Adaptation in Outer Cape Towns and Cape Cod Nat’l Seashore – to be addressed at a future meeting.

Molly Travers  – Natural Community Training:

            A Power Point presentation was given along with handouts to the Commission.  The Commission was requested to take notes if they see any unusual plant communities when they are out and about and report it to the State.  There is a website and survey/report to be filled out.   

       

Jurisdictional Opinions:  None

Meeting Minutes – March 21, 2018 – the Commission reviewed the meeting minutes and provided amendments.  Barbara Brennessel moved to approve the amended meeting minutes; seconded by Lauren McKean; passed 5-0.

May 2, 2018:  Barbara Brennessel moved to approve the amended meeting minutes; seconded by John Portnoy; passed 5-0.

There was a discussion regarding criteria for allowing the removal of trees within the resource and buffer z.  Deborah Freeman will supply a list of questions the Commission should consider.

Agent Greenberg-Lemos asked the Commission if they had received the DLTA scope.   

                                 

Public Hearings 5:00 pm:

Town of Wellfleet, 505 Long Pond Rd., Map 16, Parcel 655, RDA, Demolish existing ramp, grade area and place access matting.  Suzanne Thomas of the Beach Department did not attend the meeting.  Abutter Natalie Lee stated she lives behind the parking lot and there are issues with the lot such as over use and drainage and storm water is washing sediment into the water.  She stated the stairs are unsafe.  She has complained to the town for the past 2 years.  Agent Greenberg-Lemos will have a discussion with DPW and Suzanne Thomas for additional information regarding Ms. Lee’s concerns.  The Commission agreed the town should protect the pond due to the heavy usage.  Ms. Lee stated the ramp is in disrepair and the ramp is used for parking during the winter months.   The Commission agreed the stairway is unsafe and also noted several people put in their kayaks at this site, which causes additional wear and tear.  Barbara Brennessel moved to continue to June 6, 2018; seconded by John Portnoy; passed 6-0. 

Melvin, 35 Holbrook Ave., Map 20, Parcel 138, NOI, demolish and rebuild 2 dwellings (Cont’d).  Attorney Liza Cox and Engineer David Sadowski, representing the applicant, came to the table.  Additional information was provided to the Commission on the new site plan for the installation of the well and septic system.  The septic tanks will weigh more than originally stated.  The Commission expressed concerns with vehicle weights and ground pressure because the ground is wet and soft.  Mr. Melvin stated he will have information available at the site visit when the project is to begin.  John Portnoy stated that the site plan must include elevations referenced to the datum NAVD88.  Trudy Vermehren moved to approve the well and septic system with conditions; seconded by Barbara Brennessel; passed 6-0.  Supervisor:  Agent.   

Daniels, 260 Kendrick Ave., Map 20, Parcel 30, RDA, Construct driveway (Cont’).  Mr. Daniels came to the table and provided additional information for the Commission.  The Agent will send a letter to the contractor, who had performed the work without checking for approval first.  Barbara Brennessel identified this as a Negative 3; seconded by John Portnoy; passed 6-0.

McAuliffe, 40 Way 35, Map 13, Parcel 122, NOI, construct addition and enclosed porch.  Mark Slivka represented the applicant.  The Commission explained what they required on the plan since additional work continues on this property. The Commission limits development within the 100-ft buffer zone to 5000 square feet and, therefore needs to know existing and new-project coverage.  The new plan shows total developed-area coverage of just under 5000 square feet.  John Portnoy moved to approve the NOI; seconded by Deborah Freeman; passed 6-0.  Supervisor:  John Cumbler 

Boehringer, 164 Cliff Rd., Map 24, Parcel 100, NOI, Repair erosion / diffuse and divert storm water. (Cont’d).  At the applicants request, Trudy Vermehren moved to continue to June 6, 2018.  A fine of  $5.00 will be issued for excessive requests for continuations; seconded by Barbara Brennessell; passed 6-0.

Shields, 25 Harding Ln., Map 15, Parcel 44, RDA, Septic system upgrade.  David Lajoie represented the applicant and stated the system would be located within the driveway.  Trudy Vermehren identified the RDA as a Negative 3; seconded by John Portnoy; passed 6-0.

                       

Robin, 29 Briar Lane, Map 14, Parcel 26, RDA, Cantilevered add-on to existing pilings.  No work on ground.  Sarah Robin gave an overview of the project and stated there will be no new ground disturbance in the buffer zone or the adjacent wetland.   Barbara Brennessel identified the work as a Negative 3; seconded by Lauren McKean; passed 6-0.   A silt fence will be placed within the work limit.

.Bromberg, 195 Samoset Ave, Map 28, Parcel 97, RDA, Install beach stairs and cantilevered deck.   Lance Lalone represented the applicant and stated either cedar or mahogany wood will be  used for the steps and decking.  He stated the posts will be pressure treated lumber.  The propsed deck will extend from  the landing and will be one to two feet in height.  The deck will be approximately 6 x 6 feet and the Commission questioned how it could be cantilevered without support.  The stairs will be replacing the current stairs which are in disrepair.  There is an aluminum stairway extension stored during winter on the property and the Commission is concerned with winter storage; Lalone agreed to store the metal stairway on the new structure during winter.  Materials will be all hand carried to the project site.  The Commission stated no cantilevered deck will be approved, and the bottom of the stairs will not be placed in the water.  Mr. Lalone will provide a protocol stating the width and length of the wood.  Barbara Brennessel noted that owners should be responsible for cleaning up pieces of broken stairways when they are set adrift; she recommended some method of tagging so that the owners of broken pieces could be identified and notified of their responsibility for retrieval..  Trudy Vermehren identified the RDA as a Negative 2; seconded by John Portnoy; passed 6-0.    

The public hearing was closed at 6:30 pm and the Business Meeting reopened at 6:30 pm.

Agent Greenberg-Lemos reported on her activities.

Garry Onley, 479 Black Pond Rd., Map 4, Parcel 38:  another letter sent to him regarding the parking issues.

A letter to the Building Inspector regarding storage of derelict vehicles at Rose Garage on West Main St. 

Trudy Vermehren reported the repaving on West Road has directed road runoff directly into  Silver Spring Brook, which is illegal and needs to be corrected. .

415 Old Chequessett Rd, Map 12:52 MacGibbon – property that is for sale has plastic containers on property holding water and probably breeding mosquitoes.  Agent Greenberg-Lemos will contact the Cape Cod Mosquito Patrol to alert them of a potential health hazard; Portnoy said that he believed that CCMCP has the authority to control mosquitoes on private land.  They may be able to remove the containers.
