Minutes of Meeting on Wednesday, May 7, 2014

Wellfleet Senior Center, 7:00 p.m.

 

Present: Gerald Parent, Chair; Andrew Freeman, Janet Morrissey, Alfred Pickard, Janet Reinhart; Planner Patrice Carson

Chair Gerald Parent called the meeting to order at 7:02 p.m.

Minutes

Reinhart moved to approve the amended minutes of April 2, 2014.  Morrissey seconded, and the motion carried 5-0. 

Mail

Jan Morrissey distributed the Mail Log of May 7, 2014. 1 

 

Review of Annual Town Meeting

Chair Gerald Parent read an e-mail message from Donna McAffery regarding removal of the C2 Medical Marijuana Overlay District.  At Annual Town Meeting, Parent had agreed to revisit the bylaw.  He will respond to Ms. McAffery’s correspondence with an invitation to attend an agreed-upon Planning Board meeting.  The rest of the Warrant Articles had passed with no questions or discussion on Town Meeting floor.

 

Home Occupation & Service Trades

Jan Morrissey protested that protocol had not been followed with items included in the packet.  She said that the Occupation & Service Trades Zoning Bylaws draft in the packet had her name on it, but it contained revisions that were not hers. She further objected that several other draft versions had been produced for the meeting but had not been provided in the meeting packet.  The Board agreed to recognize only the one draft version of the Home Occupation & Service Trades Zoning Bylaws that Patrice Carson had prepared which was included in the packet2 even though it had Jan Morrissey’s name on the footer.  The Board used this draft for revision purposes.  Board members considered the list of exclusions with an eye towards the Board of Health’s requirements that might influence the home occupation activities. 

 

Section 6.22.1 Allowed occupations and business activities and the list of exclusions were scrutinized. Jan Morrissey moved to remove detailing motor vehicles from the list of exclusions.   Janet Reinhart seconded, and the motion carried 5-0.

 

A poll of the Planning Board showed that the majority of the members agreed that motor vehicle repairs should not be excluded. 

 

The review of the bylaw continued with 6.22.2 Requirements and Standards.  When polled on 6.22.2, section 2, Planning Board favored keeping the bylaw limitation of no more than one (1) person outside the family.

 

The time of business hours in 6.22.2, section 8 was set as 8:00 a.m. to 8:00 p.m.  Planning Board members discussed limits for days of the week in operation and decided to keep it as 7 days a week from Memorial Day to Labor Day. 

 

The Board addressed traffic and parking issues in 6.22.2, section 9. 

 

Planning Board began to discuss changes to 9.23 Service Trades.   This will be continued at the next meeting. 

 

Cluster Developments

The Board will work on Smart Growth/Cluster Development at another meeting.  There is material from other towns available.   Planning Board was interested in discussing the state level zoning act changes currently being developed. 

 

Agenda for Next Meeting

Agenda for the May 21, 2014 meeting will include:  Cell Phone Special Permit Application; Home Occupation and Service Trades Bylaws; Medical Marijuana Dispensary Overlay District; and Storage Pods.

 

Adjournment

Jan Morrissey moved to adjourn.  Freeman seconded.  The motion carried 5-0.  The meeting was adjourned at 9:55 p.m.
