18-14 Paul Madel, 96 Samoset Ave., Map 28, Parcel 129: Application for a Special Permit under WZB 6.1.5 and 8.4.2 to demolish existing structure which is located on and extends over common property line of parcel 88 and replace with a new, more conforming single family residential dwelling. (Cont’d) The Board consisted of Roger Putnam, Sharon Inger, Manny Heyliger, Wil Sullivan and Reatha Ciotti, who replaced Trevor Pontbriand. Ms. Ciotti attended the August 2, 2018 hearing. Attorney Ben Zehnder represented the applicant and a new site plan and architectural plan was provided. Mr. Madel gave an overview of the design of the dwelling, stating the roofline has been lowered and will have shed-roof awnings. There will no longer be an intrusion into the adjourning lot. Manny Heyliger moved for Findings of Fact; seconded by Wil Sullivan; passed 5-0.
- This is an application for a Special Permit under WZB 6.1.5 and 8.4.2 to demolish an existing structure which is located on and extends over the common property line of parcel 88 and replace it with a more conforming single-family dwelling.
- The lot is located in the R1 district.
- The lot is pre-existing, nonconforming, having been subdivided in 1922.
- The structure is lawfully pre-existing, non-conforming, having been built in 1954 according to the Assessor’ records.
- Building coverage will increase from 944 square feet, or 8.3%, to 1,708 square feet, or 15%.
- The side yard setback will decrease from 8.4 feet to 6.4 feet.
- The rear setback will increase from intrusive to 10 feet.
- Front yard setback will remain conforming.
- There will be no change in use.
- There will be no increase in use.
- The use conforms to the objectives of the R1 district.
- There are no objections from abutters.
- The replacement structure will not be substantially more detrimental to the neighborhood, and the existing non-conforming structure.
- This is not a significant development.
Manny Heyliger moved the Findings of Fact; seconded by Reatha Ciotti; passed 5-0. Manny Heyliger moved to grant the Special Permit based on the Findings of Fact; seconded by Wil Sullivan; passed 4-1.
