Mail / Discussion

            Adaptations to Climate Change in Outer Cape Towns

Barbara Brennessel recommended this be presented at the Wellfleet State of the Harbor Conference  There was discussion regarding presenting it to the Town.  Agent Greenberg-Lemos stated there was a meeting between the town and the chairs of all the committees and boards to discuss various needs of the town.  It was agreed that there should be a presentation at their next meeting in the fall.   

Jurisdictional Opinions

Chris Fromboluti – move and replant rhododendron.  The area of disturbance will be approximately 6’ x 6’.  Barbara Brennessel moved to approve the Jurisdictional Opinion; seconded by Trudy Vermehren; passed 5-0.

465 Lt. Island Rd, 1 large locust tree fallen down – want to cut up and remove.  Trudy Vermehren moved to approve the Jurisdictional Opinion; seconded by Lauren McKean; passed 5-0.

Jim Holmes & Annie Dillard, 24 Pleasant Pt Landing, prune Leland Cyprus which is against house, pick up stray limbs and dispose of them, and remove beach plum.  John Portnoy moved to approve the Jurisdictional Opinion; seconded by Trudy Vermehren; passed 5-0.

 Agent Greenberg-Lemos reported she had received another complaint regarding the LeBow-Rolbein  property (Map 15:120).  The shed was moved but a new tent has replaced the shed in the same location.  She will write a letter stating that the tent is still disturbing the resources and must be moved.

Barbara Brennessel recommended sending a pamphlet in every tax mailing explaining Conservation Commission jurisdiction and permit requirements under the Wetlands Protection Act and Wellfleet Environmental Bylaw. .  Agent Greenberg-Lemos stated that had been done in the past.  Barbara also reported people are using mowers or weed whackers to create paths through the salt marsh to Chipman’s Cove.  She is not sure what people can or cannot do even if they have easements. 

Lauren McKean distributed the first copy of the “Trip Planner” which covers various park programs, local information, advice on permitted uses, etc.  

Meeting Minutes

Trudy Vermehren moved to approve the amended June 6 meeting minutes; seconded by John Portnoy; passed 5-0.

Lauren McKean accepted the nomination to be  Chair of the Commission.  John Cumbler moved Lauren McKean become the Chair of the Conservation Commission; seconded by Trudy Vermehren; passed 5-0. Lauren McKean moved that Barbara Brennessel remain as Secretary;  seconded by John Portnoy; passed 5-0.

                           

Public Hearings 5:00 pm:

Crockett, 145 and 121 Holbrook Lane, Map 20, Parcel 132, Certificate of Compliance.  Agent Greenberg-Lemos stated the work was completed in compliance.  Lauren McKean moved to approve the Certificate of Compliance; seconded by Trudy Vermehren; passed 5-0.    

Boehringer, 10 Bay View Rd., Map 35, Parcel 33, Certificate of Compliance.  Mr. Boehringer questioned if he would be allowed to continue maintenance work on the fencing.  Agent Hillary Greenberg-Lemos recommended the Certificate of Compliance not be issued so that maintenance could continue for another two years and the Commission can monitor the erosion / maintenance.  Trudy Vermehren moved to postpone the Certificate of Compliance indefinitely; seconded by John Portnoy; passed 5-0.  

Boehringer, 164 Cliff Rd., Map 24, Parcel 100, NOI, Repair erosion / diffuse and divert storm water. (Cont’d).  Lauren McKean recused herself. Mr.  Boehringer stated sand has naturally come back into the eroded area of the coastal bank and Trudy Vermehren stated the Commission would want to know the amount of sand to be used for renourishment.  He stated no work will be done until the fall now.  Barbara Brennessel would like to know what he will be planting and how much, including the spacing.  Agent Greenberg-Lemos stated the project is not huge and could be approved because there are 2 drain pipes, added sand and plantings. Trudy Vermehren moved to approve the NOI with conditions; seconded by John Cumbler; passed 4-0.  Supervisor:  Agents    

Valli, 30 Ridge View Dr., Map 13, Parcel 134, RDA, construct addition and porch (Cont’d)  At the request of the applicant, John Portnoy moved to continue to 07/19/18; seconded by Barbara Brennessel; passed 5-0.

Steven Wellfleet Partners, LLC, 308 King Phillip Rd., Map 34, Parcel 4, RDA, flush cut dead pines, prune trees and revegetate (Cont’d).  Charles Wentz represented the applicant and stated the site visit identified the view corridor.  The Commission recommended they leave the black locust alone for now and cut  them once they grow to a trunk diameter of 5 inches.  The Commission had concerns with the damage caused by a dog tethered along the top of the coastal bank, and required as a condition that the dog be kept at least 10 feet back from the bank crest. Work will be performed in the fall.  Barbara Brennesell identified the RDA as a negative 2; seconded by Lauren McKean; passed 5-0.   

Reavey, 145 Indian Neck Rd., Map 28, Parcel 135, RDA, construct shed (Cont’d).  Photographs and new site plans were provided to the Commission where the shed could be located with 3 proposals. Mr. Reavey gave an overview of how he would like to support the shed with blocks and sono-tubes.  There was discussion regarding the 3 options.  John Portnoy requested that wetland shrubs  be planted as mitigation for previously damaged habitat.  The Commission wanted the shed out of the filter strip and requested a new site plan, identifying the tree on the property.  The Reavey’s would be willing to utilize diamond piers to support the shed..  The Commission will approve the RDA and the Reaveys will be responsible to come back to the agent with new plans for the location as well as to identify what will be planted.  Trudy Vermehren identified the RDA as a negative 2 with conditions; seconded by John Cumbler; passed 5-0.          

Mannel, 122 Village Lane, Map 47, Parcel 9, RDA, Septic upgrade.  Stephanie Sequin represented the applicant and gave an overview of the project.  A new leaching system is required.  Work is outside of the 100 foot buffer zone; however, the entire property is within the riverfront area.   

There will be no stock piling of materials on the site.  Trudy Vermehren identified the RDA as a Negative 2; seconded by Barbara Brennessel; passed 5-0.

The public hearing was closed at 6:15 pm.

Business Meeting reopened at 6:15 pm.

John Cumbler stated that the Commission toured several Town-owned lots on Lieutenant Island and near Hatches Creek with the chairman of the Open Space Committee to consider transfer to Conservation Commission custody. looked at the Open Space property which would be conveyed to the Commission.  Because no one appeared at the meeting from the Open Space Committee to represent the proposal, this issue will come before the Commission at a future date.
