Minutes of Meeting on Wednesday, June 4, 2014

Wellfleet Senior Center, 7:00 p.m.

Chair Gerald Parent called the meeting to order at 7:04 p.m.

 

Minutes

O’Connell moved to approve the amended minutes of May 21, 2014.  Reinhart seconded, and the motion carried 4-0.

Home Occupation & Service Trade Business Bylaws

Chair Gerald Parent said that he had approached Town Administrator Harry Terkanian about the status of aquaculture in terms of Home Occupation and Service Trades Business bylaws.  Mr. Terkanian said that he wanted to review the bylaw revision before offering guidance or referring the draft of the bylaw to Town Counsel for her comments.  Andrew Freeman had also spoken to Mr. Terkanian, and he reported on their conversation about the bylaw revision. 

 

The Board reviewed the May 21, 2014 draft of the Home Occupation & Service Trades Business Bylaws2 and made adjustments to it.  Dennis O’Connell said that a Purpose Statement should be added to the bylaw.  Patrice Carson read a purpose statement from the Danvers bylaws on Home Occupation. 

 

O’Connell moved to add a Purpose Statement to the Wellfleet Home Occupation & Service Trades Bylaws based on the Danvers model.  Reinhart seconded, and the motion carried 6-0. 

 

Board members discussed the Selectmen’s Business Registration/License Policy. 3   The Board will continue to consider enforcement issues for registration of Home Occupation Businesses and Service Trades. 

 

The Board discussed application of the bylaw to shellfishing/ aquaculture.  One possible avenue is to exempt aquaculture from the Home Occupations and Service Trades bylaws.  Exemptions for shellfishing could apply to the number of employees outside of the family, keeping the activity solely indoors and time limits because of the tides.  Board members kept these possibilities in mind as they reexamined the bylaws in terms of their broad-range. 

 

The Board agreed that the number of non-family members working in a Home Occupation be raised from one to two. 

 

The Board made corrections to the Definition section of the Service Trade Business bylaw and added a paragraph of Purpose that matches the one for Home Occupations. The allowance for the number of non-family members was raised to “up to three.”   Items in 6.23 Service Trades were matched in language and made parallel with 6.22 Home Occupation items.   There was discussion of vehicle size allowed for Service Trade.   The start time for both Service Trades and Home Occupations was changed to 7 a.m. 

 

Agenda for Next Meeting

Agenda for the June 18, 2014 meeting will include: Home Occupation and Service Trades Bylaws, Storage Pods, Cluster Development/Smart Growth and Future Concerns.
