18-01  Ronald and Julia Lavoie, 402 Wilson Ave, Map 30, Parcel 627, Application for a Special Permit under WZB 6.1.5 and 6.24 to construct a second story on the same footprint:00 pm to be held at the Wellfleet COA (to be Cont’d to 03/15/18).00  At the request of the applicant, Mick Lynch moved to continue to 03/15/18; seconded by Manny Heyliger; passed 7-0.

18-03  Theodore Dieffenbacher and Leslie Rowe,   105 Rockwell Ave., Map 24, Parcel 160, Application for a Special Permit under M.G.L.c.40A,s.6 and WZB 6.1 and National Seashore Park District Special Permit approval pursuant to Bylaw 6.24 to alter a pre-existing, non-conforming single family residential dwelling structure.  The Board consisted of Roger Putnam, Sharon Inger, Manny Heyliger, Mick Lynch and Trevor Pontbriand.  Attorney Ben Zehnder and architect, Peter Coneen represented the applicant.  The existing dwelling will increase from 14.1% to 14.5% lot coverage with the current structure being removed and a two-story dwelling replacing it.  The height of the dwelling will be 25.9 feet.  The Board did not have any issues with the plans provided.  Mick Lynch moved for Findings of Fact; seconded by Manny Heyliger; passed 5-0.

  1. This is a request for a Special Permit under MGL.c40A s.6 and WZB 6.1 and National Seashore Park Special Permit pursuant to WZB 6.24 to alter an existing single family residential dwelling structure.
  2. The property comprises of 5,625 square feet in the National Seashore Park, where zoning requires 3 acres.
  3. The property is non-conforming as to lot size, frontage and set-backs.
  4. The existing dwelling was built in 1950.
  5. The applicant proposes to demolish and replace the dwelling in approximately the same location, and squaring off the footprint and adding a second floor.
  6.  The lot coverage will increase from 14.1% to 14.5%.
  7. Setback encroachments will be diminished on the north and west sides.
  8. Setback on the south side will be increased by the overhang of the cantilevered bay window on the second floor.
  9. The proposal is consistent with and meets the National Seashore Park District Special Permit standards as set forth in QZB 6.24.3.
  10. A letter from abutters, David and Anne Lee, supported the proposal.
  11. The result of granting this request for a Special Permit will not create a situation substantially more detrimental to the neighborhood than the present existing dwelling.
  12. This is not a significant development.

Trevor Pontbriand moved to accept the Findings of Fact; seconded by Mick Lynch; passed 5-0.

Mick Lynch moved to grant the Special Permit based on the Findings of Fact; seconded by Manny Heyliger; passed 5-0.
