Agent Greenberg-Lemos reported there will be an Executive Session at the July 20 Business Meeting.

There was a discussion regarding the project at 95 Lawrence Road.  The Conservation Commission has no jurisdiction within this project.

Jurisdictional Opinions:

Town of Wellfleet – Long Pond.  A tree fell into pond and the town wants to cut it down and remove it due to danger for swimmers and boating.  Barbara Brennessel pointed out that there is habitat under the tree.  Leon Shreves moved to grant the Jurisdictional Opinion that the town should remove it; seconded by Barbara Brennessel.  Leon Shreves aye; Barbara Brennessel aye; Ben Fairbank aye; Marty Murphy aye; and Michael Fisher aye.  5-0. 

Barbara Brennessel reported some of the boats on the resources at the end of King Phillip Rd have been removed.  One larger vessel will be removed by Harbormaster Will Sullivan.  Other areas where vessels are on the resources will be looked at.  Ben Fairbank stated there was discussion on Wellfleet Facebook pages about the small boat regulations and Ben provided further information there about our regulations.  Agent Greenberg-Lemos stated we will again create signage and post it in several key areas regarding boats left on the coastal resources.  Jack’s Boat Rental has new ownership and the brochures about these regulations will be left with them.

Agent Greenberg reported that Old Briar Cliff Road and the end of Old Wharf Road are in need of repair.  She is in touch with the DPW about grading them so they are passable.  There have been problems with contractors’ trucks getting stuck in the marsh and doing damage to it when they have tried to go around the problem spots in these roads.  If major work needs to be performed, it will have to go to the next Town Meeting for funding. 

Barbara Brennessel reported diamond back terrapins trying to nest at the house to the south of Powers Landing.  They were trying to go up the coastal bank by that house through a snow fence, but the fencing doesn’t allow passage.  Agent Greenberg-Lemos will follow up. 

Agent Greenberg-Lemos reported there was discussion at the last Town Meeting regarding a Tree Committee and the issue is with the Selectboard at this time. 

There is going to be a hybrid or in person meeting of the Selectboard with the Water Management group on Thursday, June 23, at 7:00 pm. 

Barbara Brennessel stated that there will discussion about enhanced I/A systems at the State of Wellfleet Harbor meeting in November. 

Leon Shreves asked about the Water Access Committee.  Agent Greenberg-Lemos stated that it will be important that its proposals consider climate change.

Public Hearings:

Chair Shreves opened the Public Hearing.

In attendance:  Barbara Brennessel, Leon Shreves, Marty Murphy, Michael Fisher; and Benjamin Fairbank.

Kleeman, 170 Bayberry Lane, Map 41, Parcel 121, Request for Amendment to Order of Conditions.  John O’Reilly represented the applicant and stated there are minor changes to the approved site plan: 1) install I/A treatment system; 2) extend foundation wall to the east end of the building in order to retain the grade; 3) have 1800 sq ft of decking with a step; 4) rotate the house to stay out of the setbacks.  The limit of work will not change.  The total disturbance was not identified on the revised plan.  Barbara Brennessel moved to approve the Amendment to Order of Conditions with the Conditions that the total amount of disturbance is under 3,000 sq. ft. and the total amount of disturbance is added to the new plan; seconded by Leon Shreves.   VOTE: Leon Shreves aye; Barbara Brennessel aye; Ben Fairbank aye; Marty Murphy aye; and Michael Fisher disclosed an apparent possible conflict of interest, stated that this disclosure has been approved by the Commonwealth Ethics Commission and the Wellfleet Selectboard, and stated that he can act objectively on this application, aye. 5-0. 

Curley, 295 Pilgrim Spring Rd., Map 29, Parcel 242, RDA, Install 3’ x 4’ generator pad and generator, trench for gas and electrical connections, install new front step, and replace 2 overgrown foundation plants.  A site visit was made by the Commission.  David Lyttle represented the applicant.  The only disturbances will be the site of the generator pad, the trenches, and the area where the replacement plants will be located.  The Commission stated the Conditions: the pad will be gravel filled; the outdoor shower will have nitrogen reducing wood chips installed; the total amount of disturbance for the property be provided on the plan.  Barbara Brennessel identified the RDA as a Negative 3, with those Conditions; seconded by Leon Shreves.  VOTE:  Michael Fisher disclosed an apparent possible conflict of interest, stated that this disclosure has been approved by the Commonwealth Ethics Commission and the Wellfleet Selectboard, and stated that he can act objectively on this application, aye, Leon Shreves aye; Ben Fairbank aye; Marty Murphy aye; and Barbara Brennessel aye.  5-0. 

Leon Shreves moved to adjourn the Public Hearing at 5:25 pm; seconded by Michael Fisher.  Michael Fisher aye; Barbara Brennessel aye; Ben Fairbank aye; Leon Shreves aye, and Marty Murphy aye.  5-0.
