  • Fr:  Cape Cod Commission regarding Falmouth alternative energy
  • Fr:  MA. Executive Office of Energy and Environmental Affairs, invitation to participate in regulatory over sight group regarding Herring River restoration project.  Thursday, Nov. 17, 10:00 – 3:00 Lakeville.  Agent Hillary Greenberg-Lemos will attend.

Jurisdictional Opinions:  Gitlow, Compass Hill Road, remove one locust, one evergreen tree.  The owner will prune the evergreen and remove the locust.  Ginie Page moved to approve the Jurisdictional Opinion; seconded by Ed Simpson; passed 7-0.

Meeting Minutes:  October 19, 2016   Trudy Vermehren moved to approve the amended meeting minutes; seconded by Ginie Page; passed 7-0. 

GOALS:  Discussion among commissioners.  The majority of the questionnaire did not apply to the commission or would be state regulated.  The commission discussed in detail the various statements pertaining to the low-lying roads, resources and sea level rise. The Commission will review and amend some local regulations to allow for habitat restoration projects.

                                 

Public Hearings 5:00 pm:

Perot, 36 Indian Neck Rd., Map 28, Parcel 45, Request for Amended Order of Conditions:  enlarge driveway and construct retaining wall.  Laura Kelley represented the applicant.  She gave an overview of the proposed revegetation.  The original Order of Conditions have not been completed which included the vegetated swale at the end of the driveway and the amount of disturbance within the 100’ buffer zone.  Trudy Vermehren moved to continue to Nov. 16, 2015; seconded by Ed Simpson; passed 7-0.

Flattery, 479 Black Pond Rd., Map 4, Parcel 38, NOI, replace wood stairs with stone stairs (Cont’d)   At the request of the applicant, Trudy Vermehren moved to continue to Nov. 16, 2016; seconded by Ed Simpson; passed 7-0.

Robicheau, 800 Ocean Dr., Map 17, Parcel 5, NOI, relocate dwelling away from marine scarp (Cont’d).  Lauren McKean recused herself.  Chet Lay represented the applicant.  Natural Heritage responded to the project and there will be no take.  Trudy Vermehren moved to approve the NOI; seconded by John Portnoy; passed 6-0.  Supervisor:  Ed Simpson

Sea Shells Condo Trust (Mattingly), 575 Chequessett Neck Rd., Map 19, Parcel 120, NOI, replace existing retaining wall (Cont’d).  Alfred Pickard represented the applicant. 

Natural Heritage responded and there will be no take.  Alfred stated the work limits on the plan should be moved to the low water level to avoid ruts in the sand.  The commission requested a pre-construction site visit with the supervisor/agent.  Trudy Vermehren moved to approve the NOI with conditions; seconded by Lauren McKean; passed 7-0.  

Cooney, 3 Kendrick Ave., Map 21, Parcel 112, Change foundation, modify footprint of dwelling, and place utilities underground (Cont’d).  At the request of the applicant, Trudy Vermehren moved to continue to November 16, 2016; seconded by John Portnoy; passed 7-0.

Goodman, Diamondback Way, Map 36, Parcel 17.1.2, Certificate of Compliance.  Agent Greenberg-Lemos stated the project is in compliance.  Trudy Vermehren moved to approve the Certificate of Compliance; seconded by Ed Simpson; passed 7-0.

Ginie Page reported she was told there is a stairway on Wigwam to the marsh. 

Trudy Vermehren moved to adjourn at 6:00 pm; seconded by Ginie Page; passed 7-0.
