Attendees:  Roger Putnam, Manny Heyliger, Sharon Inger, Mick Lynch and Trevor Pontbriand

  1. James and Susan K. Collins, 3 West Main St., Map 14, Parcel 148: for a Special permit under WZB 8.2 to restore and alter existing non-conforming building in the Central District:  rebuild and existing single story retail store with a two story building with retail space and a single residential apartment on second floor, relief from setback requirements, building coverage and minimum lot requirements and parking requirements.  The Board consisted of Roger Putnam, Manny Heyliger, Sharon Inger, Mick Lynch and Trevor Pontbriand.  George Reilly represented the applicant and gave an overview of the project.  He stated all the setbacks would remain the same, with a volumetric increase with the second floor.  The parking area has been realigned to add more parking spaces and a turn around area in the back.  A portion of the property is within the residential area and he stated they are planning on constructing a fence to block the view of the parking lot.  He stated there is a planting plan in place and the walkway on Holbrook Avenue will allow for handicap access.  The property owner will have to go before the Board of Health for the septic upgrade.  There will be a full basement.  Mick Lynch moved for Findings of Fact; seconded by Sharon Inger; passed 5-0.
  1. This is a request to restore and alter a pre-existing structure under WZ B 8.2.
  2. This is a prior existing nonconforming structure.   
  3. This is a replacement of a building
  4. One of the nonconformities is lot size but the building will be similar to the original footprint but have a significant volumetric increase to the building in all the setbacks.
  5. There will be a change in use based on the apartment on the 2nd floor
  6. There will be an increase in use.
  7. This use is permitted in the Central District.
  8. There will be improvements in the use of the property
  9. There will be 15 parking places, 3 less than required.
  10. This will be a significant improvement in the property
  11. The rebuilding of this property will not be substantially more detrimental than the prior existing structure.   

Mick Lynch moved to approve the Findings of Fact; seconded by Sharon Inger; passed

5-0.  Mick Lynch moved to grant the Special Permit based on the Findings of Fact; conditioned on the Board of Health approval and recognition of 3 parking places short of the required 18; seconded by Sharon Inger; passed 5-0.

7:22 pm

  1. J. Dale Sherratt and Beatrice Sherratt, 110 Cliff Road, Map 24, Parcel 120:  Application for a Special Permit under WZB 6.1.5.2(b)  to move dwelling from marine scarp¸ reducing it’s size from 2,445 sq. ft to 1,630 sq. ft.  At the request of the applicant, Mick Lynch moved to continue to 5/5/16; seconded by Sharon Inger; passed 5-0.
