Wellfleet Board of Health

Minutes of Meeting of August 12, 2015

Senior Center, Long Pond Room, 7:00 p.m.

 

Present:  Chair Ken Granlund Jr.; Janet Drohan, Moe Barocas, Health Agent Hillary Greenberg-Lemos, and Mary Rogers, Committee Secretary

Chair Ken Granlund called the meeting to order and opened the public hearings at 7:00 p.m.  The meeting was tape-recorded.

Variances

Sherratt, 110 Cliff Road (Map 24, Parcel 120)

Chris Wixon of East Cape Engineering came forward to present the plan for the relocation of the existing four-bedroom house, septic tank and distribution box at 110 Cliff Road on behalf of owners, J. Dale and Beatrice A. Sherratt.  An earlier variance had been granted for the septic tank, but this request is for a new polyethylene septic tank.  The original variance requested for the setback of the existing leach pit to the new foundation is to remain unchanged.  He requested two (2)  variances: a 4’ +/- to the 20’ required setback for the existing leach pit to the proposed foundation wall; and 5’ +/- to the 10’ required setback from the proposed septic tank to the proposed foundation wall.

Janet Drohan moved to approve the East Cape Engineering Plan #14-036, dated July 30, 2015, for the 2 variances requested in the letter or July 30, 2015, subject to the following conditions:

  1. Design flow is to be limited to 440 GPD, to serve 4 bedrooms. 
  2. The well water shall be tested and found potable, with results copied to the Health Department, prior to issuance of the Disposal Works Permit.
  3. Any restriction in design flow and all conditions shall be recorded against the deed for the property at the Registry in Barnstable, and proof of deed recording shall be submitted to the Health Department prior to the issuance of the Disposal Works Permit.

 Moe Barocas seconded, and the motion carried 3-0.

Lasker, 185 Main St. (Map 15, Parcel 71)

David Lajoie of Felco, Inc. presented the plan for 185 Main Street (Map 15, Parcel 71) for the Variances requested by Cynthia and John Lasker Jr.  The addition to the dwelling does not increase the number of bedrooms.  The property will be connected to Wellfleet Municipal Water System. 

Janet Drohan moved to approve the Felco plan 14072, dated July 6, 2015, for the 3 requested variances in the letter of July 29, 2015 subject to the following conditions:

  1. Design flow is to be limited to 330 GPD, to serve 3 bedrooms. 

  2.   No increase in habitable area without Board of Health review.  

  3.   There is to be no conversion of use without Board of Health review.

  1. Any replacement of on-site well connection with Municipal Water Supply shall    be done under benefit of proper plumbing and electrical permits, and authorization by the Water Commissioners, and in compliance with the Water System rules and regulations.
  2. Any restriction in design flow and all conditions shall be recorded against the deed for the property at the Registry in Barnstable, and proof of deed recording shall be submitted to the Health Department prior to the issuance of the Disposal Works Permit.

Moe Barocas seconded, and the motion carried 3-0. 

 Jenkins, 200 Holbrook Ave., Map 14, Parcel 116

David Lajoie of Felco also presented the project for Pricilla Jenkins of 200 Holbrook Ave. (Map 14, Parcel 160).  Due to constraints of lot size, lot configuration, topography, structure location, water supply and the existing septic system location, Felco requested 4 variances for installation of a new subsurface septic system.       The property is on Town Water.  The property to the north is on Town water, but the property to the south is not connected.  That is the area in need of a variance.  Felco will draw up a plan using IA because the abutter is not planning to connect to the Municipal Water System and opposed the variance.  The Health Agent read the letter of opposition from the abutter into record.  Mr. Lajoie said this would necessitate an alternative system. 

Moe Barocas moved to approve the Felco plan # 15035, for the 4 requested variances subject to a revised plan with the inclusion of an IA system. 

4 Variances

Janet Drohan seconded, and the motion carried 3-0.

Business

A Transfer Station client who has an account there has not been keeping up with his bill, Health Agent Greenberg-Lemos said.  He had been invited to attend the meeting to discuss his delinquent bill.  In his absence, the Health Agent and Board members discussed solutions and determined that he must pay at each visit or not be allowed to dump his trash. 

Food License

Board members signed a license to operate a food truck to “349 Events,” whose place of business is 53 Avery Ave.  

Minutes

Barocas moved to approve the minutes of July 8, 2015.  Drohan seconded, and the motion carried 3-0.

Correspondence

The Board reviewed the correspondence file. 

Adjournment

 Janet Drohan moved to adjourn.   Moe Barocas seconded, and the motion carried 3-0.  The meeting was adjourned at 7:35 p.m.
