Minutes of Meeting on Wednesday, January 6, 2016

Council on Aging, 7:00 PM

Members Present: Gerald E. Parent, Chair, Janet V. Morrissey, R. Dennis O’Connell, Janet Reinhart

Members Absent:  Andrew Freeman, Alfred Pickard

Others Present: ATA Brian Carlson, Peter Stewart

Chair Parent opened the meeting at 7:01 PM.

Subdivision Regulations Revisions

O’Connell shared some updates including research he had done on cul-de-sacs, but the bulk of his work is in progress and will be presented at the next meeting.  He intends to do site visits with members of the fire department and the DPW to help determine appropriate dimensions.

Zoning Proposals

Morrissey made the motion for the Planning Board to have a public hearing on February 3, 2016, to consider revisions to the Zoning Bylaw definitions of Lot Area; the revisions to Zoning Bylaws Sections 6.14.2, and 7.3.1-7.3.2; Reinhart seconded; the motion passed 4-0.

Cumberland Farms Decision Appeal Update

ATA Carlson informed the Board that TA Terkanian had spoken with Town Counsel who said that the decision on the bylaw is not being appealed but the decision on the zoning permit is.  Morrissey expressed an interest in asking Town Counsel if there is any chance of salvaging the bylaw.

Whereaway Lane Follow Up Discussion

It appears that improvements have been made to the road and the catch basins, but no Board member has had the opportunity to observe drainage in action during a rain.  Abutter Stewart indicated that Whereaway Lane drainage has improved.

Old King’s Hwy Community Housing Project

Chair Parent suggested to the Board that the signed Findings of Fact with a cover letter be submitted to the ZBA who has requested Planning Board input on the Habitat for Humanity Old King’s Hwy Community Housing Project 40B application.

O’Connell made the motion for the Planning Board to submit a cover letter along with the Findings of Fact for the Habitat for Humanity Old King’s Hwy Community Housing Special Permit; Morrissey seconded; the motion carried 4-0.

ATA Carlson updated the Board on the fact that Town Counsel will enter a Notice of Appearance in the civil law suit regarding the granting of the Special Permit to Habitat for Humanity.

Morrissey moved to accept the December 16, 2015, Planning Board minutes as amended; O’Connell seconded; the motion passed 4-0.
