Wellfleet Planning Board
Minutes of Meeting on Wednesday, January 7, 2015
Wellfleet Senior Center, 7:00 p.m.

Chair Gerald Parent called the meeting to order at 7:00 p.m.
Minutes
Janet Reinhart moved to approve the amended minutes of December 17, 2014. Morrissey seconded, and the motion carried 4-0.
Of interest in the mail were the Zoning Board of Appeals’ public hearing on January 15, 2015 and two Cape Cod Commission memos on planning.
Josem Way Road Inspections
Chester Lay of Slade Associates came forward, representing Donald Horton on the construction of Josem Way. Mr. Horton had been notified to cease work on the road until inspections had been done. Mr. Lay asked who would be inspecting the road on behalf of the Planning Board, and he asked what the time frame would be for the inspections. Planning Board members worked out the notifications, time for inspections and submission of As-builts with Mr. Lay. The procedure will be overseen by Brian Carlson. Certification of electric utilities will be done by the electrician.
The road is partially paved, and the catch basins are in place. There have been no inspections or As-builts submitted to date. The cul-de-sac has not yet been paved, but it has been grubbed and filled. The applicant will redo the cul-de-sac and dig out fill under the road. The applicant will restore the original elevations and re-compact the road before the rest of the paving is done.
The Board discussed revision of the Subdivision Regulations for the section on road inspection procedure.
Howard Court Discussion
Mr. Lay said he considers Howard Court, the road for the Hahn subdivision DSD #13-05 completed. The road has been redone and ready for inspection, he said. The Planning Board requested one more certification on the adequacy of catch basins on the older portion of the road where it connects to the new subdivision.
Liston Subdivision
Chester Lay of Slade Associates submitted the Liston Definitive Subdivision DSD#14-03 for Planning Board signatures now that the appeals period is over. Planning Board noted the corrections in road names that had been made and signed the plan.
Town Counsel Opinion
Attorney Elizabeth Lane of Kopelman & Paige had submitted her opinion on the Home Industry and Home Occupation Bylaw revisions.1 Planning Board reviewed her comments on Home Occupation, discussing: zoning bylaw terms, use of the term “Commercial,” the definition of Home Occupation, use of word “dwelling,” redundancies, specifications for “family,” needed renumbering, noise provisions, and making matching changes to Service Trades. Jan Morrissey said she would incorporate Town Counsel’s amendments into the Planning Board’s draft version. This will go back to Elizabeth Lane through Brian Carlson. The new draft will also be submitted to the Building Inspector and Appeals Board for their comments.
Signs Bylaw Revision
The Board had a general discussion of signs on Route 6 with multiple businesses listed, including home occupation businesses and those with access off the highway. Members examined the October 1, 2014 draft sign bylaw revisions 2 making changes to prepare it for Annual Town Meeting.
Definition of Dwelling
O’Connell moved to send the Definition of Dwelling bylaw revision to Town Counsel for her opinion. Janet Reinhart seconded, and the motion carried 4-0.
Morrissey moved to schedule hearings for Warrant Article for first meeting in March. O’Connell seconded, and the motion carried 4-0.
FEMA Floodplain Bylaw Revision
The Board discussed the code referenced in the FEMA Floodplain Bylaw. Brian Carlson will find the correct code that should be cited in the bylaw and prepare a new version to be approved at Annual Town Meeting.
Agenda for Next Meeting
Agenda for the January 21, 2015 meeting will include: Demolition Delay Bylaw discussion with Historical Commission representatives; Disposition of two Town-owned properties; sign bylaw revision; Subdivision Regulations; Josem Way; Howard’s Court discussion; FEMA Floodplain Bylaw revision; Minutes and Mail.
Adjournment
Reinhart moved to adjourn. O’Connell seconded, and the motion carried 4-0.
The meeting was adjourned at 10:15 p.m.
