17-21  Olaf and Angie Valli, 3 West Main St., Map 14, Parcel 146, Application for a Special Permit under WZB 8.4.2 and 5.2 to erect a 30’ x 40’ tent to be used for 2017 seasonal sales.  Tent will be located on existing slab, there will be a temporary 20’ x 8’ storage container for merchandise and a temporary porta-potty for employees only.

The Board consisted of Roger Putnam, Bruce Drucker, Sharon Inger, Manny Heyliger and, Trevor Pontbriand.   Ronald Welch represented the applicant and stated the proposal is for a tent to sell retail merchandise.  There will be rentals as well.  This would be an open-air tent and placed on the existing slab.  Mr. Welch stated they would bore into the slab to insert the tie downs with stakes to hold the tent in place.  If there was enough notice of a bad storm, the tent would be brought down.  The storage container is 20 x 8 to hold the merchandise.    Justin Post stated there could be a temporary electrical service which adheres to OSHA.  A permit would have to be pulled for the tent and the electric.  Ideally, they would like to have the tent up prior to the 4th of July and take it down after Labor Day.  The employees would park at the town parking area.  A letter from Maurice Grumberg was read into the record who objected to the porta potty.   Manny Heyliger stated that due to the circumstances of not building the approved building during the summer months, he would vote on it.  Normally, he would not approve this.  Roger Putnam questioned what this can be filed under according to definitions and use.  Bruce Drucker stated this is a temporary structure.  Bruce Drucker moved for Findings of Fact; seconded by Sharon Inger, passed 5-0.

  1. This is an application for a Special Permit under WZB 8.8.2 and 5.2 to erect a

30 ft x 40 ft tent to be used for seasonal sales.  The tent will be located on an existing cement slab.  There will be a temporary 20 ft x 8 ft storage container for merchandise and a temporary porta-potty for employees.

  1. The use is similar to the pre-fire use.
  2. There are no other tents in the Central District
  3. This is a heavy traffic intersection.
  4. Both side yard setbacks are less than required in the Central District.
  5. Abutters concerns is use of the porta-potty.

Bruce Drucker moved to grant the Special Permit subject to the following conditions:

1.  The permit expires on September 8 and the tent, storage container and porta    potty to be removed by September 8, 2017.  

2.   A weather forecast with winds in excess of 40 mph will require the tarp be  removed from the frame.

seconded by Sharon Inger, passed 5-0. 

17-22  Nate Johnson, 39 Way 75, Map 23, Parcel 185, Application for a Special Permit under WZB 6.1 to build a 312 sq. ft. non-heated studio onto rear of home which is within the setbacks  This hearing was cancelled due to a decision by the Building Inspector that a Special Permit was not required.

Business: 

Bruce Drucker reported he had acquired a Professional Assistant for training in 40B Permits.  The training will be held on Tuesday, May 30, 2017 at 7:00 pm. 

Bruce Drucker circulated the responsibilities the Town Planner in Eastham does with ZBA applications.  He would like to ask Wellfleet’s Town Administrator if our Town Planner could examine the ZBA applications to ensure the paperwork is complete.

Bruce Drucker moved to adjourn at 7:45 pm; seconded by Sharon Inger; passed 6-0.
