Wellfleet Planning Board Minutes

Chair Gerald Parent called the meeting to order at 7:00 p.m.

Minutes

Dennis O’Connell moved to approve the amended minutes of January 18, 2017.  Janet Morrissey seconded, and the motion carried 6-0-1.

Harbor Water Quality Certification Sign Off

The Planning Board examined the BRP WW26 Water Quality Permit for Waterways & Water Quality Certification for Wellfleet Harbor (Map 20, Parcel 31 and Map 21, Parcel 114) which the Chair will sign.

Draft Food Truck Bylaws

Gerald Parent said that he had forwarded the draft Food Truck Bylaw to Town Counsel and had a follow-up phone conversation with Attorney Carolyn Murray.    She sent back her comments and questions for the Planning Board to consider.  Planning Board members discussed her recommendations for the bylaw, starting with the definition.  Section 2.1- a of Definition was struck, but subsections b, c and d in Section 2.1 were retained and renumbered accordingly.  

Board members discussed the possibility of further considerations of setbacks and parking but decided that the general special permit requirements were sufficient.  Mary Ellen Manning said, for the record, that for the few months that food trucks operate they should be allowed in the C2 District.  

Dennis O’Connell moved to approve the changes to the draft Food Truck Bylaw to bring to a public hearing on March 1, 2017.  Alfred Pickard seconded. The motion carried 5-1.

Draft Sign Bylaw

Dennis O’Connell reviewed Town Counsel’s comments for the Draft Sign Bylaw revision.  Planning Board members discussed the proposed draft for Sign Zoning Bylaw revisions. 

Dennis O’Connell moved to approve the amended 1/31/17 draft Sign Bylaw to bring to the public hearing on March 1, 2017.   Janet Morrissey seconded, and the motion carried 5-1.

The dissenting vote by Mary Ellen Manning is not a reflection on content, but because the bylaw is grammatically incorrect.

List of Proposed Zoning Articles

Janet Morrissey reviewed the list of eight Warrant Articles that Planning Board intends to bring before Annual Town Meeting.

Janet Morrissey moved to repeal the Formula Business Special Permit bylaw by deleting “Business, Formula” from Section II Definitions and Section 5.3.2 Commercial Use table, and Section 6.30 Formula Business Special Permit.   Dennis O’Connell seconded, and the motion carried 5-0-1.

Alfred Pickard moved to leave the draft for the repeal of the Formula Business Bylaw as presented and send it to public hearing on March 1.  Dennis O’Connell seconded.  The Board discussed the Article Summary and made amendments.

Beth Singer moved the amendments to the Article Summary.  Alfred Pickard seconded, and the motion carried 6-0.

The main motion to bring the amended version to the public hearing on March 1, 2017 carried 6-0. 

Janet Morrissey explained the amendments for Sections 8.2., 8.2.2, 6.20.4, 8.4.24, 3.3, 9.1.2, 9.2.2, all of which were previously moved to the public hearing.  Janet Morrissey reviewed the summaries for the Warrant Article.

Liaison Reports

Dennis O’Connell reported on Charter changes that refer to the Planning Board.  In the Charter the Master Plan is included as a responsibility of the Planning Board.  He will put the Charter section on Planning Board as an agenda item for a future meeting. 

Brian Carlson announced two meetings: the Local Comprehensive Plan Committee with the Shellfish Community on February 21, 2017 and Cultural District Mapping on Saturday, February 4, 2017.

Correspondence

Dennis O’Connell reviewed items of interest in the Correspondence Folder.  He read from the forwarded messages from Jude Ahern to Brian Carlson.  He noted a copy of a letter from Curt Felix to the Board of Selectmen.  Stephen Oliver had sent a letter to the Board of Selectmen with a copy to the Planning Board regarding operations at 2267 State Highway.   The Zoning Board’s decision for Cumberland Farms was also included in the folder. 

Agenda for February 15, 2017 meeting

  1. Definitive Subdivision 17-01 Old King’s Hwy, which is now staked.A site visit is scheduled at 9:00 a.m. of February 15, 2017;
  2. Disposition of Town-owned Land;
  3. Draft Cluster Housing Bylaw with Martha Hevenor; and
  4. General Discussion of Proposed Articles for Town Meeting.

Future Concern

Brian Carlson said that other boards and committees’ recommendations for the disposition of Town property, the bulkhead at Pleasant Point, would be coming to the Planning Board   

Adjournment

The meeting was adjourned by consensus at 9:10 p.m.
