Wellfleet Planning Board Minutes

Members Present: Mary Ellen Manning, Janet V. Morrissey, R. Dennis O’Connell, Gerald E. Parent, Chair, Alfred Pickard, Beth Singer

Members Absent: Andrew Freeman,

Others Present: Assistant Town Administrator (ATA) Brian Carlson, members of the Heyliger Family, Chet Lay of Slade Assoc., Town Clerk Joe Powers

Vice-Chair Morrissey opened the meeting at 7:00 PM. 

Minutes

O’Connell made a motion to approve the November 9, 2016 Planning Board Minutes as amended; Pickard seconded; the motion passed 4-1.

Chair Parent arrived after the vote.

Definitive Subdivision (DSD) 16-01: Heyliger, 0, 2 & 15 School St.

Lay presented the additional information that was provided by the DPW, the PD and the FD, as well as the corrected covenant, complete with all necessary waivers.  The Board discussed each entity’s response to the plan, the details of the covenant and Home Owner’s Association.

Pickard made a motion to approved DSD 16-01; O’Connell seconded; the motion carried 6-0.

Style Memo Discussion

Town Clerk Powers began the discussion by explaining his recent contact with staff attorneys at the Massachusetts Attorney General’s Municipal Law Unit ­­­­­­­­and Town Counsel over formatting and other editing of the Zoning Bylaws.  Powers stated that the initial reaction by the staff attorney was that no changes were permitted unless Town Meeting has voted.  He will continue to update the Board as news becomes available.

The Board continued the topic by discussing the memo on writing style submitted by Morrissey.  Manning made a motion for the Board to accept the Associated Press Style Book for all documents going forward; there was no second. 

Chair Parent concluded the discussion by stating that the Board will continue to focus on substance while doing its best to produce the highest quality documents possible in regard to clarity and uniformity of format and style.

New Amendments to the Zoning Act

ATA Carlson was asked to follow up on obtaining a response from Town Counsel on the letter that was sent for Counsel’s consideration on 11-15-16.

Charter Review Committee Request for Input

O’Connell reported that more committees have weighed in and most agree that the Charter Quorum requirements should remain as they are.  Consequently, the Charter Review Committee has decided not to change that section of the Charter.  O’Connell also reported that the process for submitting bill warrants is being reviewed.

Draft Sign Bylaw Review

The Board reviewed the draft Sign Bylaw revisions prepared by O’Connell and Freeman and suggested changes.  O’Connell and Freeman will update the draft and report back to the Board at a future meeting.  ATA Carlson was asked to check with Town Counsel on the legality of removing or revising Section 7.8.2.  The Board agreed, by O’Connell’s suggestion, to add Morrissey to the working group.

Food Truck Regulations

Morrissey presented the latest version of the Food Truck Use Special Permit Bylaw and the Food Truck Prohibition Bylaw.  The Board reviewed both and made suggestions.  Morrissey will make the changes and report back.

Map 15, Parcels 19 & 19.1, and Map 42, Parcel 601

Chair Parent and Pickard updated the Board on the discussion they had with the Board of Selectmen (BOS) regarding vacant parcels off School St. and the Town-owned parcel known as the Landing Strip near Marconi Beach.  Chair Parent reported that the BOS appeared receptive to the suggestion of the Town purchasing the lots off School St. for the potential use of municipal parking on the upper lots. 

The Landing Strip was not discussed at the BOS meeting, but it was reported that the Assessor’s Atlas is in the process of being corrected to reflect the true boundaries of Map 42 Parcel 601.

Meeting Time and/or Cap Discussion

The Board discussed the idea of imposing a cap on discussion time and starting meetings earlier in the evening.  It was agreed that no changes would be made at this time.
