Minutes of Meeting on Wednesday, March 4, 2015

Wellfleet Senior Center, 7:00 p.m.

 

Present: Gerald Parent, Chair; Andrew Freeman, Janet Morrissey, Alfred Pickard; Assistant Town Administrator/Planner Brian Carlson

Chair Gerald Parent opened the public hearing at 7:02 p.m.  He verified the advertising and advance notices for the zoning bylaw hearings. 

The Planning Board had prepared and advertised seven zoning bylaw amendments, Articles 39 to 45, for the Annual Town Meeting Warrant.

Janine Shaw read her letter of concern regarding changes to the Home Occupation and Service Trades Business bylaws.  She also discussed with Planning Board their motivation for making the changes. Dawn Rickman suggested that wording in 6.23.2 – I be revised to read “through Labor Day” if it is meant to be inclusive.  Another member of the audience commented on numbers of vehicles allowed and asked about enforcement.  She also asked about associations’ control over neighborhoods and possible home occupation businesses that could exist.  Mary Fox inquired about permitting of Home Occupation and Service Trade businesses. 

Jan Morrissey suggested a change to the Service Trade Home Business definition in Article 40.  This was discussed but the Board declined to make a change.

Warrant Recommendations*

Article 39 Home Occupation

Pickard moved to close the public hearing for Article 39.   Morrissey seconded, and the motion carried 4-0.

Pickard moved to recommend Article 39 to amend Home Occupation bylaw with changes.  Freeman seconded, and the motion carried 4-0.

Article 40 Service Trade

Pickard moved to close the public hearing for Article 40. Morrissey seconded, and the motion carried 4-0.

Picard moved to recommend Article 40 to amend the Service Trade bylaw.

Freeman seconded, and the motion carried 4-0.

Article 41 Home Industry

Morrissey moved to close the public hearing for Article 41. Freeman seconded and the motion carried 4-0. 

Morrissey moved to recommend Article 41 to repeal the Home Industry bylaw.

Pickard seconded, and the motion carried 4-0.

Article 42 Individual Storage Units

Morrissey moved to close the public hearing for Article 42. Freeman seconded and the motion carried 4-0.  

There were some revisions to the wording of the definition for “Individual Storage Unit.”  Freeman moved to amend the wording of the definition by deleting rental spaces and adding Individual Storage Unit.  Parent seconded, and the motion carried 3-1. 

Picked recommend Article 42 to amend the Section II definition of Individual Storage Units.  Morrissey seconded, and the motion carried 4-0.

Article 43 Floodplain

Morrissey moved to close the public hearing for Article 43. Pickard seconded and the motion carried 4-0. 

Freeman moved to recommend Article 43 to amend 6.14.3.5 Special Flood Hazard District Regulations. Morrissey seconded, and the motion carried 4-0.

Article 44 Signs

Dawn Rickman was present to discuss Signs 7.5.3.  She noted that the current bylaw requires 5 feet setbacks already in 7.5.1.

Pickard moved to close the public hearing for Article 44. Freeman seconded and the motion carried 4-0. 

The Board discussed sign allowances in the different zoning districts. 

Pickard moved to recommend Article 44 to amend the Section II and Section VII Definitions of Signs.  Morrissey seconded, and the motion carried 4-0.

Article 45 Signs Sections VII

Janet Morrissey said that Article 45 is needed  in case the previous sign Article fails but the Service Trade Article passes. 

Pickard moved to close the public hearing for Article 43. Morrissey seconded and the motion carried 4-0. 

Freeman moved to recommend Article 44 to amend the Section II and Section VII Definitions of Signs.  Morrissey seconded, and the motion carried 4-0.

Discussion with Historical Commission

Maria Burks and Lydia Vivante of the Historical Commission came to the meeting to discuss some informational sessions they are planning for the public about the demolition delay General Bylaw.  They asked if the Planning Board would like to co-sponsor workshops for property owners, realtors and builders.  Planning Board members reviewed the history of the creation of the General Bylaw for demolition delay.  Maria Burks said they would like to increase awareness of National Register designations.  Brian Carlson and the Board suggested developing a pamphlet or survey on demolition delay. 

More Warrant Recommendations

Three other Warrant Articles needed Planning Board recommendations.

Article 46 Paine Hollow Road Property Transfer

The Board discussed their  message to the Board of Selectmen in a November 6, 2014 memo which contained a further strong recommendation to change the access to the Housing Authority land from Paine Hollow Rd. to Lewis Paine Rd. through an eminent domain taking.

Morrissey moved to recommend Article 46 to transfer the ownership of Paine Hollow Rd. property (Map 29, Parcel 498) to the Housing Authority.

Freeman seconded, and the motion carried 4-0.

Article 48 Pleasant Point Property Transfer

Pickard moved to not recommend Article 48 to transfer the ownership of Town property at Pleasant Point (Map 35-1, Parcel 210) to the abutting owners.  Parent seconded.  Among other items, there is no dollar amount attached to this transfer.  The Board discussed dune erosion at the location, beach nourishment and access.   

The motion to not recommend carried 4-0.

Article 25  Rte. 6- Main St. Intersection

Gerald Parent explained the request to borrow or transfer funds for design purposes.

Morrissey moved to recommend Article 25 for preparatory work on improving the intersection of Route 6 and Main St.  Pickard seconded, and the motion to recommend carried 4-0.

Mail

The Truro notification of their public hearing for condo conversion bylaws was included in the mail.   There was also an e-mail from Bruce Drucker of the Wellfleet Zoning Board of Appeals suggesting that the Planning Board consider this change for Wellfleet Zoning Bylaws.  This is a topic that Planning Board is interested in pursuing.  This will be an agenda item for future meeting.

Jan Morrissey enumerated more items in the mail, in particular the ZBA minutes that dealt with the sign at the Marina. 

Planning Board Fees

Town Administrator Harry Terkanian had requested a review of the Planning Board’s fee schedule.  Brian Carlson will gather information on other towns. 

Minutes

Morrissey moved to recommend the amended minutes of February 4, 2015.  Pickard seconded, and the motion carried 4-0.

Future Concerns

Jan Morrissey reminded the Board that the Subdivision Regulations need revision.  The “Landing Strip” (Map 42, Parcel 601) is another issue of concern.  There is still money reserved for developing a plan for this Town-owned property

Agenda for Next Meeting

Agenda for the March 18, 2015 includes:  ANR for 135 and 0 Pine Point Rd; Discussion of Howard Court; Habitat for Humanity’s Affordable Housing Special Permit hearing (cont.); Minutes and Mail.

Parent moved to adjourn. Freeman seconded, and the motion carried 4-0.
