Meeting Minutes

                                           Attendees:  Roger Putnam, Bruce Drucker, Sharon Inger, Manny Heyliger, Trevor Pontbriand, and Reatha Ciotti

16-35  Griffith, 14 5th St., Map 40, Parcel 69:  Application for a Special Permit under WZB 6.1.5.4 for a volumetric increase to the dwelling.  The Board consisted of Roger Putnam, Bruce Drucker, Manny Heyliger, Reatha Ciotti, and Trevor Pontbriand.  Steve Cook represented the applicant and gave an overview of the project.  The dwelling is pre-existing, non-conforming.  He described the construction of the proposed dormers along with a 2nd floor deck.  There will no change in the footprint.  Trevor Pontbriand stated he did not make a site visit.  Bruce Drucker moved for Findings of Fact; seconded by Manny; passed 5-0.

  1. Applicants seek a special permit under WZB 6.1.5.4 for a volumetric increase to the dwelling, specifically, the installation of two shed dormers on the front & back of the structure.
  2. The dwelling is entitled to treatment as a lawfully pre-existing nonconforming structure having been in existence for least 10 years as provided for in Wellfleet Zoning Bylaw 8.2.2
  3. The existing non-conformities include inadequate lot area and intrusion into the setbacks.
  4. There will be only a volumetric increase on the front & rear setbacks and the shed dormers will be constructed entirely on the current footprint.
  5. There will be no change in use.
  6. There will be no increase in lot coverage.
  7. The use conforms with the objectives of the R1 District in which the lot is located.
  8. There were no appearances or correspondence either for or against the project.
  9. The proposed alteration will not be more substantially detrimental to the neighborhood than the existing nonconforming structure and the applicants have demonstrated that the benefits of the proposal will outweigh any adverse effects on the Town and the vicinity after considering the District Objectives for the district as provided for in WZBL 3.2 and the relevant criteria set forth in WZBL 8.4.2.

Trevor Pontbriand moved to accept the Findings of Fact; seconded by Manny Heyliger; passed 5-0.  Bruce Drucker moved to grant the Special Permit based on the Findings of Fact; seconded by Manny Heyliger; passed 5-0.

16-13  Amendment:  James and Susan K. Collins, 3 West Main Street, Map 14, Parcel 146, Application to amend previously approved Special Permit under WZB 8.2 and MGL Chapter 40, Section 6 to restore and alter existing non-conforming building within the Central District by eliminating the previously approved second story and rebuild as a single story building with no change in use. (Cont’d).   The Board consisted of Roger Putnam, Sharon Inger, Manny Heyliger, Reatha Ciotti and Trevor Pontbriand.  At the request of the applicant, Sharon Inger moved to allow the petition to be withdrawn without prejudice; seconded by Reatha Ciotti; passed 5-0.

 

Business

Bruce Drucker reported the Appeals Court came down with the decision for Cumberland Farms affirming the Land Court.  The Board of Selectmen have until Dec 21 to make a decision whether to appeal.  The Board of Selectmen will meet in executive session on Dec. 19 to decide whether to appeal.

Nov. 17, 2016 – Roger Putnam moved to approve the November 17, 2016 meeting minutes as amended; seconded by Sharon Inger; passed 3-0 by acclimation.

Bruce Drucker moved to adjourn at 7:30 pm; seconded by Sharon Inger; passed 6-0.
