Chair Parent called the meeting to order at 7:05 P.M.

Announcements, Open Session & Public Comment:

Dennis O’Connell announced he will not return as a Planning Board Member when his term is up.

Chair announced that there will be no proposed discussion and this is strictly a discussion for an article that will go to Town Meeting.

Meeting Minutes-

Moved to approve the minutes of December 20, 2018, as amended, by O’Connell. Seconded by Cooney. The motion carried, 5-0.

Moved to approve the minutes of January 3, 2018, as amended, by O’Connell. Seconded by Freeman. The motion carried, 4-0-1.

Discussion of Affordable Flexible Residential Design- The Board reviewed the Affordable Flexible Residential Design draft revised by Town Counsel on 2/6/2018. Some of the changes discussed were definitions, common open space, and setbacks. The Board will continue this agenda item as a discussion and move it to the March 7th  meeting.

Moved to hold public hearing by Parent. Seconded by O’Connell.

The motion carried, 5-0.

A public hearing is tentatively scheduled for March 21st.

Discussion-Special Permit/Site Plan Review for Impactful Commercial Uses Zoning Bylaw-O’Connell requested a review of the Special Permit/Site Plan Draft from Town Counsel. Some of the sections reviewed were applicability, administration, and design. The Chair would like the Board members to review the Outside Displays/Outside Use, and think about what direction they would like to continue.

The Chair requested information on how many copies does the Zoning Board of Appeals require for a filing. The Board will continue the discussion at the March 7th meeting, and tentatively hold a public hearing on March 21st.

Discussion-Medical Marijuana-Retail Sales of Marijuana, Growing, Testing, and Cafes (of Marijuana) in the Overlay District:

Chair Parent explained that the Board has defined cultivation, production, retail and testing, and the definitions will be inserted into the overlay district.

The Board members reviewed Town Counsel’s suggestion which amends the title of the bylaw and overlay district from 9.3 Medical Marijuana Overlay District to 9.3 Marijuana Overlay District. The Board members discussed retail sales and the definition of medical marijuana and marijuana allowed in which district.

Abutters to Wixom Road stated that the proposed facility is located on a residential road, and they do not want this traffic-flow. Freeman responded that it would be a matter if the business was applying for a special permit, and would ultimately be the Zoning Board of Appeals decision. The Chair explained that access to a commercial district can come through a residential area, and it will be addressed with Town Counsel. The Board discussed restricting the access to commercial property through Route 6.

The Board members will send their proposed changes to Town Counsel, and tentatively hold a  public hearing on March 21st.

Discussion-White Crest Beach Parking Lot

Chair Parent explained that the expansion of the White Crest Beach Parking lot will be an agenda item until the Planning Board receives a plan, but this is not something to discuss until it has been received. The Board will let the public know when the plan has been received and the proposal will be discussed at length.

Discussion-Home Occupation-Shellfish Screening

The Board reviewed proposed amendments in the Zoning Bylaws Home Occupation: Section 6.22.2. O’Connell read a proposed citizen petitioned article from the correspondence folder. The Board members discussed what is meant by “reasonable” screened… and to move the discussion of the Planning Board’s proposed amendment to the March 7th meeting. The petitioned article will be included in the Board packets of the 7th and the document will be sent to Town Counsel for review.

Moved to approve by O’Connell. Seconded by Pickard. The motion carried, 5-0.

Discussion-Pleasant Point Bulkhead, Disposition of Land

The Board reviewed the map of the Pleasant Point Bulkhead. Carlson read an email dated 2/15/2018, which listed the Planning Board requirements. The requests included: lot lines extended to the bulkhead, a 20-foot easement seaward of the property, two center bounds in each lot line, seawall markers installed for the property line where it intersects with the seawall. The Planning Board will reschedule this agenda item when they hear from the engineer.
