Meeting Minutes

 

Members Present: Kenneth Granlund (6:15pm), Chair; Moe Barocas, Nick Picariello, Janet Drohan, Gary Locke (6:50pm)

 

Others Present: Hillary Greenberg-Lemos, Health Agent; Rebekah Eldridge, Mia Baumgarten, media manager for the Town of Wellfleet; David Lajoie, Felco, Inc.

 

Chair Granlund called the meeting to order at 6:15PM

 

Mia was introduced to the board and she explained why taping their meetings would be beneficial. The board discussed with Mia the pros and cons of taping. They agreed they would like more time to discuss this and would reach out to Mia when they had a decision.

 

 

Animal Permits – Hillary told the board that the applicant withdrew the application.

Business

  • Appeal of health agent for a fine – 115 Cahoon Hollow Rd, Wellfleet, MA – Dana & Colleen Barisano – No one showed up for this property, Eldridge told the board that this property has not come before the planning board to date. Hillary discussed the case with the board going over the case file. April 2018, the property was closed on. There was a signed six-month waiver agreement to upgrade the septic system, six months brought the owners to November at that point he failed to upgrade the septic, the Health department wrote to him ordering him to have a new system installed on November 2, 2018, he failed to do so. Another letter was written to him in December, there was a phone call between Barisano and Hillary December 7th. He was coming to ask the board for more time, he missed that meeting. A ticket was issued on December 12, 2018, he explained he had brain surgery and wanted to meet with the board at its next meeting. His lawyer and he didn’t show up to that meeting. He and his lawyer were to be at this meeting and no one came. Hillary recommended to send another citation and order his septic be upgraded immediately and ticket him until he does so.

 

 

 

  • Housing Rental Regulation – Discussion

 

The board asked Hillary to investigate the housing. At this meeting they asked her to explain the rental tax and the tax the could be possibly be imposed on all renters. Hillary explained that the state instituted the Air B&B tax which means that any property that’s rented for a certain segment of time has to asses this tax. The tax goes to the state and the person renting the home is responsible for collecting the tax and sending it into the state and then a portion of that money comes back to the town of Wellfleet. The money that comes back, a portion if it will be spent on wastewater.

The board discussed having the right to inspect any unit that is being used as a rental. Which would force people to register the unit with state regulations. Hillary explained there isn’t a program in Wellfleet that forces them to register with the Board of Health at this time. The board discussed plans on how this might be handled before they make any decisions. Hillary explained she doesn’t inspect any property unless she gets a phone call of a complaint. She explained the pros and cons of inspecting units to the board. The board discussed housing codes and possible inspections. The board asked Hillary her thoughts on the matter, Hilary expressed she didn’t want to displace people that didn’t have an alternate place to go, she believes people should be entitled to a house that meets code, water testing, septic systems up to code. She told the board she wasn’t sure how to get to that point due to staffing needs. The board decided they are interested in a regulation after properties are registered with the DOR. The board would like to know the plans when getting properties registered.

  • All licenses were signed by the board members

 

Correspondence

  • Warrant; Water Resource Director was discussed. Concerns about cost were brought up. The board discussed at length what this position would look like. There is a meeting set up with Hillary, Helen, Justina, Dan, Joe and Alex from wastewater will be meeting to discuss and brainstorm about this position. The board asked questions concerning what the actual plan was with this position. The board feels more information is needed. The board decided to leave this recommendation to town meeting. The board would like wastewater committee to come in and speak to the board about what their plans are for this position.
  • Locke moved to draft a letter to Dan Hoort to not recommend a Water Resource Director at town meeting.
  • Barocus seconded the motion. Motion carried 4-1-0

Variances

  • 11 Anawan Rd, Wellfleet (Map #28, Parcel #208) – Jonathan Robbins

David Lajoie from the engineering company Felco, Inc presented to the board. This is for a septic system upgrade. He went over the specs of the new septic system. Hillary asked if he needed a PE to stamp the wall, David said he uses to shore guide. She asked if a Monolific tank could be used he said yes.

Locke moved to approve Felco plan number 18068 dated 2/7/2019 granting the one variance requested 2/12/2019 for the upgrade of a septic system to serve a three-bedroom structure with innovative technology using Advantax AX 20 mode 3B denitrification technology under the provisional approval category and the testing that comes with the provisional.

  •  Design flow limited to 333 GPD to serve three bedrooms
  •  no increase in habitable area
  •  no conversion of use
  •  standard well water testing per board of health regulations
  •  a deed restriction reflecting three bedrooms.
  •  Innovative technology monitoring.

Barocas seconded the motion

Motion carried 5-0-0
