Chair Roger Putnam opened all three hearings at one time.  The Special Permit (18-06) was the focus for the meeting.

18-05   Martha R. Wilson, Trustee of The Martha R. Wilson Living Trust Agreement, 56 Indian Neck Road, Map 28, Parcel 48, Appeal from Person Aggrieved regarding Stop Work Order dated January 18, 2018. (Cont’d).  The Board consisted of Roger Putnam, Sharon Inger, Mick Lynch, Trevor Pontbriand, and Wil Sullivan.   Attorney Singer requested the application be withdrawn without prejudice.  Mick Lynch moved to allow the application be withdrawn without prejudice;  seconded by Trevor Pontbriand; passed 5-0.

18-06  Martha R. Wilson, Trustee of the Martha R. Wilson Living Trust Agreement,  56 Indian Neck Road, Map 28, Parcel 48, Application for a Special Permit under WZB  6.1.5 and 8.4.2 and M.G.L. Chapter 40A, Section 6, to complete construction of a detached accessory two-car garage with art studio above.(Cont’d).  The Board consisted of Roger Putnam, Sharon Inger, Mick Lynch, Wil Sullivan, and Trevor Pontbriand.  Attorney Andrew Singer represented the applicant and reviewed the revised site plan and construction plans.  The stairs will be located  15’ from the side setback.  The proposed lot coverage will be 9.3%.    The revised construction plans identify the elevations and design of the structure.  Trevor Pontbriand moved for Findings of Fact; seconded by Sharon Inger; passed 5-0.

  1. This is an application for a Special Permit under WZB 6.1.5 and 8.4.2 and MGL Chapter 40A section 6 to build a detached two car garage with studio above within the side yard setbacks.
  2. The house on the lot is a lawfully pre-existing, non-conforming dwelling.
  3. The non-conformities are side yard setbacks.
  4. The lot is located in the R District.
  5. The lot coverage will increase from 6.2% to 9.3%
  6. The proposed structure will impinge on both side yard setbacks.
  7. There will be no change in use.
  8. There will be no increase in use.
  9. The use conforms to the uses for the R District.
  10. There are no objections from abutters.
  11. There is a letter of support from an abutter.
  12. The additional building will not be more substantially detrimental to the neighborhood than similar structures in the neighborhood.
  13. This is not a significant development.

Trevor Pontbriand moved the Findings of Fact; seconded by Sharon Inger; passed 5-0.  Trevor Pontbriand moved to grant the Special Permit based on the Findings of Fact; seconded by Sharon Inger; passed 5-0.

Wilson Living Trust Agreement, 56 Indian Neck Road, Map 28, Parcel 48, Application for Variance under WZB .4.3 and M.G.L., Chapter 40A, Section 10 from the provisions of Sections 5.4 and 6.2 to complete construction of a detached accessory two-car garage with art studio above. (Cont’d).  Attorney Singer requested the application be withdrawn without prejudice.  Mick Lynch moved to allow the application be withdrawn without prejudice; seconded by Trevor Pontbriand; passed 5-0.

Business – Since no new applications were received, the next ZBA meeting will be July 19, 2018.
