Chair Roger Putnam opened all three hearings at one time.  The Special Permit (18-06) was the focus for the meeting.

18-05   Martha R. Wilson, Trustee of The Martha R. Wilson Living Trust Agreement, 56 Indian Neck Road, Map 28, Parcel 48, Appeal from Person Aggrieved regarding Stop Work Order dated January 18, 2018. (Cont’d). 

18-06 Martha R. Wilson, Trustee of the Martha R. Wilson Living Trust Agreement,  56 Indian Neck Road, Map 28, Parcel 48, Application for a Special Permit under WZB  6.1.5 and 8.4.2 and M.G.L. Chapter 40A, Section 6, to complete construction of a detached accessory two-car garage with art studio above.  The Board consisted of Roger Putnam, Sharon Inger, Mick Lynch, Trevor Pontbriand and Wil Sullivan. C. Wilson Sullivan read the meeting minutes of April 5, 2018 and signed the appropriate paperwork pursuant to G.L.c.39, Section 23D.

Attorney Andrew Singer represented the applicant.  He reported the abutter and applicant came to an agreement that is represented in the revised plan.  The garage will be 30’ from the street, 17’ from left side setback, and 19’ on the right-side setback.  The garage will be built into the ground and appear as a one-story structure from the abutter’s view and a two-story from the front.  He requested the Board to review the Special Permit application and withdraw application 18-05 and application 18-07. 

Attorney Singer gave an overview of his Findings of Fact, stating the structure will not be more detrimental to the neighborhood.  The site is suitable for the neighborhood; the roads, drainage, etc. will remain adequate; drainage on the roads is adequate, and a new septic is scheduled to be installed.  The building will be away from any wetlands and minimize any potential environmental damage.  The septic system will be of benefit to the property.  The use as a single- family dwelling will remain the same.   The lot coverage will remain conforming, and views were taken into consideration.  Sara Torano-Flores stated her client is happy with the revised plan.  Trevor Pontbriand stated the current plans do not show the steps or the decking which would change the east setback to 13’.   Mick Lynch stated he had concerns with the incorrect paperwork, and increasing the non-conformities on the property.  Attorney Singer reiterated the history of previous permits which were issued incorrectly.  The Board concurred they would like to receive a revised site plan, as well as detailed construction plans.  Attorney Singer stated the septic upgrade would be constructed within a few weeks.  Mick Lynch moved to continue all 3 hearings to June 7, 2018; seconded by Sharon Inger; passed 5-0.
