Meeting Minutes

Attendees: Chair Roger Putnam, Vern Jacob, Sharon Inger, Manny Heyliger, Don Palladino, Mick Lynch and Trevor Pontbriand

Chair Roger Putnam called the meeting to order at 7:00 pm.

  1. Brian and Cindy Batchelder, 370 Wilson Ave., Map 30, Parcel 615:  Application for a Special Permit under WZB 6.1.5.1b  and 6.1.1 for dormer addition to a pre-existing, non-conforming, single family structure.  The Board consisted of Roger Putnam, Sharon Inger, Manny Heyliger, Mick Lynch and Trevor Pontbriand.  Jay Horowitz represented the applicant, and he read a letter from the owners giving the reasons why they are asking for a Special Permit.  The reason for the dormer is for a safety issue because the current stairs are very steep and are not compliant with the current building codes.  Approval from the condo association was received.  There will be no additional bedrooms or intensity of use of the dwelling.  The project will be an additional 45 square foot (206 cu. Ft)  increase.  Mick Lynch moved for the Findings of Fact; seconded by Sharon Inger, passed 5-0:
  1. This is an application for a Special Permit for a dormer addition under WZB 6.1.5.1b and 6.1.1 to a legally pre-existing non-conforming single family structure.
  2. The structure is located in the Cape Cod National Seashore District.
  3. The proposed structure conforms to CCNS guidelines
  4. The structure is located within a cottage colony.
  5. There will be a volumetric increase of 206 cubic feet.
  6. The addition will be constructed entirely on the existing footpring.
  7. There will be no change in use.
  8. There will be no increase in use.
  9. There are no objections from abutters.
  10. There will be no impact on public or private views.
  11. The proposal is not a significant development.
  12. There was no comment from the National Seashore for this property.
  13. The proposed alteration to the existing structure will not be more detrimental to the neighborhood than the present non-conforming structure.

Roger Putnam moved the Findings of Fact; seconded by Manny Heyliger; passed 5-0.  Roger Putnam moved to grant the Special Permit based on the Findings of Fact; seconded by Manny Heyliger; passed 5-0.

Meeting Minutes

Trevor Ponotbriand moved to approve the amended 7/16/15 meeting minutes; seconded by Vern Jacob; passed 7-0.

Business

It was agreed by the Board that Attorney Ben Zehnder would have to come to the August 20, 2015 meeting to request his continuation for Case 15-20 (Bromberg).

Mick Lynch moved to adjourn at 7:20 pm; seconded by Trevor Pontbriand; passed 6-0.
