To summarize Greg C - “At this point we have two very different proposals on the table, we either change the regulations to be applicable to natural persons which is simple or in the case of the 2nd group there are lots of variations. No need to write all different versions of regulations when we have big picture questions that need to be answered.
"This isn’t my area of expertise but there (may) be all kinds of ways to protect your assets that do not involve creating a corporation. This is a very important question and we should hear from a business attorney about what the potential consequences are of that decision. Because this is such an important question we shouldn’t proceed without getting the answer to this question.”
Because this meeting took place just hours before our scheduled SAB meeting and we have not had an opportunity to finalize the notes and distribute them nor make them publicly available, nor were we able to obtain answers to our overriding questions, we will be postponing tonight’s meeting. This will allow time for SAB to make this information publicly available and to seek additional legal input from a lawyer that specializes in business liability law.

I will be following town councils suggestion to contact the Barnstable County Bar Association about having a business attorney speak to us at a meeting about ways that shellfishermen can protect themselves from liability including but not limited to insurance, business organizations ect.

When we reschedule we will add a discussion and potential vote on requesting the Select Board to extend the moratorium on transfers to non natural persons to give ample time for broad community discussion on this important topic. I will be in contact soon about scheduling the next meeting.
