Minutes of Meeting on Wednesday, February 17, 2016

Council on Aging, 7:00 PM

Members Present: Janet V. Morrissey, R. Dennis O’Connell, Alfred Pickard, Janet Reinhart

Members Absent:   Gerald E. Parent, Chair, Andrew Freeman,

Others Present: ATA Brian Carlson, Chet Lay of Slade Associates

Vice-Chair Morrissey opened the meeting at 7:00 PM.

27 Whereaway Lane ANR #16-01

Reinhart made the motion to override the Planning Board policy and allow discussion on the material that arrived after the deadline for receiving packet information had passed; O’Connell seconded; the motion passed 4-0.

Chet Lay began by addressing the concerns expressed in a letter sent to the Planning Board by abutters Peter and Gail Stewart, dated 2/14/16.  He noted that the Stewarts did not object to the plan.  He also addressed the concerns of the Planning Board, specifically the question of legal rights to the access road and Home Owner’s Association membership.

Pickard moved to endorse ANR #16-01; Reinhart seconded; the motion passed 4-0.

Nextel Restoration Bond Update

The Board examined the collection of documents relating to the site restoration bond for the Nextel Telecommunications Tower on Gross Hill Rd.  The Board discussed the progression of past actions and concluded that there is one bond in existence for $25,000 for the removal of the telecommunications tower.

The Board questioned whether other co-carriers have restoration or removal bonds, and if so, at what value.  Com Electric will be sending a revised bond.

Subdivision Regulations Revisions

The Board discussed the most recent proposed revisions, including adjustments made to forms located in the appendix of the Subdivision Rules and Regulations.

The Board discussed options for alerting surveyors and engineers to the newest iteration of the Rules and Regulations, after the public hearing on March 16, 2016, and after the revisions have been finalized.  The Board concluded that the proposed Subdivision Regulations review should be announced at a Board of Selectmen meeting to get it on record.

Affordable Housing, Work Force Housing, and Cluster Housing Bylaw

The Board discussed options for improved planning for community housing and cluster development.  It was agreed that the Board would wait to discuss specifics until a draft of a revised Cluster Housing Bylaw from the Cape Cod Commission was made available, and until the Board had a full complement of members (mid-March.)

Local Comprehensive Plan (LCP)

O’Connell nominated Morrissey to be the Planning Board liaison to the LCP Committee; Pickard seconded; the motion passed 4-0.

DLTA Grant Status

There was nothing new to report.

Old King’s Hwy Community Housing Project

The ZBA hearing has been continued.

ATM Warrant Article Recommendations

No articles have been submitted to the Planning Board to date.

Monthly Building Inspector Reports

The Board discussed the contents of the packet of Building Department Monthly Reports for the last six months.  The Board is looking for feedback or input on how it can improve the Zoning Bylaws.  Reinhart will follow up with Building Inspector Richard Stevens, and Morrissey agreed to contact Town Administrator Terkanian to follow up on the earlier complaint logs produced in 2013.

O’Connell moved to accept the February 3, 2016, Planning Board minutes as amended; Pickard seconded; the motion passed 4-0.
