Minutes of Meeting #38; March 21, 2018

Present: Harry Terkanian, Chief Ronald Fisette, Jay Horowitz, Sean Donoghue, and Davis Walters

(alternate)

Also present: Rick Pomroy, Pomroy Associates, Todd Costa, Kaestle Boos Associates, Gary Sorkin and

Sharon Agar, Wellfleet Housing Partnership

Mr. Terkanian called the meeting to order at 4:00 PM.

1. Project status.

a. Project status and schedule report. Mr. Pomroy reported there was no schedule update. The

significant outstanding issue is the general contractor’s general conditions claim. Mr.

Pomroy was contacted earlier this week by the general contractor about resolving this issue.

Mr. Costa reports that the construction contract provides for either a contract price

adjustment or extension to the substantial completion date, but not for both. The contractor’s

earlier claim was rejected as unsupported, but a $100,000 general conditions claim remains

outstanding. Mr. Pomroy expects to speak with the contractor about this issue again prior to

the next meeting. Work continues with a goal of releasing the communications area by April

11 so that furniture and dispatch equipment can be installed.

b. Pending change orders. Approved PCOs are proposed for change order #10.

i. PCO 47, first of two electrical system upgrades. Cost $7,902.15.

ii. PCO 48, second of two electrical system upgrades. Cost $5,214.15.

iii. PCO 49, digital artwork (town seal and department patch.) Cost $277.50. The Town

will retain this artwork for use on other projects.

iv. PCO 50, water service for coffee maker. Cost $659.68.

v. PCO 51, removal of fiber optic line from conduit. Cost $784.06. Includes removal,

termination of ends and disposal of removed fiber.

vi. PCO 52, design upgrade. Cost $1,535.67. Airflow in locker rooms needs to be

vented through lockers to insure that clothing in lockers is dry. Two additional ducts

may be required so this remains under review by the designer.

vii. Mr. Costa noted that while all of the work has been approved by his office, markups

on these PCOs need to be checked and may be reduced. On motion of Chief Fisette,

seconded by, Mr. Horowitz it was voted (4-0) to approve the scope of work in PCOs

47 through 52 inclusive. Vote to recommend the PCOs will be deferred to the April

4, 2018 meeting. It is anticipated that these PCOs will be incorporated into Change

Order #10.

c. Project budget. No changes to the project budget since Budget Report Update #14, reviewed

at the February 21, 2018 meeting.

d. Pending purchase orders and open items. Mr. Pomroy reported on the status of these items

which include:

i. Smart Boards – on hold;

ii. Phone – on hold;

iii. Fingerprint machines – on hold.

e. Disposition of the temporary facility. The general contractor has been instructed to remove

the temporary facility in accordance with the contract.

2. Mr. Donoghue joined the meeting.

3. Minutes. On motion of Chief Fisette, seconded by Mr. Horowitz, it was voted (5-0) to approve the

minutes of the March 7, 2018 meeting as presented.

4. Committee meeting schedule through June, 2018: April 18, 2018, May 16, 2018 and June 20, 2018;

meetings for invoices and time sensitive items on April 4, 2018, May 9, 2018 and June 6, 2018.

5. Future agenda items. Mr. Walters expressed concern that the general contractor’s request for an

extension should be resolved.

6. Adjournment. On motion of Chief Fisette, seconded by Mr. Horowitz it was voted (5–0) to adjourn.
