4:00 - Business Meeting & Conservation Agent's Report

            Tennis Courts – no planting plan was provided to the Conservation Commission when an Order of Condition was granted.  The Recreation Department went to Board of Selectmen for  approval to plant  privet around the tennis courts which was granted.  The commission would like to see native plants used instead and Agent Greenberg-Lemos will make recommendations. 

            Trudy Vermehren stated a wedding is scheduled behind Preservation  Hall with  approximately 120 people attending. She is concerned with the impact on Wesley Swamp, a vernal pool, and the proposed memorial park. 

            Letter from Mark Gabriel regarding the Memorial Garden at Preservation Hall and the impacts to the vernal pool.  The Commission again discussed the heavy use of the property and Town’s pumping of water from the pool and likely effects on the wetland and wildlife including State-threatened spadefoot toads.  Americorps will do a project to clean it up.  John Portnoy recommended a hydrologist be brought in to determine whether the pumping is needed to prevent flooding of local yards on underground wastewater systems.

Other discussion items:

Subdivision – Farmsworth – 135 Pine Point Road. 

Letter from DEP stating they withdrew the appeal for the Donald plan and the AOOC will be upheld. 

Letter from MA Audubon regarding 225 Harms Way and driveways.    ACEC project going on which will affect Wellfleet ACEC.    

Brian Carlson – Save the Date  June 12, 5:30 to 7:00 COA update on climate change

AJOR filed an appeal with DEP and Superior Court for the denial of the NOI

Meeting Minutes Ginie Page moved to approve the amended meeting minutes of 02/01/17; seconded by Trudy Vermehren; passed 2-0.

                                    

Trudy Vermehren moved to have Agent Hillary Greenberg-Lemos request Town Council’s  opinion on whether  members of the Commission who are also members of the Friends of Herring River and/or the Wellfleet Conservation Trust can vote on Herring River restoration permitting without conflict of interest; seconded by John Portnoy, passed 5-0.

Public Hearings 5:00 pm:

Madel/Morrisson, 88, 86 and 96 Samoset Rd., Map 28, Parcels 128, 128.1 and Parcel 129:  RDA, upgrade septic.  Stephanie Sequin represented the applicant.  She stated there are 3 properties that have been sharing cesspools and wells, and each property will now upgrade to Title V.  She stated the 100-year flood zone is identified on the site plan.   She gave an overview of the projects.   Lauren McKean moved to identify the RDA as a Negative 3; seconded by Ginie Page; passed 5-0.  Condition:  reseed with conservation mix of grasses.     

Williams, 64  and 70 Gull Pond Rd., Map 8, Parcel 25, NOI, install gravel driveway and drainage trenches.   David Lyttle represented the applicant and gave an overview of the project.  The driveway will have a paved apron with a catch basin and leach pit, then gravel with trenches on the sides, and the use of concrete retaining walls – all to  minimize grading, sheet flow and erosion.  He gave an overview of the materials which will be used for the slopes / grades.  There will be approximately 5,600 square feet of disturbance.   NHESP has not responded.  Trudy Vermehren moved to continue to June 7, 2017; seconded by John Portnoy; passed 5-0.    

Kelly, 20 4th Ave, Map 40, Parcel 15, Certificate of Compliance.  The work has been done in compliance.  Ginie Page moved to approve the Certificate of Compliance; seconded by John Portnoy, passed 5-0.

Trieschman, 14 Wigwam St., Map 35, Parcel 134, RDA, remove invasive autumn olive trees, replant with native vegetation, install stepping stones.  Charles Wentz represented the applicant and gave an overview of the project, removing olive trees by the road and planting native plants by the house.  The beach grass would be planted in the fall.  There will be a total of 61 plants, and drywells and downspouts will be added to the dwelling.  Trudy Vermehren stated there are stones in the road which need to be moved back onto private property because they force people to drive close to the marsh on the opposite side of the road.  Mr. Trieschman stated the rocks keep people off his personal property.  Ginie Page recommended determining the width of layout of Wigwam St.  Barbara Brennessel moved to identify the RDA as a 3; seconded by Ginie Page; passed 5-0.    

Slackman (Pearl Restaurant) 250 Commercial St., Map 21, Parcel 106, NOI, construct roof over 2nd story floor deck.  Tim Brady represented the applicant and stated the project consists of a roof over the second-floor deck.  Work will be done for roof run off.  The project will go to the ZBA.  The commission requested additional information regarding roof run off for the whole property.  Tim Brady requested a continuation to June 7, 2017.  Trudy Vermehren moved to continue to June 7, 2017; seconded by Barbara Brennessel; passed 5-0.     

Alexander, 49 Wigwam St., Map 35, Parcel 159, RDA, install two 120-gallon propane tanks.   Trudy Vermehren stated there are piles of dirt and concrete debris on the property.  Mr. Alexander stated the foundation had to be dug out due to roof construction and electrical installation.  Trudy Vermehren moved to identify the RDA as a Negative 3; seconded by Ginie Page; passed 5-0.   

Halloran, 1360 Chequesset Neck Rd., Map 18, Parcel 5, NOI, install stairs over coastal bank.  Trudy Vermehren moved to continue to June 7, 2017 at the request  of the applicant; seconded by John Portnoy; passed 5-0.

Wolff, 156 Pleasant Point Rd., Map 35, Parcel 110, NOI, rebuild cottage within 100 buffer zone.  Gordon Peabody and Trevor Pontbriand represented the applicant.  Gordon Peabody read a letter from MESA stating this would be an exemption.  He said that the relocation of the  cottage will correct the nonconforming  setbacks.  A silt fence will be used during the construction.  Native plantings will take place on the property.  The site plan did not identify which trees / invasives will be removed and what will be replanted.  The commission requested a new site plan be provided to the Agent.  Ginie Page moved to approve the NOI; seconded by Barbara Brennessel; passed 5-0.  Supervisor:  Lauren McKean
