource Advisory Board comments.  All costs including but not limited to survey, title work, legal costs to be paid by the buyer.  Sell only the land needed to do the work as approved by the Conservation Commission.  The Town should retain the ownership rights to the beach fronting the bulkhead.  Seconded by Reinhart and approved 4-0-0.

Map 14, Parcel 4 (Brehmer Request)

The Board discussed this request.  An email from the Town Administrator to Jan Morrissey was read to the Board which recommended that the Town not dispose of the property.  Janet Reinhart moved not to recommend.  Seconded by Larsen and voted 4-0-0.

Subdivision Regulation Revision Discussion

The Board discussed proposed changes to the “Rules and Regulations Governing the Subdivision of Land.” Specifically the Board discussed changes to 4.04b and discussed modeling the paragraph that describes dead-end streets after the Nantucket regulation.  It was decided to use the following language when describing the requirements of a dead-end: The dead-end shall have an exterior layout of the roadway with a  radius of at least sixty (60’) feet; an exterior radius of the paved surface of at least fifty (50’) feet; and at center island with a radius of at least thirty (30’) feet.  Mr. O’Connell is reworking the section of the regulation that discusses and defines drainage systems and will report back to the Board at a future meeting.  O’Connell’s proposed Section 5.08 Roadway Pavement was discussed and it was decided not to include the proposed changes as this material is covered in Section 4.05c.  It was discussed that the narrative describing pavement should read as follows: 1). 2 ½ inch bituminous concrete, Type I-1 Hot mix asphalt binder course.  2). 1 ½ bituminous concrete “State top” or approved equivalent.  Section 6.04, Inspections will have the narrative changed so that an inspection is required before backfilling shall proceed.

Signs Bylaw Revision

The Board had a general discussion of signs on Route 6 with multiple businesses listed, including home occupation businesses and those with access off the highway.  Members re-examined draft sign bylaw revisions and made changes to prepare it for Annual Town Meeting.  O’Connell moved to send the amended sign bylaw with the changes to Town Counsel for review.  Seconded by Larsen.  Voted 4-0-0. 

FEMA Floodplain Bylaw Revision

The Board discussed the code referenced in the FEMA Floodplain Bylaw.  O’Connell moved to send to Town Counsel for review.  Seconded by Larsen.  Voted 4-0-0.

Home Occupation and Service Trades

Morrissey reported that she revised the Service Trade and Home Occupation bylaws as per Board discussion at the January 7 meeting, and that Brian Carlson had forwarded them to Town Counsel for review. O’Connell suggested a few additional revisions; members will consider his suggestions after Town Counsel’s comments are received.

Dwelling & Individual Storage Units Definitions

Brian Carlson has forwarded the amended Dwelling and Individual Storage Units definitions to Town Counsel for review.

Repeal of Home Industry Bylaw

Morrissey reported that she drafted the article to repeal the Home Industry bylaw as per Board discussion at the January 7 meeting, and that Brian Carlson had forwarded it to Town Counsel for review. O’Connell voiced some concerns regarding the repeal of the Home Industry bylaw and suggested that the Board consider amending it instead. Morrissey will resubmit a draft amendment to the bylaw from a previous meeting for discussion at the next meeting.

2015 Meeting Schedule

The Board discussed the proposed meeting schedule for 2015.  The date of May 20th was added to the schedule.

Future Concerns

Have a meeting with the Historical Commission regarding a proposed Demo Delay Bylaw.
