Minutes of Meeting of October 12, 2016

Senior Center, Duck Pond Room, 7:00 p.m.

 

Present:  Ken Granlund Jr., Chair; Moe Barocas, John Cumbler, Janet Drohan, Gary Locke, and Mary Rogers, Committee Secretary

Chair Ken Granlund called the meeting to order at 7:00 p.m. 

Variance - Nordahl, 20 Barker St. (Map 36, Parcel 42)

David Lajoie of Felco presented two variance requests for 20 Barker Street (Map 36, Parcel 42):  He requested 2 variances for the septic system:

  1. 4’ from leach area to property line (Arbutus Street) – 310 CMR 15.211
  2. 4’ from leach area to property line (Columbia Street)

Gary Locke moved to approve FELCO Design plan # 16063, dated 9/25/16 and to grant two (2) variances requested in the letter of September 28, 2016 subject to the following conditions:

  1. Design flow is to be limited to 440 GPD, to serve four (4) bedrooms.  No increase in habitable area without Board of Health review.
  2. No increase in habitable area without Board of Health review.
  3. There is to be no conversion of use without Board of Health review. 
  4. The well water shall be tested and found potable, with results copied to the Health

Department, prior to issuance of the Disposal Works Permit.

  1. The new well shall be connected and put in service under the benefit of proper plumbing and electrical permits, and well shall be tested and found potable, with results copied to the Health Department, prior to issuance of the Disposal Works Permit.
  2. Any restriction in design flow and all conditions shall be recorded against the deed for the property at the Registry in Barnstable, and proof of conditions deed recorded shall be submitted to the Health Department prior to the issuance of the Disposal Works Permit
  3. The system owner shall have a septage Handler service the filter regularly, at least once every year and pump the septic tank in accordance with 310 CMR 15.000.  The system owner shall report in writing to the local Board of Health within 30 days of the date of servicing every time the septic tank is serviced.

Janet Drohan seconded, and the motion carried 5-0. 

Business

The Assistant Town Administrator had requested an update of the Local Comprehensive Plan Matrix.  The Board reviewed the update as prepared by the Health Agent but would like a further conversation with the Assistant Town Administrator Brian Carlson.

A Subdivision Plan for Heylinger, School St. (Map 13, Parcel 81 & Map 15, Parcels 22 & 23) had been submitted for the Board of Health’s consideration as a part of the Planning Board’s process for a Definitive Subdivision.  Members of the Board of Health had no issues with the subdivision.                                                                    

Correspondence

The abutters of the Parent Farm at 125 Duck Pond Rd./ 15 Bittersweet Rd. had submitted another letter with photos, which will be discussed at the next meeting.  The Board had not yet received a reply from Town Counsel, nor had the requested plot plan of the property been submitted.  Board members would also like to be better informed about the state definition and regulations of farms.  The McDonalds were present and answered some questions about their residency at their present address and knowledge of the Parent’s farm plans, informally and by abutter notification.

Moe Barocas moved to approve the minutes of September 14, 2016.  Gary Locke seconded, and the motion carried 3-0-1.

Adjournment

John Cumbler moved to adjourn.  Gary Locke seconded, and the motion carried 4-0.
