Chair Parent called the meeting to order at 7:05 PM

Announcements, Open Session & Public Comment:

-O’Connell noted that he reviewed a revised homeowner’s association from Habitat from Humanity for 2082 Route 6 and it appears to be acceptable.

-O’Connell reported that the Board of Selectmen’s meeting that Moderator Silverman suggested that articles be grouped together by subjects.

Meeting Minutes-The minutes of 2-14-2018 were moved to approve, as amended, by Singer. Seconded by Cooney, and the motion carried, 3-0-1.

Discussion-Pleasant Point Bulkhead-Tabled for a future meeting.

Discussion-Affordable Flexible Residential Zoning Bylaw

The Planning Board members discussed Town Counsel’s responses to the Board’s proposed amendments of the Affordable Flexible Residential Design Zoning Bylaw. They  discussed additional changes to Dimensional Requirements, Site Design, Application Requirements, Common Open Space Requirements, Permissible Uses of Open Space, Open Space Restriction, and Affordability Restriction. The AFRD document with proposed changes will be sent to Town Counsel for further review.

Moved to accept with amendments, and schedule a public hearing on March 21st by Pickard. Seconded by Singer, and the motion carried, 5-0.

Moved to submit to the Warrant by O’Connell. Seconded by Parent, the motion carried 5-0.

Discussion- Marijuana Overlay District

O’Connell asked if the Planning Board can add something to the bylaw which prevents access through any other districts. The Board discussed where they can add limitations or restrictions to public traffic, such as the General Requirements section. They discussed that access will only be from Route Six, contingent on Town Counsel’s response.

O’Connell asked about the suggested change of Medical Marijuana Overlay District (MMOD) to Marijuana District. The Board discussed changing the name to Marijuana Overlay District (MOD) instead, and have the amendment be the suggested replacement name.

The Chair discussed Town Counsel’s response which stated “there is a Medical Marijuana Overlay District at the present time, which is comprised of two underlying districts: C2 and Commercial. While retail sales are not allowed in the C2 zoning district, uses allowed in the MMOD supersede the underlying zoning district.” Town Counsel suggested creating a separate overlay district for retail sales only, which could be limited to the C district.

Moved to accept, as amended, for the hearing on March 21st and to send to the Warrant, by Pickard. Seconded by Singer, and the motion carried 5-0.

Assistant Director, Department of Public Works Paul Lindberg: Discussion Tree Maintenance on Scenic Roads-Tabled for a future meeting. A site visit will be scheduled to view the trees.

Discussion-Special Permit/Site Plan Review for Impactful Commercial Uses Zoning Bylaw-O’Connell asked if this will satisfy Town Meeting by not having a Formula Business Definition.

Moved to not submit for the Warrant in Town Meeting, by O’Connell. Pickard seconded.

The Board discussed the motion made by O’Connell. Singer suggested leaving it on the Warrant and then not recommending it. Chair Parent suggested leaving it as advertised, having the hearing, and still take a vote not to recommend. O’Connell doesn’t feel as though this is ready for Town Meeting.

The final vote on the motion not to submit for the Warrant made by O’Connell was 4-1.

Discussion-White Crest Expansion-The Chair explained that this is something the Board of Selectmen have brought forward, and the Planning Board is trying to weigh in on issues such as traffic studies and traffic patterns. The Chair mentioned that there is no special permit required for the parking lot. He explained that it will ultimately be a matter between the Board of Selectmen, the Board of Appeals, and Town Counsel.

Discussion- Coles Neck Road-Affordable Housing-This item will be removed from future Planning Board agendas.

Discussion-Update to Home Occupation 6.22.2 (5) Zoning Bylaw-The Chair opened the discussion addressing Helen Miranda Wilson’s concern that aquaculture, as defined in the Zoning Bylaw, only occurs in the water. She believes that aquaculture should refer to land-based actions in the home occupation bylaw when by adding “…to allow, in particular, the necessary, land-based activities associated with aquaculture to be considered as a Home Occupation.”

The Chair reiterated that the classification includes aquaculture, shellfishing, or fishing as being Home Occupation in the bylaw, and you can cover 30% of the lot to do it. The Board members reviewed the language in the current bylaw, as well as the citizen petitioned articles.

The Board will hold a public hearing on March 21st.
